Statement of the Matter
The applicant request approval of a one-lot tentative tract map to create five
condominium dwelling units with common areas and pool. The Planning Commission
is recommending approval of the proposed CT 75-5, for reasons outlined in
Planning Commission Resolution 1176, adopted July 23, 1975 by a 5-0 vote
(one absent). Letters have been received from affected school districts
assuring that school facilities and services will be available,
concurrent, with need.

RECOMMENDATION:

reasons and subject to the conditions outlined in Planning .Commission
Resolution 1176. If. the Council concurs with the Planning Commission action
. the Council should direct the City Attorney to prepare the necessary documents
of approval.

I. REQUEST: One lot tentative tract map to create 5 condominium dwelling units
with common areas and pool.
II. BACKGROUND:
A- Location and Description of the Property: Lot 405, La Costa South
Unit No. 5, Map 6600, City of Carlsbad.
The subject property fronts on La Costa Avenue and has been rough
graded. Street improvements exist including curbs, gutters,
trees and cable T.V. facilities. The site is rectangular with 100
feet of frontage on La Costa Avenue and a depth of 160 ft.(16,000 sq.ft.),
The density for 5 condominiums on the .37 acre parcel would constitute
a density of 13.5 du/acre.
B. Existing Zoning and Land Use:
Subject Property: R-D-M vacant
North: R-D-M vacant
South: R-l La Costa Avenue and slope
E-tst: R-D-M vacant
West: R-D-M vacant
C- Environmental Impact Information: The project has been given a
negative declaration based on the following finding :
The proposed project lies in an area already urbanized with
public improvements. The project will consequently have an
insignificant effect on topography, wildlife and vegetation,
air and water quality.
D- Public Facilities: Letters have been received from the following
agencies indicating compliance or required facilities to provide
compliance:
Carlsbad Municipal Water Department
San Diego Flood Control District
Letter from the San Dieguito Union High School District
has been received indicating no agreement has been made

NAME OF APPLICANT: DENIS HOBSON
The proposed project conforms to the General Plan density range
and policies, and is in an area planned and prepared for develop-
ment of this type.
Since the tract map is for a 1-lot condominium development, no
specific locations and dimensions are subject to approval. The
tentative tract map only signifies the boundaries of the property
and that a maximum of five condominium dwelling units will be
allowed. Less than five units could be constructed.

I. FINDINGSo.
A. General Plan Consistency: The proposed map is consistent with the
General Plan because:
(1) The project conforms to the General Plan density range.
(2) The project conforms to the General Plan policies and is in
an area planned and prepared for development.
The site is physically suitable for the type of development because:
(1) The subject property has been graded to accomodate development.
(2) Street improvements are in, including streets, curbs, gutters,
sidewalks, lighting and trees.
B. Environment: See Environmental Impact Information in Background.
c- Schools: Certification of school facilities has not been received
at this time.
D- Water and Sanitation: A letter has been received from Carlsbad
Municipal Water Department indicating service will be provided with
certain requirements.
A letter has been received from the Leucadia County Water District
indicating service will be provided with certain requirements.
£• Streets: Street facilities, curbs, gutters, etc. are existing.
1l• RECOMMENDATION:
A. Staff recommends that CT 75-5 be denied since no certification of
school facilities has been received.
If the Planning Commission should decide to approve the request,
Staff recommends the following conditions of approval:
Conditions for Approval:
(1) The Final Map shall be submitted for approval within 18 months
from the final action by the City Council on the Tentative
Subdivision Map. The Final Map shall be in substantial con-
formance with the Tentative Subdivision Map known as Exhibit
A, dated 6-9-75.
(2) The development of the property described herein shall be
subject to the restrictions and limitations set forth herein
which are in addition to all the requirements, limitations and
restrictions of all municipal ordinance and State and Federal
statutes now in force, or which, hereafter, may be in force for
the purpose of preserv ing the residential characteristics of
adjacent properties.
(3) All public improvements shall be made in conformity to the
City of Carlsbad Engineering Design Criteria and Standard
Plans, the Subdivision Ordinance and other City Standards, to
the satisfaction of the City Engineer, without cost to the
City of Carlsbad, and free of all liens and encumbrances. Im-
provement plans for water and sewer systems shall meet the
requirements of the respective service districts.
(4) All land and/or easements required by this Ordinance shall be
granted to the City of Carlsbad without cost to the City and
free of all liens and encumbrances. No easements shall be
recorded prior to approval of the Final Map unless approved
by the City Engineer.
(5) All slopes created as a result of this development shall not
exceed a 2:1 slope.
(6) Ingress and egress along the property line bordering public
street right of way for all lots shall be dedicated, except
at location as specified by the City Engineer. Dedication shall
be made prior to approval of Final Map.
(7) If requested by the City Engineer, an amended Tentative Map
shall be submitted for approval by the City Engineer prior to
preparation of the Final Map to assure compliance to all
conditions of approval.
(8) In order to provide for reasonable fire protection during the
construction period, the subdivider shall maintain passable
vehicular access to all buildings and adequate fire hydrants
with required fire flows and dry-stand pipes shall be installed
prior to framing construction.
(9) The CC&R's for this development shall be submitted to the
Planning Director for review arid approval prior to the approval
of Final Map.
(10) Park-in-lieu fees shall be granted to the City concurrent with
City Council approval of the Final Map. It shall be the res-
ponsibility of the applicant to make all arrangements with the
Parks Department, concerning the requirements of this condition.
(11) A bikeway along La Costa Avenue shall be provided for to the
satisfaction of the City Engineer.

PLANNING COMMISSION RESOLUTION NO. 1176
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF THE
TENTATIVE MAP REQUEST FOR A ONE LOT SUBDIVISION ON
PROPERTY GENERALLY LOCATED IN LA COSTA SOUTH.
CASE NO. CT 75-5
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did on July 23, 1975 hold a duly noticed public hearing to
consider a request by Denis Hobson of Denbar Construction; and
WHEREAS, a verified application for a certain property, to wit:
Lot 405, La Costa South, Unit No. 5, Map 6600, City of Carlsbad
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided by
the "Carlsbad Municipal Code"1 and
WHEREAS, the applicant has complied with the Public Facility Policy of the
City of Carlsbad and has prov ided the necessary information which insures
Public Facilities will be available and current with need; and
WHEREAS, the subject application has complied with the requirements of
the City of Carlsbad "Environmental Protection Ordinance of 1972" because
the proposed project lies in an area already urbanized with public improvements.
The project will consequently have an insignificant effect on topography, wild-
life and vegetation, air and water quality.
WHEREAS, the proposed map meets or performs the requirements or conditions
of the "Carlsbad Municipal Code" or the Subdivision Map Act; and
WHEREAS, at said hearing a staff report was presented and all persons
desiring to speak on the subject request were heard. At the conclusion of
said hearing, after considering all the evidence presented, the Planning
Commission made certain findings and reached a decision on the request as
hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carlsbad as follows:

A) That the above recitations are true and correct.
B) That the Planning Commission makes the following findings of fact:
1) That the proposed map is consistent with the General Plan
because:
a) The project conforms to the General Plan density range.
b) The project conforms to the General Plan policies and
is in an area planned and prepared for development.
2) The site is physically suitable for the type of development
because:
a) The subject property has been graded to accomodate
development.
b) Street improvements are in, including streets, curbs,

C) That in view of the findings heretofore made and considering the
applicable law, the decision of the Planning Commission is to
approve Case No. CT-75-5 subject to the following conditions:
1) The final map shall be submitted for approval within 18 months
from the final action by the City Council on the Tentative
Subdivision Map. The Final Map shall be in substantial con-
formance with the Tentative Subdivision Map known as Exhibit A,
dated 6-9-75.
2) The development of the property described herein shall be
