ENCROACHMENT PERMIT REQUESTS - LA COSTA LAND CO,
Statement of the Matter --
The La Costa Land Co. has requeste.d an encroachment permit to install
split rail fencing and landscaping in the public rights of way in La
Costa where no sidewalk exists. Since there are very few pedestrians
in La Costa, the request does not seem unreasonable. If the permit is
issued, it should be subject to the following conditions:

The rights of way encroached upon must be maintained by the La Costa
Land Co. including landscaping, watering, weeding and fencing.
The permittee. shall provide liability insurance to protect the City
from any liabilities connected with'the encroachments. The amount
of coverage to be determined by the City Attorney. Provide the City with a bond to guarantee removal of the encroachments
upon demand.
Obtain consent of property owner abutting street, in writing, prior
to installation of any encroachments.
Obta.in consent of CMWD to preclude conflicts with water meters.

Recommendation
It is recommended that City Council approve the issuance of an 'encroach-
ment permit for split rail fencing and landscaping in public rights of
way in La Costa where sidewalks do not exist subject to the conditions
recommended above.
Council action
8-19-75 The Council approved the issuance of an Encroachment permit for
the Split Rail Fence, subject to certain conditions, and approved
the issuance of an Encroachment permit for Landscaping, subject
to certain conditions, and the Mayor authorized to execute both
agreements.

Dear Sir:
This is a formal application by the La Costa Land Company for an
encroachment permit whereby La Costa Land Company would be able
to install in City right-of-way split rail fences similar or identical
to those now in place along El Camino Real from Alga Road south to
Costa Del Mar Road.
Specifically, we are requesting permission to install fences along
the roads as indicated on the aerial survey map previously submitted
to you.

way landscaping similar to that shown in the attached renderings.
Specifically, we are requesting permission to install such landscaping at the
16 locations indicated on the aerial survey map submitted herewith.
If the City grants the encroachment permit, La Costa Land Company will -
1) Install the landscaping
2) Insure maintenance
3) Make adequate provision to hold the City harmless for
any liabilities
4) Remove the landscaping on request.
We think that the provision of landscaped areas as indicated will improve the
environment of La Costa and therefore the City of Carlsbad.
