Statement of the Matter
The City Council at your meeting, of June 17, 1975 directed the City
Attorney to prepare the necessary documents approving preannexation
zone change (ZC-153) . The resolution approving the zone change and
the ordinance adopting the zone change are attached.

Recommendation '
If the Council desires to approve preannexation zone change (ZC-153) ,
your action is to adopt Resolution No.^^/T/ and introduce Ordinance
Council action
7-1-75 Resolution #3676 was adopted, announcing findings and decision
on a preannexation change of zone (ZC-153.
Ordinance #9430 was introduced for a first reading, granting
a preannexation change of zone from E-l-A to P-C.
7-15-75 Ordinance #9430 was given a second reading and adopted.

RESOLUTION NO. 3676
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION ON A PREANNEXATION
CHANGE OF ZONE (ZC-153) FROM SAN DIEGO
COUNTY E-l-A TO P-C (PLANNED COMMUNITY
ZONE) ON A 13.9-ACRE SITE LOCATED ON THE
EAST SIDE OF EL CAMINO REAL APPROXIMATELY
2,500 FEET NORTH OF ALGA ROAD. APPLICANT:
WILLIAM CANNING FOR C.W.C. DEVELOPMENT.
WHEREAS, on April 8, 1975 a dully advertised public
hearing was held before the Planning Commission in a manner
prescribed by law to consider a preannexational change of zone
from San Diego County E-l-A to RD-M (residential density-multiple
zone) on a 13.9-acre site located on the east side of El Camino
Real approximately 2,500 feet north of Alga Road, more particularly
described as: -
Parcel A, West Half of Northeast Quarter, Survey 26,
Township 12 South, Range 4 West, San Bernardino
Meridian, County of San Diego;
and ,
WHEREAS, at the conclusion of said hearing, the Planning
Commission adopted Resolution'No. 1147 recommending denial without
prejudice; said resolution is herewith referred to and made a
part hereof; and
. WHEREAS, on May 6, 1975, the City Council of the City of
Carlsbad held a public hearing on the appeal of said denial,
received all recommendations and heard, all persons interested in
or opposed to the proposed change of zone and indicated their
intent to grant said appeal, to the extent of rezoning the property
P-C, and referred the matter back to the Planning Commission for

report; and .
WHEREAS, on May 27, 1975 the Planning Commission heard
the request again and recommended the City Council grant P-C
zoning on the subject property for the following reasons:
o
1. The P-C Zone will allow coordination of open space
systems with the San Diego Gas and Electric Company easement.
2. The P-C Zone would also allow development of the
property to be coordinated with property to the east and north.
3. The P-C Zone would allow greater flexibility in de-
signing, with special treatment areas .such as El Camino Real or
the archeological site.
4. The P-C Zone will promote a smoother transmission from
the subject property to the higher density area to the south.
WHEREAS, said application has complied with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972, and an Environmental Impact Report was filed and dis-
cussed at a duly noticed public hearing held by the Planning
Commission, and was approve'd as presented;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
v 1. That the above recitations are true and correct.
2. That the approval of the proposed preannexation change
of zone classification is necessary to carry out the general
purpose of Title 21 of the Municipal Ccpde.
3. That the City Council of the City of Carlsbad intends
to.adopt an ordinance to effectuate the proposed preannexation

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 1st day of July / 1975,
by the following vote, to wit:

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE
BY AMENDING THE ZONING MAP TO GRANT A
PREANNEXATION CHANGE OF ZONE FROM SAN DIEGO
COUNTY E-l-A TO P-C (PLANNED COMMUNITY
ZONE) ON A 13.9-ACRE SITE LOCATED ON THE
EAST SIDE OF EL CAMINO REAL APPROXIMATELY
2,500 FEET iIORTH OF ALGA ROAD. APPLICANT:
WILLIAM CANNING. FOR C.W.C. DEVELOPMENT
The City Council of the City.of Carlsbad, California
does ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning map of the City of Carlsbad
to grant a preannexation change of zone from San Diego County E-l-A
to P-C (Planned Community Zone) for the following described
property:
PARCEL A, West Half of Northeast Quarter, Survey 26,
Township 12 South, Range 4 West, San Bernardino
Meridian, County of San Diego.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adop-
tion.
INTRODUCED AND FIRST READ at a meeting of the Carlsbad
City Council held on the 1st day of July , 1975, and
thereafter
PASSED AND ADOPTED at a meeting of said City Council held
on the 15th aay Of July , 1975, by the following vote,
