Minor, President 1m MEMORANDUM September 30, 1975 TO: City Manager FROM: City Engineer SUBJECT: CT 73-8, Conditions of Tentative Map Extension. Review of the tentative map extension is complete, and the problem areas listed in Agenda Bill 2901, Supplement No. 5, are either resolved or included in the resolution approving the extension. Staff believes the original tentative map, as approved by Resolution 3178 and amended by Resolution 3358, is consistent with current elements of the general plan, with one exception, bikeways. This aspect is covered in the proposed Condition 9 revision. Problems with the local water system posed by Units 1 and 2 of CT 73-8 have been resolved. Interim operations to pro- vide adequate fire flows have been implemented. Meanwhile, the completion of water line improvements underway in City Contract 1026 and CT 73-36 (Woodbine) Units 2 and 3 will assure a reliable local system, integrated with the existing adjacent system. It is intended to resolve the second major problem, the intersection of Tamarack Avenue and Skyline Drive, by revising Condition 9 of the Resolution. Originally, it was determined during public hearings to require the Tamarack Avenue improvements to be made in whatever manner would squeeze the street through the available right-of-way outside the tentative map boundary. The engineer's design proposals have been unsatisfactory. To provide a proper alignment and grade to match existing Birch and Skyline Road, an unusual, narrow street sandwiched between retaining walls would be required. Staff is convinced that a full street should be installed to the intersection of Skyline Drive, (or not at all) and revised Condition 9 reflects that neces- sary requirement. Proposed Condition 9 will necessitate the acquisition of additional street right of way. The developer's dual relationships with the adjacent property owners (both may result in litigation) render it difficult to fulfill Condition 9 without condemnation of right of way. According to the developer, the Brownleys, owners of the parcel to the South of the proposed Tamarack extension, will not grant right of way unless an equal take is made from Mr. Schwab, the property owner North of the proposed extension. MEMORANDUM, City Manager September 30, 1975 Page 2 Given a fixed intersection with Skyline, such an equal dedi- cation plan is not possible. And Mr. Schwab purchased, by land contract, a parcel behind his lot from the previous owner of the developer's tract. This division of land was not in accordance with the Subdivision Map Act, but it clouds title on the developer's property. A portion of the proposed Tamarack right of way lies within the disputed Schwab parcel. Condition 22 was added to secure improvement of the left turn pocket to CT73-8 in El Camino Real. The existing pave- ment in this area is a thin median overlay. Tim Flanagan City Eng i neer TCF/DCG/sln EVWIBIT "C// •SITE LOCATION MAP 1 2 3 4 5 6 i 7 8 9 I 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 RESOLUTION NO. 3758 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS AN EXTENSION OF TENTATIVE MAP (CT 73-8) PERMITTING DEVELOPMENT OF 331 UNITS ON PROPERTY GENERALLY LOCATED ON THE WESTERLY SIDE OF AND ADJACENT TO EL CAMINO REAL, APPROXIMATELY 200 FEET NORTHERLY OF THE INTERSECTION OF KELLY DRIVE AND EL CAMINO REAL, CONSISTING OF APPROXIMATELY 63 ACRES. APPLICANT: DOUGLASS SOUTHWEST CORPORATION WHEREAS, the City Council of the City of Carlsbad, on the 7th day of August, 1973 adopted Resolution No. 3178 approving with conditions, Tentative map (CT 73-8); and, on the 19th day of February, 197^- adopted Resolution No. 3358, amending Condition No. 13 of Resolution No. 3178; and WHEREAS, the subdivider had requested and the City Council had approved an extension of the tentative map from August 7, 197^ to August 7, 1975; and WHEREAS, the subdivider has requested an additional one-year extension of such map from August 7, 1975 to August 7, 1976 and; WHEREAS, the City Council has determined to extend such map subject to a revised and an additional condition; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-8) is hereby extended, subject to the execution and/or fulfillment of all the conditions of Resolution No. 3178, except that: 1. Condition No. 9 is revised as follows: "9. The developer shall dedicate and improve the remainder of Tamarack Avenue based on an 8k foot right of way width and a 52 foot street section with 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 a separate two-way bikeway. Tamarack Avenue right of way and improvements shall be secured to its intersection with Skyline Drive (prior to approval of the final map of Unit No. 2)." 2. A Condition No. 22 is added as follows: "22. The developer shall provide a left turn pocket from El Camino Real to Tamarack Avenue, as approved by the City Engineer. C. That said tentative map extension together with the pro- visions for its design and improvement and subject to the above conditions, is consistent with all applicable general and specific plans of the City of Carlsbad. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 21st day of October , 1975 by the following vote, to wit: AYES: Councilmen Chase, Lewis and Councilwoman Casler.
