(Financial Statement of the Matter : The applicant is requesting the City to approve proposed changes in elevation, height, and bulk of the town houses proposed on Phase C of Alta Mira. Also being proposed is a net reduction of 39 units from the original approved 118 dwelling units to 79 DU's. Planning Commission does not view the change to be so signif.icant in light of the overall project as.to require an amendment to the Specific Plan (SP-23B). RECOMMENDATION: It is recommended that the City Council by minute motion concur in the Planning Commission findings that the proposed changes are not so significant as to constitute an amendment to the Specific Plan (SP-23B), and that the Council approve the revisions"to said plan. MEMORANDUM August 21, 1975 TO: HONORABLE MAYOR, CITY COUNCIL FROM: - PLANNING COMMISSION SUBJECT: CITY COUNCIL REVIEW OF PROPOSED REVISIONS TO SP-23A Pacific Scene, Inc. is requesting the City to approve proposed changes in elevation, height, and bulk of the town houses proposed on Phase C of Alta Mira. Also being proposed is a net reduction of 39 units from the original approved 118 dwelling units to 79 DU's. Planning Commission does not view the change to be so significant in light of the overall project as to require an amendment to the Specific Plan (SP-23B). The Planning Commission at its regularly scheduled meeting of August 13, 1975, recommended to the City Council that the proposed revisions to Phase C of the Alta Mira project were not so substantial as to require an amend- ment to the Specific Plan. The developer, Pacific Scene Inc., by letter of August 7, 1975, outlined the proposed revisions and requested the Planning Director to determine significance of the proposed changes outlined. The Staff did not feel the changes proposed were significant and requested that the Planning Commission concur in their recommendation. Both the Staff and the Planning Commission feel that the City Council should be similarly apprised of the proposed changes and would recommend the City Council concur in the Planning Commission recommendation. Agatep,~"~- Secretary to the Planning Commission DAA/vb MEMORANDUM August 13, 1975 TO: PLANNING COMMISSION ' FROM: DRC SUBJECT: SP 23-B (Revision) - FINANCIAL SCENE REQUEST: PLANNING COMMISSION REVIEW OF PROPOSED SITE PLAN AND ELEVATION REVISION FOR PHASE C, ALTA MIRA In a letter dated August 7, 1975 (attached), Financial Scene has requested the City's permission to modify their approved specific Plan for the third phase of the Alta Mira Development on Lowder Lane. City approval is re- quired by Condition 6 of the Specific Plan: "The Specific Plan, Exhibit A shall be adopted and deviation therefrom shall be subject to the approval of the City of Carlsbad". Staff feels that the modifications proposed are not significant in terms of the total Alta Mira project and requests the Commission's concurrance in it's interpretation prior to reviewing the revisions and proceeding with building permits. The applicant proposes to lower the density of the affected area from 118 units to 79 units, as shown in the attached site plan exhibit, with corresponding modifications in building elevations (Exhibit Ys available at Commission meeting). Modifications are also proposed in providing covered parking adjacent the units and in the turnarounds at the ends-of the cul-de-sacs. The changes are shown on the previously submitted drawings and involve the following: 1. A reduction in density from 118 to 79. 2. An increase in the size of each living unit at an average of 250 square feet. 3. Decreasing the number of stacked units (one unit over the other) and introducing two new tri-level plans. 4. The reduction in density will also reduce the parking ration, thereby making garages necessary on one side of the street only. Each garage will be adjacent to each living unit. 5. As the submitted plans indicate, the elevations will remain red tile and stucco and the architectural design will be similar to the existing buildings in Unit #3. 6. Streets, parking, the existing grading, water lines, utility lines will remain the same except for a few minor service connection points. 7. Landscaping will remain the same. "wMr. Donald A. (Financial Scene) The City Council of the City of Carlsbad, California, DOES ORDAIN that a Specific Plan for the hereinafter described real pro- perty be adopted in the following particulars: SECTION 1. PROPERTY DESCRIPTION. Portions of Sections 20 and 21, Township 12 South, Range 4 West, San Bernardino Meridian * according to Official Plat thereof lying easterly of Carlsbad Tract No. 72-2.1 according to Map thereof No. 7303, filed in the Office of the County Recorder of San Diego -County, in the City of Carlsbad County of San Diego, State of California, more particularly described in application on file in the Office of the City Clerk. SECTION 2. GENERAL CONDITIONS. The Specific. Plan, entitled Exhibit "A" attached hereto,' is subject to the following conditions and restrictions: 1. The development of the property described in Section 1 hereof shall be subject to the restrictions and limitations set forth herein which are in addition to all requirementss limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. 2. All public improvements shall be made in conformity with the subdivision ordinance and other City standards to.the satisfactio of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. 3. All land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. XX 1 4. PRIVATE DEVELOPMENT CONDITIONS. The following 5 conditions shall apply with respect to any development after the 6 effective date of this Ordinance of the property described in Section 7 1 hereof: 8 1. That ten (10) foot wide street tree easements shall be 9 provided along Lowder Lane. 10 2. That Lot 8 (a 6-acre portion of Phase "E") shall be offere 11 for dedication in conjunction with all of Phase "E" during Tentative 12 Map approval of Phase "D". And $500.00, a portion of the financial 13 contribution (Ord. 9293), shall be offered to the City of Carlsbad 14 at this time to initiate a landscaping program for the greenbelt. 15 (Lot 8). 16 3. All fire hydrants and fire fighting devices shall be 17 approved by the City of Carlsbad Fire Department. 18 4. Landscape and sprinkler plans shall be submitted to the 19 Parks and Recreation Director and shall be subject to his approval. 20 5. Architectural elevations shall be submitted to the Plannin 21 Department staff for review. 22 6. The Specific Plan, Exhibit "A" shall be adopted and devi- 23 ations therefrom shall be subject to the approval of the City of 24 Carlsbad. 25 7. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF BUILDING PERMIT. The following shall be granted to the City of Carlsbad before any building permit will be is.sued for the develop- ment of the property described in Section 1 hereof: A. All street improvements including water, sewer, under- ground power and telephone, street tree planting, street light, storm drain and any other improvements deemed necessary by the City Engineer shall be installed in conformance with City standards and indicated on an approved improvement plan, or bond posted in lieu of improvements, prior to the issuance of a building permit. B. All lands necessary for street widening shall be dedicated to the City of Carlsbad prior to approval of said improvement plan. C. A grading plan shall be submitted prior to the issuance of a building permit. SECTION 5. ADMINISTRATIOQND ENFORCEMENT. The Building De- partment shall not approve any building for occupancy until the Plan- ning Director has certified that all the conditions of this Ordinance have been satisfied. INTRODUCED AND FIRST READ at a regular meeting of the City Council held on the 15th day of August, 1972 and thereafter PASSED AND ADOPTED at a regular meeting of said City Council on the 5th day of September, 1972,^ by the following vote, to wit: AYES: Cmn- McComas, Lewis, Chase and Frazee.
