Applicant: City of Carlsbad Statement of the Matter: The Planning Commission is recommending approval of the change to Open Space all the City schools, parks, lagoons, beach areas and other sites designated on the land use plan as open space areas. Exhibits: Planning Commission Resolution No. 1152 Planning Commission Resolution No. 1162 Planning Department Memorandum to Planning Commission, June 19, 1975 Site Maps Recommendation: Staff recommends that ZC-155 and ZC-156 be approved for the reasons outlined in Planning Commission Resolution- No. 1152 and No. 1162. If the City Council concurs with the Planning Commission recommendation, the Council should direct the City Attorney to prepare the necessary documents. •' City Manager's Recommendation; Since the Planning Commission's consideration of this item, some addi- tional information has been developed. That land recommended for rezoning from P-U to E-A in Exhibit 19 is covered by a specific plan. At least a portion of that specific plan may be inconsistent with the recommended zone change.' In order to make the zoning, general plan, arid specific plan all consistent with each other, many alternatives are available. It is therefore recommended that that .portion of Exhibit 19 which recom- mends a rezoning from P-U to E-A be referred back to the Planning Com- mission for further study and report. ZC-155 and ZC-156 ' WHEREAS, the public hearing to consider the subject rezoning was held at the time and in the place specified in said notice on May 13, 1975; and WHEREAS, at said public hearing-, upon hearing and considering the testi- mony and arguments, if any, of all persons who desired to be heard, said Commission considered all factors relating to the Zone Change and found the following facts and reasons to exist: 1) This Zone Change is justified because it will implement the goals and objectives of the General Plan of the City and provide for open space and recreational uses which have been deemed necessary for the • aesthetically attractive and orderly development of the community. 2) This Zone Change will make the Land Use Plan and Zoning Map consis- tent, which is a mandatory requirement under the provisions of the California Government Code (Section 65860). 3) The permitted uses in this proposed classification will not be detrimental in any way to surrounding properties because the areas to be rezoned are now developed as park sites, beach areas, or are proposed to be developed as active or passive recreational areas or will remain as visual open space areas which will be of great benefit to residents of the City of Carlsbad. 4) The properties in this application are more suitable for the pro- posed zone than the existing zone because Open Space (0-S') Zoning will more accurately reflect existing and proposed land uses of these properties. Agatep, Secretary -2- " '•• MEMORANDUM •j June 19, 1975 TO: , PLANNING COMMISSION FROM: PLANNING DIRECTOR SUBJECT: ZC 156 (CITY INITIATED REZONING TO OPEN SPACE) At your regularly scheduled June llth meeting, the Planning Commission forwarded to the City Council a complete rezoning program which would achieve consistency of General Plan and Zoning pursuant to requirements of Assembly Bill 1301. Zone Change 155 and 156 recommended rezoning a number of properties to Open Space to insure zoning and General Plan consistency. During the course of the Planning Commission hearing, sub- stantial discussion revolved around the rezoning from Public Utilities to Open Space of 254.8 acres of SDG&E property east of 1-5 and south of the Agua Hedionda Lagoon. After discussion by the Commission, SDG&E representatives and the staff, the SDG&E parcel was recommended by the Planning Commission to be rezoned to Exclusive Agricultural. During City Staff review of the Planning Commission action, a number of new issues have developed to the point that the staff will recommend to the City Council preceding with the Open Space rezoning program and in the event that the SDG&E parcel is not rezoned at this time, the council could still proceed with the entire Open Space Rezoning Program without refering the matter back to the Planning Commission for report. It is requested that the Planning Commission, by minute motion, recommend to the City Council that the Open Space Program be approved and in the event that the issues which involve SDG&E Company lands east of 1-5 and south of Agua Hedionda Lagoon are treated as a separate matter that the Planning Commission would concur with the Council's action of completing as much of the proposed Open Space program as practical and resolve the problem issues as a separate action on a subsequent date.
