AND OTHER SITES. APPLICANT: CITY OF CARLSBAD
Statement of the Matter
The City Council at your meeting of July 1, 1975, directed the City
Attorney to prepare the necessary documents approving the zone
changes of City schools, parks, lagoons, beach areas and other sites.
The resolution approving the zone change and the ordinance adopting
the zone change are attached.

7-17-75 Resolution #3694 was adopted, announcing findings and decision
on the change of zone to Open Space Zone (0-S).
Ordinance #9432 was introduced for a first reading granting the
change of zone on certain designated properties to 0-S.

RESOLUTION NO.3694
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION ON A CHANGE OF ZONE
(ZC-155 AND ZC-156) REZONING A NUMBER OF
CITY SCHOOL SITES, CITY PARK SITES AND
OTHER LANDS TO 0~S (OPEN SPACE ZONE).
APPLICANT: CITY OF CARLSBAD
WHEREAS, on May 13, 1975 and June 11, 1975, duly adver-
tised public hearings were held before the Planning Commission
in a manner prescribed by law to consider a change of zone from
a number of zones to 0-S (Open Space Zone) and to consider the
application of the O-S zone to previously rezoned property located
throughout the City and more particularly described in Planning
Commission Resolutions 1152 and 1162 on file in the Planning
Department and incorporated by reference herein; and
WHEREAS, at the conclusion of said hearings, the Planning
Commission adopted Resolutions Nos. 1152 and 1162 recommending
said zone changes; and
WHEREAS, on July 1, 1975, the City Council of the City
of Carlsbad held a public hearing on the matter and received all
recommendations and heard all persons interested in or opposed to
the proposed changes of zone; and
WHEREAS, the zone change application has complied with the
City of Carlsbad Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained

in the aforementioned Resolutions Nos. 1152 and 1162 constitute
the findings of the Carlsbad City Council
3. That the approval of the proposed change of zone
classification is necessary to carry out the general purpose of
Title 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed change of zone,
excepting properties Nos. 12, 18 and 4 which have been referred to
staff for further study.
PASSED, APPROVED AND ADOPTED at a meeting of the City
Council on the 17th day of July , 1975, by the following vote,
to wit:
AYES: Councilmen Frazee, Chase, Lewis, Skotnicki and
Councilwoman Casler

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE .
BY AMENDING THE ZONING MAP TO GRANT A
CHANGE OF ZONE FROM A NUMBER OF ZONES TO
O-S (OPEN SPACE ZONE) ON PROPERTY LOCATED
THROUGHOUT THE CITY OF CARLSBAD IN ACCORD
WITH THE OPEN SPACE ELEMENT OF THE GENERAL
PLAN.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning map to grant the following
change of. zones:
1. Buena Vista Elementary School Site, 1330 Buena Vista
(approximately 9.2 acres) located southerly of Las Flores Drive,
northerly of Buena Vista Avenue and easterly of Olive Drive, from
unzoned to O-S, as shown and more particularly described on
Exhibit 1, Assessor's Map 156-12 attached hereto and made a part
hereof.

2. Jefferson Elementary School Site, 3743 Jefferson
Street (approximately 8.2 acres) located westerly of Jefferson

Street between Magnolia Avenue and Tamarack Avenue, from unzoned
to O-S, as shown and more particularly described on Exhibit 2,
Assessor's Map 204-28 attached hereto and made a part hereof.
3. Pine Elementary School Site, 801 Pine Avenue (approxi-
mately 13.6 acres), located westerly of Harding Street, southerly
of Pin& Avenue and northerly of Palm Avenue, from unzoned to O-S
as shown and more particularly described'on Exhibit 3 and 3a,

made a part hereof.
7. Laguna Riviera Future School Site (approximately 8.3
acres), located southerly of Hillside Drive, westerly of Valley
Drive and easterly of Cordoba Place, from unzoned to 0-S, as shown
and more particularly described on Exhibit•7, Assessor's Map
207-24, Sheet 2, attached hereto and made a part hereof.

12. Oak Park Site (approximately 0.18 acres), located

EFFECTIVE DATE: This ordinance shall be effective thirty
