' _ • Statement of the Matter The Planning Commission approved Resolution of Intention No. 116, a proposed Zone Code Amendment that would revise permitted uses in the Public Utilities (P-U) Zone and would delete the lot area requirements of the Limited Control (L-C) Zone. On August 27, 1975 the Planning Commission, for reasons outlined in Resolution No. 1178 recommended approval of the proposed amendment to the Pubilic Utilities (P~U) and Limited Control (L-C) Zones. The amendment would permit construction of .pipelines .in ; Public Utilities Zone. The amendment would also reduce.the minimum Tot area-requirement in Limited Control Zone by deleting the 5 acre minimum. Exhibits 1. CASE NO. ZCA-69 WHEREAS, the Planning Commission of the City of Carlsbad did adopt Resolution of Intention No. 116 declaring its intention to recommend to the City Council an Amendment to Title 21 of the Municipal Code; and WHEREAS, the Planning Commission did hold a duly noticed Public Hearing to consider the subject amendment; and WHEREAS, the Planning Commission received all testimony from those persons interested in and opposed to, if any, the proposed Zone Code Amendment; and WHEREAS, the Planning Commission did find the following facts and reasons to be present which in their opinion are necessary to carry out the general purpose of Title 21 of the Carlsbad Municipal Code: 1. The amendment will provide for energy transmission facilities in the P-U Zone. 2. The amendment will delete minimum lot size in the L--C Zone to provide greater flexibility. 3. The amendment will update wordage of both Zones. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad that it does recommend approval to the City Council of an amendment to Title 21 permitting pipeline in P-U Zone and deletion of lot area requirement in L-C Zone, as per Exhibit A, dated August 19, 1975, and attached hereto.
