Subject: 1975-76 LIGHTING DISTRICT REPORT Statement of; the Matter • In Resolution No. 3678, the City Council--declares its intention to form and establish three lighting maintenance districts in the City to provide .for the operation and maintenance of a street lighting system in the City for a two year period. A duly noticed public hearing has been scheduled to consider the formation of the district and the individual assessments proposed to be levied in support thereof. In accordance with said resolution, this department has secured the preparation of the necessary documents. The proposed districts are substantially the same-as the existing districts with the exception of District No. 3 (ornamental) which has been enlarged to include new subdivision areas. The items of maintenance and operation to be furnished and the boundaries of the districts are contained in the engineering report and in Resolution No. 3656. Staff recommends they be approved. The costs to be assessed have been determined and the extent of City participation has been decreased as follows: District No. 1 ..9.% to 0.5%" District No. 2 18% to 3.4% District No. 3 5% to 1.6% The total estimated first year costs are as follows: City ' . In order to have the assessments placed on the property tax bill and collected by the Tax Collector, it is necessary for the City Council to approve lists of special assess- ments. Staff recommends the assessment roll be confirmed as submitted. The funds necessary for the City's participation in the lighting districts have been appropriated in the 1975-76 budget. It is "also necessary that the Council enter into a street lighting contract for the operation and partial maintenance of the lighting system. Staff recommends that the Council determine that SDG&E is the only contractor capable of performing said contract and authorize Agenda Bill No. 3354 Suppl. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ORDERING THE FORMA- TION OF LIGHTING MAINTENANCE DISTRICTS NO. 1, 2 AND 3 IN SAID CITY AND CONFIRMING ASSESS- MENTS THEREFOR _______„_________________._ WHEREAS, the City Council of the City of Carlsbad did on May 6, 1975 pass Resolution No. 3638 ordering the City Engineer to prepare and file a report pursuant to the Municipal Lighting Maintenance District Act of 1927 for the maintenance and operation of a street lighting system in the City of Carlsbad; and WHEREAS, the City Engineer of said City has filed with the City Council of said City said report in writing, as directed by the City Council; and WHEREAS, the said City Council did on the 3rd day of June, 1975, pass Resolution No. 3656 approving said report of said City Engineer; and WHEREAS, the City Council of the City of Carlsbad did on the 3rd day of June, 1975 pass its Resolution of Intention No. 3657, declaring its intent to establish lighting maintenance districts in the City of Carlsbad and setting a time and place for hearing protests thereto; and WHEREAS, notice for said public hearing was incomplete; and WHEREAS, the City Council did on the 1st day of July, 1975 pass Resolution No. 3677 rescinding Resolution No. 3657 and pass Resolution of Intention No. 3678, declaring its intent to establish lighting maintenance districts in the City of Carlsbad and setting August 5, 1975 at 7:00 p.m. as the time and place for hearing protests thereto; and WHEREAS, the said Resolution of Intention was duly and 1 8 10 11 12 13 14 15 16 17 regularly published as required by law; and WHEREAS, notices of passage of said Resolution of Intention No. 3678 headed "Notice of Formation of Lighting Maintenance Districts" was conspicuoxisly posted along all streets in the districts, where lighting exists, which are to be assessed for the benefits thereof, at not more than 300 feet apart, but not less than three (3) in all, said districts more particularly described in Resolution of Intention, all as required by law, after the passage of said Resolution of Intention, as appears from the affidavit of Timothy C. Flanagan, City Engineer, who caused to be posted said notices and who upon the completion of the posting of same, forthwith filed his affidavit of so doing in the Office of the City Clerk of said City, making oath that he completed the posting of said notices on the 22nd day of July, 1975; and WHEREAS, the City Engineer has presented to the Council an assessment roll showing the assessment to be levied against each 18 individual parcel of land to be benefited by said districts in 19 funding said districts share of the total costs of operation and 20 maintenance for the street lighting system; said roll is on file 21 I! in the Office of the City Engineer and is incorporated by reference 22, herein; and 23 j WHEREAS, on August 5 , 1975, the City Council of the City 24 i! of Carlsbad did proceed to hold and did hold a duly noticed public hearing in conformity with the provisions of the Municipal Lighting Maintenance District Act of 1927, in order to consider any protests 27 i against the formation of said districts or against any individual 28 assessments; and 1 2 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, at said hearing no protests or objections were presented in the time and manner as required by lav;, and said City Council having determined that the territory within the boundaries of Districts No. 1, 2 and 3 as hereby established will be benefited by the maintenance and operation herein deter- jmined upon and thereby acquired jurisdiction to proceed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the boundaries of the districts shall be as shown on the map entitled "Lighting Maintenance District Map, 1975-77" on file in the Office of the City Clerk and incorporated herein by reference. 3. That the items of maintenance for the lighting system shall consist of electric power, relamping, cleaning of lenses and repair or replacement of damaged circuits, luminaires and standards arid other necessary items as described in the Report of the City Engineer to the City Council dated June 3, 1975, on file in the Office of the City Clerk and incorporated by reference herein. Said system shall be lighted from fifteen (15) minutes after sunset: until one-half hour (thirty minutes) before sunrise each day in the year. The estimated cost for the first year of the above items of maintenance is as follows; District No. 1 $20,415.10 District No. 2 $11,319.89 District No. 3 $78,191.44 4. That the City Council determines that .there is only one contractor practically capable of serving the street lighting — 3 — 1 o 8 10 11 12 13 14 15 16 17 18 19 system and that such contractor is subject to the jurisdiction of the Public Utilities Commission of the State of California, and. the City Council orders that the above described items of maintenance arid operation be furnished from time to time as necessary by the San Diego Gas and Electric Company, in accordance with the rates and rules filed by it from time to time with said Public Utilities Commission. 5. That the City Council orders that the percentage of the total expenses of maintenance and operation to be paid by Districts No. 1, 2 and 3 shall be paid by special assessment taxes levied upon all the lands, exclusive of improvements, within said districts 6. That the City of Carlsbad shall pay the following amounts of the total expense of maintenance and operation of said system: District No. 1 $ 93.80 District No. 2 $ 384.23 District No. 3 $1,261.44 7. FRAZEE, MaycfF 9 ATTEST: (seal) •5- 1 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO._J3_70_4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF- CARLSBAD, CALIFORNIA, AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH THE SAN DIEGO GAS AND ELECTRIC COMPANY FOR THE MAINTENANCE AND OPERATION OF THE CITY STREET LIGHTING SYSTEM FOR 1975-76 'WHEREAS, the City Council has by Resolution No. 3678 ordered the formation of Lighting Maintenance Districts in the City of Carlsbad to provide for the maintenance and operation of a street lighting system in said City; and WHEREAS, it is necessary for the City to contract for the energy to power said system and for other necessary items for operation and maintenance of said system as described in said resolution; and WHEREAS, the San Diego Gas and Electric Company is the sole and only source available to the City capable of performing said contracts which are governed as to rates and rules by the Californi Public Utilities Commission. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the Mayor is authorized to execute on behalf of the City a contract with the San Diego Gas and Electric Company for the operation and maintenance of the City in a form and with the terms and conditions as set out in Exhibit "A" attached hereto and incorporated by reference herein. Massman, Director of Transportation, 0-320 FROM: County Assessor, A-4 Re: EC 75-28 Encinitas Plaza/Wesley Homes #1 Annexation" to the San Diego County Lighting Maintenance District No. 1. The subject proposal having been filed by you with the Clerk of the Board of Supervisors on July 11, 1975, the Assessor makes the following report and recommendation pursuant to Chapter 3 (commencing with Section 58850) of Division 1, Title 6, of the Gov- ernment Code of the State of California. 1. The territory to be included within the proposal comprises approximately 17.71 acres, located in whole or in part within the following cities or districts. Encinitas Union School District San Dieguito Union High School District Encinitas Fire Protection District Encinitas Sanitary District C.S.A. No. 17 - San Dieguito San Diego County Flood Control - Zone 1 S.an Dieguito Irrigation District San Diego County Water Authority Metropolitan Water District and located within three miles of the City of Carlsbad. All of the cities and districts listed herein are being notified in accordance with Section 58855, Government Code, by copy of this re- port, of the filing of this proposal. 2. The description of the proposed boundaries is not definite and certain, but such description may be made definite and certain by correcting said description to read as set forth in Exhibit "A" hereto attached. 3. The proposed boundaries do not conform to existing lines of assessment, documents of record, or ownership in that ex- isting district assessment lines in the street center lines are n.ot followed, but said boundaries would conform if corrected to read as set forth in Exhibit "A" hereto attached. The Assessor is of the opinion that the proposal would be inimical to the public interest unless changed to include territory as accomplished in Exhibit "A" hereto attached, for the reason that existing district lines should be adhered to in order to prevent problems in subsequent governmental applications. 5.
