Mgr. ?^ Applicant: Dale El kins Statement of the Matter: The Planning Commission is recommending approval of a tentative subdivision map (cT 75-3) providing for six condominium units on 0.392 acre, one lot parcel, generally located on the northwest corner of Gibraltar Street and Jerez Court. Exhibits: Planning Commission Resolution No. 1156 Staff Report dated May 13, 1975 - : Plat Map, Exhibit A, dated 4/3/75 Recommendation: Staff recommends that CT 75-3 be approved for the reasons outlined in Planning Commission Resolution No. 1156. If the City Council concurs with the Planning Commission recommendation, the Council should direct the City Attorney to prepare the necessary documents. Council Action: . • 6-17-75 Following the public hearing the City Attorney was directed to prepare the necessary documents for approval of the tentative map to include the conditions set forth in Planning Commission Resolution#1156. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 PLANNING COMMISSION RESOLUTION NO. 1156 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF THE TENTATIVE MAP REQUEST FOR A ONE-LOT PARCEL ON PROPERTY GENERALLY LOCATED ON THE NORTHWEST CORNER OF GIBRALTAR STREET AND JEREZ COURT. CASE NO. CT 75-3, APPLICANT: DALE ELKINS WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did on May 27, 1975 hold a duly noticed public hearing to consider a request by Dale El kins. WHEREAS, a verified application for a certain property, to wit: Lot 357, La Costa South, Unit No. 5, Map No. 6600, Carlsbad, California has been filed with the City of Carlsbad and referred to the Planning Commiss- ion; and WHEREAS, said verified application constitutes a request as provided by the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy of the City of Carlsbad and has provided the necessary information which insures Public Facilities will be available concurrent with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972" because the project is small in scale and is in an already developed area; and WHEREAS, the proposed map meets or performs the requirements or conditions of the "Carlsbad Municipal Code" or the Subdivision Map Act; and WHEREAS, at said hearing a staff report was presented and all persons desiring to speak on the subject request were heard. At the conclusion of said hearing, after considering all the evidence presented, the Planning Commission made certain findings and reached a decision on the request as here- inafter set forth. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That the Planning Commission makes the following findings of fact: 1) That the proposed map is consistent with the General Plan because: Oii 1) T b 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 a) The development is within the density requirements of the General Plan. 2) That the proposed map is consistent with applicable Specific Plans because: a) It meets the requirements of the La Costa Master Plan. 3) That the site is physically suitable for the type of development because: a) Grading has been completed. b) No topographic or geologic hazards are present. 4) That the design of the subdivision or the proposed improvements will not cause substantial environmental damage or substantially injure fish or wildlife or their habitat because: a) Natural habitat has been removed. C) That in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to approve Case No. CT 75-3, subject to the following conditions: 1) The Final Map shall be submitted for approval within eighteen months from the final action by the City Council on the Tenta- tive Subdivision Map. The Final Map shall be in substantial conformance of the Tentative Subdivision Map known as Exhibit A, dated 4/3/75. This Exhibit A is for the lot only, not approval of location of buildings. 2) The development of the property described herein shall be sub- ject to the restrictions and limitations set forth herein which are in addition to all requirements, limitations and restrict- ions of all municipal ordinances and State and Federal statutes now in force, or which, hereafter, may be in force for the pur- pose of preserving the residential characteristics of adjacent properties. 3) All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City standards, to the satis- faction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 4) All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to approval of the Final Map unless approved by the City Engineer. 5) All utilities, including provisions for cable television, shall be placed underground and/or shall be completely concealed from view. 6) Park-In-Lieu Fees shall be granted to the City concurrent with City Council approval of the Final Map. -2- t \' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 7) Adequate ingress and egress, parking facilities and interior cir- culation shall be accommodated through the building permit process to the satisfaction of the City Engineer. REQUEST: The applicant is requesting approval of a tentative subdivision map providing six condominium units on 0.392 acre, one lot parcel, generally located on the northwest corner of Gibraltar Street and Jerez Court. Three of the six units are under construction as apartments. II. RECOMMENDATION: Staff recommends that the Tentative Subdivision Map be APPROVED based on the following justifications: 1) The tentative map meets all City ordinance and policy requirements. 2) The tentative map meets all requirements of the Subdivision Map Act. Recommended Conditions of Approval: 1) The Final Map shall be submitted for approval within one year from the final action by the City Council on the Tentative Subdivision Map. Public Service Facilities: Letters indicating available public services for the project have been received from the following departments at the writing of this staff report. If letters from all departments are not received by the time of public hearing for this item, staff recommends tabling with concurrence of applicant, or denial without prejudice. 1) Carlsbad Municipal Water District - received 2) Leucadia County Water District - received 3) San Dieguito Union High School District - not received 4) Encinitas Elementary School District- not received III. BACKGROUND: A. Location: Lot 357, La Costa South, Unit #5. B. Legal Description: Lot 357, La Costa South, Unit No. 5, Map No. 6600, Carlsbad, California. C. Site Description: The project is situated in an area with various grades. A predominant slope runs generally south to north. The subject parcel is located on the northwest corner of the intersection of Gibraltar Street and Jerez Court. All grading on the site has been completed. D. Project Description: The site now includes three structures approxi- mately 60% complete, originally planned as apartments. These buildings are two stories and face in an easterly direction towards Jerez Court. Also, a swimming pool has been partially constructed on the site, along the northern property line. The existing three units and pool would be combined with three additional units on the undeveloped portion of the parcel to form a total condominium project. -3- £• Zoning: Subject Property: RD-M North: RD-M South: RD-M East: RD-M West: P-C F. Surrounding Land Use: Surrounding development is devoted to condominiums, with a number of undeveloped parcels in the vicinity. Open space in the form of a golf course runs generally along the western edge of the property. An undeveloped parcel is located to the north, with condominiums across Jerez Court on the east and across Gibraltar on the south. G. General Plan Recommendation: The project conforms to the General Plan designation of Residential High Density at 20-30 dwelling units per acre. H. Discussion: Three units on the parcel are under construction as apartments. However, the applicant has planned the development to ultimately be condominiums. As a result, in addition to the basic requirements, the tentative map shows locations of the additional three units, parking facilities and dimensions. On the basis of these plans, staff in Planning, Building and Engineering has expressed concern over the three existing units and their relationship to the planned units as a complete develop- ment. As the plans for the total development now stand, distinct interior circulation and parking problems exist. Since these issues are not subject to total evaluation at this point, staff feels that if the plans for the total development remain the same, specific problems should be resolved through the building permit process.
