Statement of the Matter . The Planning -Commission is recommending approval of
a Zone Change from C-l and RD-m to C-l-Q and RD-M-Q on property located north
of Alga Road, east of El Camino Real , for reasons outlined in Planning Commission
Resolution #1175.
The property owner, Cal Pacific Properties, received preannexational zoning
as outlined in Ordinance 9140 on the 17th of December, 1974. During the pre-
annexational zoneing hearing the staff and applicant indicated desire to apply
site development review to the subject properties in as much as the General Plan
provides for neighborhood type commercial development in higher density residential
land uses. The application of the "Q" Overlay zone will allow the staff and
Planning Commission site development, review at such time as development is
proposed.

RECOMMENDATION: that the requested Zone Change ZC-158 be approved
for the reasons and subject to the conditions outlined in Planning Commission
Resolution 1175. If the Council concurs with the Planning Commission action,
the Council should direct the City Attorney to prepare the necessary documents of
approval .

APPLICANT: CITY INITIATED FOR CAL PACIFIC PROPERTIES, INC.
I. REQUEST; The City has initiated a preannexational zone change
from C-l and RD-M to C-l-Q and RD-M-Q on a 16.5 acre site
located at the northeast corner of Alga Road and El Camino
Real.
II. BACK6ROUND:
Kf Location and Description of the Property: West one-half
on the NE one-fourth of Sec. 26 T. 12 S. R. 4 W. Located
at the northeasterly intersection of El Camino Real and
Alga Road. The unusually shaped parcel has approximately
2400 feet of street frontage on El Camino Real and has an
average depth of 322 feet.
B. Existing Zoning:
Subject property: C-l and RD-M (prezon+rig)
North: P-C (prezoning)
South: RD-M
East: P-C (Kratter)
West: County E-l-A
C. Surrounding landuse; The site is bordered by vacant land
on the north and east, a multi-family development to the
south, and El Camino Real to the west.
D. Past History and Related Cases:
ZC-149: Preannexational zone change from County E-l-A
to RD-M and C-l; approved by City Council Dec. 17, 1975
by Ord. 9410.
SP-164: Requested by Staff for reasons of General Plan
consistency; tabled by Planning Commission on Oct. 22, 1974
because physical design problems; application withdrawn by
applicant with concurrence of Staff.
EIR No.283: Certified by City Council on 6-17-75; includes
both subject property and Canning property to the north.

E. Environmental Impact Information:.. An EIR was certified
for the subject property on June 2, 1975. The EIR stressed
that site plan review will be necessary in adjusting both
the commercial and residential areas to surrounding areas.
In this sense, the zone change will be fulfilling a mitiga-
tion suggested by the EIR. Because of this, staff has
determined that the project meets all of CEQA's and the
City's environmental requirements (Title 19, Section 19.04.153,
Prior Compliance.)
F. General Plan Information: The Q zone is necessary to adjust
the site to certain special circumstances in assuring
General Plan Consistency:
(1) The Land Use Element designates the property
as residential medium high density at 10-20
du/acre. Neighborhood commercial uses are
allowed under this designation provided that
uses are restricted to suitable neighborhood
convenience shops. The Q zone will ensure
this.
(2) The Preliminary Noise Element suggests that
site plan review be employed for residential
areas which may be subject to excessive noise
levels. The Q zone can help mitigate the
the adverse impacts of noise and congestion
from El Camino Real .
(3) The Circulation Element recommends that all
circulation/transportation systems be safe and
functional. Since the subject property faces
a number of potential circulation problems,
the Q zone is necessary to ensure Circulation
Element compliance.
G. Public Facilities; Public facilities were ensured with
the initial prezoning of the property. The Q zone will
permit the City the additional ability to review the
adequacy of public facilities prior to any development
on the site.
III. MAJOR PLANNING CONSIDERATION: Is the Q zone necessary to
ensure General Plan Compliance?

6 WHEREAS, a verified application for a certain property, to wit:
7 West one-half on the Northeast on-fourth of section T. 12 S. R.
4 W. Located at the northeasterly intersection of El Camino Real
8 and Alga Road and further described in the files of the Planning
Department;

10 has been filed with the City of Carlsbad and referred to the Planning Commission
11 and
12 WHEREAS, said verified application constitutes a request as provided by
13 Title 21 of the "Carlsbad Municipal Code"; and
14 WHEREAS, the public hearing was held at the time and in the place specified
15 in said notice on July 23, 1975; and
16 WHEREAS, the applicant has complied with the Public Facility Policy of the
17 City of Carlsbad and has provided the necessary information which insures
18 Public Facilities will be available and current with need; and
19 WHEREAS, the subject application has complied with the requirements of the
20 City of Carlsbad "Environmental Protection Ordinance of 1972". An Environmental
21 Impact Report was certified for the subject property on June 2, 1975. It v/as
22 determined that the project meets all of CEQA's and the City's Environmental
23 requirements (Title 19, Section 19.04.153, Prior Compliance); and
24 WHEREAS, at said public hearing, upon hearing and considering the testimony
25 and arguments, if any, of all persons who desired to be heard, said Commission
26 considered all factors relating to the Zone Change and found the following
27 facts and reasons to exist:
28 i) The Zone Change is necessary to ensure consistency with Land
Use, Noise and Circulation Elements of the General Plan.

2) Public utilities have been ensured with initial prezoning.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of31 j

A) That the above recitations are true and correct.
B) That a Preannexational Zone Change is approved from C-l and RD-M to
C-l-Q and RD-M-Q on property located at the northeast corner of
Alga Road and El Camino Real.
PASSED, APPROVED-AND ADOPTED at a regulare meeting of the City of Carlsbad
Planning Commission held on July 23, 1975 by the following vote, to wit:
