Subject: MEMORANDUM OF UNDERSTANDING WITH FIREFIGHTERS ASSOCIATION, * FISCAL 'YEAR 1975-76. Statement of the Matter The attached resolution and its exhibit represent the agreement between the City and the Carlsbad Firefighters Association pertaining to changes to the conditions of employment for Fiscal Year 1975-76. Exhibit Resolution No. 3691 .- Exhibit 'A' - Memorandum of Understanding between the City of Carlsbad and the Carlsbad Firefighters Association for Fiscal Year 1975-76. City Manager's Recommendation The management team has reached an understand-ing with the . Carlsbad Firefighters Association as described in Exhibit 'A' attached and it is recommended that the City Council adopt .Resolution No. 3691 ratifying that Memorandum of Understanding. Council action 7-1-'75 Resolution #3691 was adopted, accepting Memorandum of Understanding between the City of Carlsbad and the. RESOLUTION NO. 3691 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A MEMORANDUM OF UNDERSTANDING BETWEEN REPRESENTATIVES OF MANAGEMENT AND THE CARLSBAD FIREFIGHTERS ASSOCIATION. WHEREAS, representatives of Management and the Carlsbad Firefighters Association have been conducting negotiations pursuant to the Meyers-Milias-Brown Act regarding wages and other terms and conditions of employment for the 1975-76 fiscal year; and WHEREAS, said representatives have reached agreement which they desire to submit to the City Council for approval; and WHEREAS, the City Council has determined it to be in the public interest to accept such an agreement in the form of a Memorandum of Understanding marked Exhibit A and incorporated by reference herein; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the Memorandum of Understanding between the Carlsbad Firefighters Association and representatives of Management is hereby accepted. 3. That the City Council intends to implement said Memo- randum by incorporating its terms into the salary plan for fiscal year 1975-76 and the personnel rules of the City of Carlsbad and by other appropriate actions as necessary in accord with its terms. an adjourned PASSED, APPROVED AND ADOPTED at 1 regular meeting of the Carlsbad City Council held on the 8th day of July , 1975, 11 1: 21 2: 21 2 2 2' '* 3 by the following vote, to wit: AYES : Councilmen Frazee, Lewis, Skotnicki and NOES: Councilman Chase ABSENT: None Councilwoman Casler ATTEST : I 2. EXHIBIT A I MEMOR~NDUM OF UNDERSTANDING BETWEEN MANAGEmNT REPRESENTATIVES OF THE CITY OF CARLSBAD AND THE CARLSBAD FIRE- FIGHTERS ASSOCIATION FOR FISCAL YEAR 1975-1976 WHEREAS, the City of Carlsbad Firefighters Association has been negotiating as part of the meet arid confer process with representatives from Management regaraing wages and certain other terms and conditions of employment to be effec- tive for fiscal year 1975-1976; and WHEREAS, the parties to said negotiation have reached agreement and wish to present this Memorandum of Understand- ing incorporating all terms of that agreement to the City Council and request that it be approved and implemented; NOW, THEREFORE, IT IS AGREED by and between the Management representatives (City) and the Carlsbad Firefighters Association (Association) that the following terms and condi- tions of employment for fiscal year 1975-1976 be submitted to the City Council: 1. Personnel Included. This agreement shall apply to the following employees in the Carlsbad Fire Department. (a) Fire Battalion Chief (b) Fire Captain (c) Fire Engineer (d) Fireman 2. Salary Adjustment. The City shall provide a 7.25% salary increase for all ranges and steps for all in- t . eluded personnel effective as of July 1, 1975. 3. Actuarial Survey, City agrees to request at City expense an actuarial survey of local safety members of the City for the purpose of determining the cost of the following changes to the contract with the Public Employees Ret iremen t Sy s tem : (a) Revised retirement plan corresponding to that retirement plan currently used by the California Highway Patrol. (b) The 1959 Survivor Benefit Plan, (c) Computation of retirement pay based upon highest single year of compensation. The accomplishment of said actuarial survey shall not be construed as a commitment by the City to implement any contract changes 4. Service Requirement for Salary Step B. City and Association agree that any employee hired on or after July 1, 1975 shall have a minimum service requirement of one year for movement from Salary Step A to Salary Step B . in all salary ranges. 5. City Council Policy Number 3. City and Association agree that contents, essence and conditions addressed in City Council Policy Number 38 regarding City-paid tuition assis- tance for employees, be incorporated in Personnel System Rules and Regulations at such time as those rules are redrafted. 2. . 6. Maximum Education Incentive Program Pay. City and Association agree that the present maximum for Educa- tion Incentive Program pay for personnel included shall be increased to include the following: (a) Seven years of City service. (b) Accumulation of 90 credits. (c) Incentive payment of 10% of basic salary. 7. Work Schedule Adjustment. City and Association agree that existing hours worked during existing cycles shall be modified only to provide for a cycle which permits "double kelly" days for personnel included. 8. Continuance of Terms. All other terms and condi- tions of employment applicable to included personnel and not inconsistent with the terms of this Memorandum of Understand- ing shall remain in effect. , 1975.
