Subject: AMENDMENTS TO TITLE 21, CARLSBAD MUNICIPAL CODE, REVISION OF REQl ES. (ZCA 67) Statement of the Matter The City Council at your May 6, 1975 meeting directed the City A to prepare the necessary ordinance to amend Title 21, Chapters 2 21.08, 21.10 and 21.42 to revise the requirements for greenhouse ordinance to accomplish the amendments as recommended by the Pla Commission in Resolution No. 1146 is attached. Exhibit Ordinance No. Recommendation If the City Council concurs in the amendments as recommended by Planning Commission, your action is to introduce Ordinance No. 8 Council Action . 6-3-75 Ordinance No. 9426 was introduced for a first reading by ti only. Ordinance #9426 was given a second reading and adopted. 6-17-75 I .\ 1 2 3 4 5 6 7 8 9 10 11 12 13 ORDINANCE NO. 9427 AN ORDIN NCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTERS 21.07, 21.08, 21.10 AND 21.42 TO REVISE THE REQUIREMENTS FOR GmENHOUSES. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Title 21, Chapter 21.07, Section 21.07.020 of the Carlsbad Municipal Code is amended by the amendment of subsection(4) to read as follows: "(4) Greenhouses less than 2,000 square feet provided all requirements for yard setbacks and height are met." SECTION 2: Title 21, Chapter 21.07, Section 21.07.040 of the Carlsbad Municipal Code is amended by the addition of sub- section (12) to read as follows: "(12) Greenhouses greater than 2,000 square feet, provided all requirements for yard setbacks and height are met." SECTION 3: Title 21, Chapter 21.07 of the Carlsbad Muni- cipal Code is amended by the amendment of Section 21.07.110 to read as follows: "21.07.110 Lot coverage. Lot coverage with buildings and structures shall not exceed , .forty percent of the lot. Buildings and structures used for growing or raising plants are not counted as coverage." SECTION 4: Title 21, Chapter 21.08, Section 21.08.010 of the Carlsbad Municipal Code is amended by the amendment of subsec- tion (3) to read as follows: ''(3) Greenhouses less than 2,000 square feet in area. Greenhouses greater than 2,000 square feet are permitted by ap- proved conditional use permit only. SECTION 5: Title 21, Chapter 21.08 of the Car-sbad Mun cipal Code is amended by the amendment of Section 21.08.090 to read as follows: "21.08.090 Lot coverage. Lot coverage with buildings and structures shall not exceed 40% of the lot. Buildings and structures used for growing or raising plants are not counted as coverage. 'I SECTION 6: Title 21, Chapter 21.10, Section 21.10.010 of the Carlsbad Municipal Code is amended by the amendment of subsection (3) and the addition of subsection (9) to read as follows: "(3) Greenhouses less than 2,000 square feet in area. Greenhouses greater than 2,000 square feet are permitted by ap- proved conditional use permit only.In either instance all require- ments for yard setback and height shall be met." "(9) Packing or sorting sheds of a total floor area of 600 square feet or less. Packing and sorting sheds greater than 600 square feet are permitted by approved conditional use permit only. 'I SECTION 7: Title 21, Chapter 21.10 of the Carlsbad Muni- cipal Code is amended by the amendment of Section 21.10.090 to read as follows: "21.10.090 Lot coverage. Lot coverage with buildings and structures shall not exceed 40% of the lot. Buildings and structures used for growing or raising plants or animals are not counted as coverage. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoptioi INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 3rd day of June , 1975, and thereafter PASSED AND ADOPTED at a regular meeting of said Council held on the 17th day of June , 1975, by the following vote, to wit: AYES: Councilmen Frazee, Chase, Lewis, Skotnicki and Councilwoman Casler NOES: None ABSENT: None /d&CLZid5, ROBERT C.
