Mgr Subject: PROPOSED COLLEGE/CANNON IMPROVEMENT DISTRICT Statement of the Matter Attached is a request that the Council consider formation of an improve- ment district. The area proposed for the improvement district lies east of El Camino Real and north of Palomar Airport Road and comprises approx. 0310- acres of privately-owned land and 294 acres of government-owned land. Petitions attached to the request contain the signatures of owners of 70% of the property. If the Council wishes to consider this request, an appropriate step at this time would be to request the preparation of an environmental impact report. : ' Exhibits 1. letter of request, list of property owners and petitions 2. map showing proposed district Recommendation If the City Council wishes to consider this request further, it is recommended that City Council direct the preparation -of an environ- mental impact report on the proposed project. The general location, general design, and extent of the improvements and right of way are as shown on the plat attached hereto. THE UNDERSIGNED hereby expressly waive the proceedings required and all limitations under the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," being Division 4 of the Streets and Highways Code of the State of California. The property owners hereby further agree upon signing this Petition, to dedicate all necessary right of way as determined necessary by the City Engineer for said improvements, and said dedications shall be accomplished before the ordering of the work by the City Council. THE UNDERSIGNED hereby further request that Rick Engineering Company, be authorized to act as Engineer of Work for said proceedings and to prepare all necessary plans and specifications and that F. Mackenzie Brown, Attorney at Law, be authorized for purposes of prepa- ration of proceedings and issuance of bond opinion. The property owners hereby further agree and consent to neces- sary work on private property to eliminate disparities in grade between said private property and the works of improvement. JO»Mft j~- PETITION FOR THE CONSTRUCTION OF CERTAIN PUBLIC IMPROVEMENTS, AND WAIVER OF RE- t QUIREMENTS OF DIVISION 4 OF THE STREETS ' AND HIGHWAYS CODE OF THE STATE OF CALIFORNI COLLEGE/CANNON IMPROVEMENT DISTRICT OH- —_ -~ THE UNDERSIGNED, cons Li tutiiuj the owners of property, and interested persons, as shown on the plat attached to this Petition, which property will be subject to the assessment for the improvements hereinafter requested, hereby request the institution of proceedings under the "Municipal Improvement Act of 1913," being Division 12 of the Streets and Highways Code of the State of California, with bonds to issue under the provisions of the "Improvement Act of 1911," being Division 1 of said Code, for the construction of certain street and sanitary sewer improvements, together with other public improvements, including all appurtenances and appurtenant work, including necessary street and right of way acquisition, in a special assessment district to be known and designated as the COLLEGE/CANNON IMPROVEMENT DISTRICT, City of Carlsbad, California, arid such other appurtenant work that is in the opinion of the City Engineer necessary to properly effectuate said improvement. The general location, general design, and extent of the improvements and right of way are as shown on the plat attached hereto. THE UNDERSIGNED hereby expressly waive the proceedings required and all limitations under the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," being Division 4 of the Streets and Highways Code of the State of California. The property owners hereby further agree upon signing this Petition, to dedicate all necessary right of way as determined necessary by the City Engineer for said improvements, and said dedications shall be accomplished before the ordering of the work by the City Council. THE UNDERSIGNED hereby further request that Rick Engineering Company, be authorized to act as Engineer of Work for said proceedings and to prepare all necessary plans and specifications and that F. Mackenzie Brown, Attorney at Law, be authorized for purposes of prepa- ration of proceedings and issuance of bond opinion. The property owners hereby further agree and consent to neces- sary work on private property to eliminate disparities in grade between said private property and the works of improvement. This consent to do work on private property is pursuant to the authority of Section 5104 of the Streets and Highways Code of the State of California. This Petition may be signed in counterpart and constitutes one Petition and Waiver, and may be consolidated with similar petitions Petition Page Two and waivers for similar improvements herein mentioned. We hereby further request that all efforts and attempts be made so that said proceedings and the Resolution of Intention can be adopted at the earliest time.
