MEMORANDUM OF UNDERSTANDING WITH CARLSBAD CITY MISCELLANEOUS EMPLOYEES' ASSOCIATION Statement. of the Matter The attached resolution and its exhib2t represent the agreement between the City and the Carlsbad City Miscellaneous Employees' Association pertaining to changes to the conditions of employ- ment for Fiscal Year 1975-76.' Recommendation If Council concurs, adopt Resolution No. JLpf ratizying that Memorandum of Understanding. Council action. 7-17-75 Resolution #3699 was adopted, accepting a Memorandum of Under- Standing between Representatives of Management and the Carlsbad City Miscellaneous Employees Association. .. 1 2 3 4 5 6 7 8 9 10 11 32 13 14 15 16 17 le 19 2c 21 22 22 24 25 26 27 2e 29 3c 33 32 RESOLUTION NO. 3699 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A MEMORANDUM OF UNDERSTANDING BETWEEN REPRESENTATIVES OF MANAGEMENT AND THE CARLSBAD CITY MISCELLANEOUS EMPLOYEES ASSOCIATION. WHEREAS, representatives of Management and the Carlsbad City Miscellaneous Employees Association have been conducting negotiations pursuant to the Meyers-Milias-Brown Act regarding wages and other terms and conditions of employment for the 1975-76 fiscal year; and WHEREAS, said representatives have reached agreement which they desire to submit to the City Council for approval; and WHEREAS, the City Council has determined it to be in the public interest to accept such an agreement in the form of a Memorandum of Understanding marked Exhibit A and incorporated by reference herein; City xx X NOW, THEWFORE, BE IT RESOLVED by the City Council of the of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the Memorandum of Understanding between the Carlsbad City Miscellaneous Employees Association and representatives of Management is hereby accepted. 3. That the City Council intends to implement said Memorandum by incorporating its terms into the salary plan for fiscal year 1975-76 and the personnel rules of the City of Carlsbad and by other appropriate actions as necessary in accord with its terms. -- A xx xx xx t I. 2 3 4 5 6 7 8 9 ,10 32 33 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 17th day of July 1975,.by the following vote, to wit: I AYES : Councilmen Frazee, Lewis, Skotnicki and Councilwoman NOES : Councilman Chase Casler ABSENT: &one ATTEST : ? i EXHIBIT A MEMORANDUM OF UNDERSTANDING BETWEEN MANAGEMENT REPRESENTATIVES OF THE CITY OF CARLSBAD AND THE CARLSBAD CITY MISCELLANEOUS EMPLOYEES ASSOCI- TION FOR FISCAL YEAH 1975-76. WHEREAS, the City of Carlsbad City Miscellaneous Employees Association has been negotiating as part of the meet and confer process with representatives from Management regarding wages and certain other terms and conditions of employment to be effective for fiscal year 1975-1976; and WHEREAS, the parties to said negotiation have reached agree- ment and wish to present this Memorandum of Understanding incorporating all terms of that agreement to the City Council and request that it be approved and implemented; NOW, THEREFORE, IT IS AGREED by and between the Management representatives (City) and the Carlsbad City Miscellaneous Employees Association (Association) that the following terms and conditions of employment for fiscal year 1975-1976 be submitted to the City Council: 1. 2. 3. Employee Suggestion Award Program. Maternity Leave, City and Association agree that at such time as the existing Personnel System Rules and Regulations are redrafted they will provide the following. a. That a pregnant employee may continue to work until such time as the employee's physician declares that continued work would endanger the health or safety of the employee. b. That a pregnant employee may use all and any accrued sick leave and vacation for purposes related to the termination of pregnancy. ># c. That an employee who has terminated a pregnancy may return to work at any time after the termination of the pregnancy that the employee's physician declares the return to work will not endanger the health and or safety of the employee, 5. City Council Policy Number 3. City and Association agree that contents, essence and conditions addressed in City Council Policy Number 3, regarding City-paid tuikion assistance for employees, be incorporated in Personnel System Rules and Regulations at such time as those rules are redrafted. 6, Service Requirement for Salary Step B. City and Associa- tion agree that movement from Salary Step A to Salary -2- 7. 8. Step B shall coincide with the change of employee status from probationary to permanent, to apply to all employees hired on or after July I, 1975. City and Association agree that those employees working a 10-hour day, four day week work schedule shall work two designated Fridays of each succeeding January tc compensate for those work weeks during which holidays shortened the work week to 30 hours and for which the employees were paid for a total of 32 hours. Continuance of Terms. All other terms and conditions of employment applicable to included personnel and not inconsistent with the terms of this Memorandum of Under- standing shall remain in effect.
