Sub3 ect: ADOPTION OF COUNTY ORDINANCE - SEPTIC TANK PERMITS .(Amendment to.County Ordinance) Statement of the Matter County Ordinance 4531 amends certain sections of the County Code pertaining to Septic Tank Permits. This ordinance has the following features: 1. It increases health inspection fees from $15.00 to $25.00 for construction,.installation, reconstruction, repair, or additio.i. 2. It increases the reinspection fee from $7.56to $10.00. 3. It deletes two paragraphs relating to performing these services and charging them against a deposit and the ,procedures for accounting for these deposits. The County Code section's were originally adopted by reference in Carlsbad City Code Section 6.02.010. Exhibit .Letter from County of San Diego dated July 16, 1975. County Ordinance No. 4531. This new ordinance amends Sections 68.326 and 68.333 of the San Diego County Code of Regulatory Ordinances and repeals Sections 68.334 and 68.335 relating to septic tank.permits. A copy of Ordinance No. 4531 (N.S.) is attached. Your City may adopt the appropriate sections of the San Diego County Code of Regulatory Ordinances by reference or adopt a City Ordinance and resolution requesting this department to enforce the provisions of your ordinance. Under provisions of the Basic Health Agreement with your City (Para- graph 6) the "County shall collect for such services the amount it would have collected had it performed such services in enforcing the Count} Ordinance." Section 68.326 of the San Diego County Code t { is hardby amended to read as follows: See. 68.326. APPLICATION FOR PERMIT --FEE. Any person desiring to install, construct, reconstruct, repair or add to, } a septic tank, settling tank, seepage pit, cesspool, subsurface the line system, or other subsurface sewage disposal unit or 4 sysrcm, or any part thereof, shall file with the Director a written application for a permit for such installation, con-struction, reconstruction, repair or addition. A separate 1 application and permit for each installation shall be required. Section 2. Section 68.333 of the San Diego, County Coda is hereby amended to read as follows: f Sec. 68.333. REINSPF.CTIONS--FED. When an inspection has been ordered and the work is found to be not ready for lnspec- tion and approval, the Director shall c4u0u an official notice i 7/1/75 (10) JH:sm 5-30-75 to be posted on the job stating the changes necessary in order that the work will comply with the requirements of this chapter. As soon thereafter as practicable the owner or contractor shall cause the changes to be made and upon completion thereof shall notify the Department that the unit or system is ready for reinspection. As soon thereafter as practicable the Director shall make or cause a roinspection to be made. If upon reinspection the work is approved, a certificate to that effect shall be posted as hercinabove specified. The fee for'each reinspection shall be $10.00, which fee shall be paid to the Director. Section 3. Section 68.334 of the San Diego County Code is hereby repealed. Section 4. Section 68.335 of the San Diego County Code is hereby repealed. Section S. EFFECTIVE DATE. This ordinance shall take affect and be in force thirty (301 days after the date of its passage and before the expiration of fifteen (15) days after its passage, it shall be published once with the names of the membora voting for and against the at.me in the San Diego , a newspaper of general circulation published in the County of San Diego. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Chapter 6.02, Section 6.02.010 of the Carlsbad Municipal Code is amended by the addition of Subsections (d), (e) and (f) to read as follows: "(d) Section 68.326 of the San Diego County Code of Regulatory Ordinances adopted by reference by this section is amended to read as follows: Sec. 68.326. Application for Permit --Fee. Any person desiring to install, construct, reconstruct, repair or add to, a septic tank, settling tank, seepage pit, cesspool, subsurface tile line system, or other subsurface sewage disposal unit or system, or any part thereof, shall file with the Director a written application for a permit for such installation, con- struction, reconstruction, repair or addition. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
