Statement of the Matter
The City council orginally approved CT 72-34 August 7, 1973 (City Council Resolution
3180), extended the tentative map July 16, 1974 for 1 year. By written request to
extend the tentative map for an additional year, the matter was presented to
the City Council on August 5, 1975. At the recommendation of the staff, the
requested extension was returned to the Planning Commission for recommendation
and report so as to ensure compliance with recently adopted General Plans and
the new Subdivision Ordinance.
Inasmuch as there has been substantial change in the planning (.applicable General
Plan Elements) for the area south of Palomar Airport Road and west of El Caminb
Real and a change in the current Subdivision Ordinance Requirements, the Planning
Commission was of the opinion that it would be proper to. redesign the subdivision
(CT 72-34) to ensure compliance with the newly adopted General Plan elements and
the new Subdivision Ordiance.
Therefore, the Planning Commission recommends denial of the request for tenta-
tive map extension of CT 72-34 for reasons outlined in Planning Commission
Resolution 1190. .

Recommendation: If the City Council concurs with the findings and recommendations
of the Plannin'g Commission as outlined in Planning Commission Resolution No.
1190, it is recommended that the City Council deny the subject request. , However,
if the City Council wishes to approve the subject request, it is recommended that
the City Council instruct the City Attorney to prepare the necessary document
adopting those conditions as. listed- in Planning Department Staff Report dated

MEMORANDUM

SUBJECT: CT 72-34
The subject tract was originally approved prior t.o the latest updates to
the Carlsbad General Plan and is therefore not altogether consistent. The
applicant has requested an extension of this tract but has made no attempt
to make the map consistent.
Planning staff recommended conditions that would require the applicant to
work out the inconsistency problems. The Planning Commission however
recognized that to work out these inconsistencies would require almost
complete redrafting and engineering of the map. Therefore, the Planning
Commission denied the request for extension so that a completely new tract
map could be considered at a hearing after review by all affected agencies.
The major inconsistencies are in the Circulation and Open Space Elements of
the General Plan. The inconsistencies are:
(1) Circulation Element:
a) The Circulation Element indicates Arenal Road going near
the north shore of Batiquitos Lagoon between El Camino Real
and Laguna Drive as a major arterial. CT 72-34 has Arenal
Road as a major street with 84' right of way for only about
400' westerly of El Camino Real, then it necks down to a
60' right of way and bends north to meet Alga Road. The •
tract map should be changed to indicate Arena! Road
continuing west to the property boundary at 84' right
of way or providing for a smooth transition for a future 84'
street connecting to Arena! from the south,
b) The General Plan requires bikeways on major streets. A
revised plan should shown these bikeways on El Camino Real
and Arenal and possibly Alga.
(2) Open Space Element: A strip of open space is indicated within
the canyon areas coming up from Batiquitos Lagoon. With some
modification the slope area along El Camino Real could be con-
sidered as this open space as well as meeting the intent of the
Scenic Highways Element. Staff suggests requiring Open Space
easements in these areas and possibly deleting some lots that
back up to El Camino Real in the northerly portion.
(3) Other: An amended tract map approval should contain provision
for revised noise abatement programs along all the major arterials
(El Camino Real, Arenal Road, Alga Road). Also, the map indicates
single family residential lots in an area that is zoned RD-M.
Actually this appears to be consistent with the General Plan.
However, if the property is zoned RD-M, it can be used for multi-
ple family residential-regardless if a single family residence is
proposed. Therefore, it appears a change of zone would need to
accompany a revision or extension of CT 72-34.

CARLSBAD, CALIFORNIA, RECOMMENDING DENIAL OF, THE REQUEST
FOR EXTENSION OF TENTATIVE MAP CT 72-34.

WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did, on September 10, 1975, hold a duly noticed public hearing to
consider a request by Newport Shore Builders; and
WHEREAS, a verified application for a certain property, to wit:
The S h of Section 26, T-12-S, R-4-W, SBB excepting therefrom that
portion lying east of the west line of RS 1800-1 (El Camino Real) and
the W h of the SW % of Section 26, San Diego County, State of California, (
has been filed with the City of Carlsbad and referred to the Planning Commission;
and
WHEREAS, said verified application constitutes a request as provided by
the Carlsbad Municipal Code; and ''.'-.
WHEREAS, at said hearing a staff report was presented and all persons
desiring to speak on the subject request were heard. At the conclusion of said
hearing, after considering all the evidence presented, the Planning Commission
made certain findings and reached a decision on the request as hereinafter set
forth.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carlsbad as follows:
A) That the above recitations are true and correct.
B) That the Planning Commission makes the following findings of fact:
1) The present map is not in conformance with the General Plan.
The map should be revised to incorporate the new conditions as

APPLICANT: NEWPORT SHORE BUILDERS - Donald B. Ayres, Jr.
I. REQUEST: Extension of Tentative Tract Map CT 72-34 for
a period of one year. Approval of CT 72-34 expired on
August 7, 1975. CT 72-34 was approved August 7, 1973
by City Council Resolution No. 3180.
II. BACKGROUND:
A. Location: Generally located on the west side of
El Camino Real, between Alga Road (Extended) and
Arena! Road (Extended).
B. Project Description: A development of 278 single-
family lots, 100 duplex condominium lots and 3
commercial lots, on 120.3 acres.
C. Zoning: .
Subject property: RD-M, R-l, C-2
North: E-l-A (County)
South: P-C
East: El Camino Real/R-D-M and R-l
West: P-C
D. Surrounding Land Use: The property across El Camino
Real to the east of the subject property is a portion
of the La Costa development and accommodates condo-
minium and single-family residences. The remainer of
the surrounding property is vacant.
III. PAST ACTIONS: CT 72-34 was part of a larger 1,100 + acre
parcel that was preannexationally zoned by final approval
of Zone Change No. 102, dated July 17, 1973 (City Council
Ordinance No. 9357. The City annexed the property on
July 2, 1973.
The request for extension was brought before the City
Council for consideration on August 5, 1975. The Staff
recommended that the matter be returned to the Planning
Commission for report of recommendation, since a new
General Plan and new Subdivision Ordinance have been
adopted since the original approval of CT 72-34.
IV. ENVIRONMENTAL IMPACT REQUIREMENTS: An Environmental
Impact Report (No. 106) has been certified by the City
to cover the entire Ayres Annexation. Since the plans
for the subject tentative map were completed by the
time of preparation of the Environmental Impa-ct Report,
the proposed subdivision and its impacts were considered
adequately treated.
V. PROJECT DESCRIPTION: This development is on the west
side of El Camino Real across from La Costa. Alga Road
and Arena! Road, existing in La Costa, are proposed to
extend westerly and serve as the acess roads to this
development.
There are three lots, with a total of 13..6 acres, shown
on the map in the northeast corner of the site to be
utilized as commercial (C-l) use. This area is separated
from, the rest of the development by a 100' S.D.6. & E.
transmission easement.
The residential area immediately adjoining El Camino
Real, 35.8 acres, is zoned RD-M. The developer proposes
two condominium units (duplex) on each lot in this area
(100 lots, 200 units).
The remainder of the residential area, 70.9 acres, is
zoned R-l. The developer proposes 278 single-family lots
with a minimum of 7500 sq. ft, A portion of the westerly
boundary of this area adjoins a 150' S.D.G. & E. easement.
The RD-M area lies basically in a small valley immediately
to the west of El Camino Real. There is a substantial
slope from El Camino Real down to this area. The R-l area
is to the west of the RD-M area, up on a bluff overlooking
the Batiquitos Lagoon.
VI. MAJOR PLANNING CONSIDERATIONS: Since it has been 'a number
of years since the Tract Map was approved, the project must
be considered in terms of the following:
A. The need for re-evalutation of the proposed Tentative
Map under current circumstances. Specifically,
consistency of the Tentative Map approved in 1973
compared to the new General Plan and the applicable
General Plan elements which have been adopted since
1973 (i.e. Land Use Element, Open Space Element,
Circulation Element, Conservation Element, Geologic
Hazards Element, Noise Element, Parks and Recreation
Element).

B. The project as originally conceived was reviewed under
the requirements of the old subdivision ordinance.
The City of Carlsbad has recently adopted a new sub-
division ordinance and it should be established that
the proposed Tentative Map extension does not conflict
with the ordinance as adopted in 1975.
C. That Staff will determine the proposed Tentative Map
as presently drafted is in compliance with all existing
policies which may have been approved since the time
CT 72-34 was originally approved.
VII. DISCUSSION:
The new conditions and revised conditions included in the
following recommendatio.n reflect the requirements of the
General Plan and appropriate elements contained therein.
If these conditions are unacceptable, or unworkable, the
Planning Commission may wish to consider denial of the
Tentative Tract Map extension, or suggest that the appli-
cant withdraw the extension request and re-submit a new
plan that would reflect the requirements of the General Plan.
VIII. RECOMMENDATION: Staff recommends approval of the request
to extend CT 72-34 for one year, with the following conditions
1. City Council Resolution No. 3180 shall be recinded
and replaced with a new resolution containing the
following conditions:
2. Within 60 .days of the extension request approval, a
revised Tentative Map showing development phases
.will be submitted to the City Engineer for approval.
3. Prior to issuance of building permits for Phase 1
the applicant shall initiate a Zone Change to realign
the RDM-R-1 zoning boundary in conformance with the
boundary shown on the Tentative Map.
4. The applicant shall insure adequate noise attenuation
for all portions of the site subject to ambient noise
levels in excess of 65 dB(A). This shall be accomp-
lished in a manner acceptable to the Planning Director
and according to the policies and goals of the Noise
Element of the General Plan.
5. Alga Road shall be dedicated and improved from El
Camino Real to the westerly boundary of the subdivision
on the basis of a 102 foot street section with separate
bikeway. Improvement shall be for a half street section
minimum depending on the relation of street centerline
to property line. Alga Road shall be designed to align
with the existing Alga - El Camino Real intersection
and to conform with the.Circulation Element of the
General Plan.. , *

6. The'applicant, shal1 Install a four-way, fully
actuated traffic signal at the intersection of Alga
Road and El Camino Real and at Arenal Road and El Camino
Real, including left turn pockets. City will attempt
to secure reimbursement for the developer by agreements
with the surrounding, or abutting developers.
7. Arenal Road shall be dedicated and improved from El
Camino Real to the southwesterly boundary of the
subdivision on the basis of an 84 foot street section
with separate bikeway, in conformance with the Circul-
ation Element of the General Plan and City of Carlsbad
Standards. -
8. Additional right-of-way shall be dedicated and street
improvements made to provide a standard 126 foot street
section with separate bikeway for El Camino Real, from
Alga Road to Arenal Road.
9. A detailed landscape and irrigation plan prepared by
a landscape architect shall be submitted to the Director
of Parks and Recreation for consideration and approval
prior to approval of the final map. This requirement
shall apply to all private park areas and private or
public open space areas. Said plan shall also include
the detailed plans for the proposed recreation
facilities to be installed in the private park areas.
10. Park land and fees shall be dedicated to the City of
Carlsbad for park purposes as required by the Subdivision
Ordinance and Parks and Recreation Element prior to
the approval of the Final Map. In the event private
recreational facilities are provided by the applicant,
a maximum of 25% credit may be granted by City Council
against the total Park Ordinance requirement.
11. An open space easement between Arenal Road (Extended)
and Alga Road (Extended) generally located within the
RDM zoned area will be dedicated to the City in accord-
ance with and for reasons outlined in the Open Space
Element of the General Plan.
12. The applicant shall dedicate an open space easement
along the bank at the rear of the RD-M lots backing up
to El Camino Real.
13. All areas of the subdivision shall be designated as a
legal lot or public right-of-way.
14. The proposed sewer main to Leucadia County Water District
lift station is not approved. The trunk line connecting
to the Encino Treatment Plant shall be installed prior
to occupancy. The design of this line shall be subject
to the approval of the City Engineer. The applicant
shall initiate proceedings to de-annex the small portion
of their property within the L.C.W.D.'s service area.

15. No final map will be approved until provisions are
made to extend the offsite sewer to connect to the
existing Ponto sewer and to construct the necessary
pumping system; that is, until plans are approved
and easements and -bonds are received.
16. Two 15' wide public easements.for pedestrian/Equest-
rian use shall be dedicated between Arenal Road and
the 150' S.D.6. & E. easement.
17. The method of storm drainage shown on the map is not
approved. Storm drainage shall be designed per the
requirements of the City Engineer.
18. Proper siltation controls and slope protection shall
be proposed as part of the required grading plan (refer
to EIR comments for suggestions).
19. In order to provide for reasonable fire protection
during the construction period, the subdivider shall
maintain passable vehicular access to all buildings,
and adequate fire hydrants with required fire flows
shall be installed as recommended by the Fire Department
20. All public improvements shall be made in conformity to
the City of Carlsbad Engineering Design Criteria and
Standard Plans, the Subdivision Ordinance and other
City Standards to the satisfaction of the City Engineer
without cost to the City of Carlsbad, and free of all
liens and encumbrances. Improvement plans for water
and sewer system shall meet the requirements of the
respective service districts.
21. All drainage and grading plans shall be submitted to
the City Engineer for approval.
22. All utilities, including provisions for cable TV, shall
be placed underground and/or shall be completely con-
cealed from view.
23. All land and/or easements required by this Ordinance
shall be granted to the City of Carlsbad without cost
to the City, and free of all liens and encumbrances.
24. Access rights shall be dedicated along the first 500
feet of Alga Road and along El Camino Real.
25. The covered archway and planter strip on Arenal Road
is not approved.
26. Street names shall be subject to approval and shall be
designated in accordance with the standards and policies
adopted by the Planning Commission on file in the
Planning Department. Said names shall be approved by
the Planning Director prior to recordation of the Final
Map.

27. If required by the City Engineering Office, the
Improvements plans shall include a report of a
geological investigation and a complete grading plan
of the entire site. The report and plan shall be
prepared by civil engineers licensed by the State of
California, and experienced in erosion control who
shall be acceptable to the City Engineer, and they
shall certify they have investigated the site and
prepared data with full consideration of the con-
sequences to the included and neighboring properties.
28. The development of the property described herein shall
be subject to the restrictions and limitations set
forth herein which are in addition to all the require-
ments, limitations and restrictions of all municipal
ordinances and State and Federal statutes now in force,
or which, hereafter, may be in force, for the purpose
of preserving the residential characteristics of adjacent
properties.
29. Prior to consideration of the Final Map and Improvement
Plans, a grading and plot plan of the tract with all
proposed dwelling units located thereon, and showing
appropriate setback dimensions, shall be submitted to
the Planning Department for approval to insure that
adequate area requirements can be met.
30. If requested by the City Engineer, an amended Tentative
Map shall be submitted for approval by the City Engineer
prior to preparation of the Final Map to assure compli-
ance to all conditions of approval.

CARLSBAD, CALIFORNIA, APPROVING TENTATIVE MAP
(CT 72-34), A-DEVELOPMENT OF 273 SINGLE-FAMILY
LOTS, TOO.DUPLEX CONDOMINIUM LOTS AMD 3 COMMERCIAL
LOTS, OH PROPERTY GENERALLY LOCATED ON THE WEST SIDE
OF EL CAMINO REAL, BETWEEN ALGA ROAD (EXTENDED) AND
'ARENAL ROAD (EXTENDED) TO BE 'KNOWN AS "RANCHO LA CUESTA".
WHEREAS, on the 24th day of July, 1973, the Carlsbad City
Planning Commission adopted Resolution No. 935, recommending
to the City Council that Tentative Map (CT 72-34) be condition-
ally approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
7th day of August - , 1973, considered the-recommendation
of the Planning Commission; and
WHEREAS, said application has complied with the require-
ments of the "City of Carlsbad Environmental Protection
Ordinance of 1972"" and an Environmental Impact Report was
•presented and discussed at a duly noticed public hearing held
by the Planning Commission and the City Council and was
approved as presented; •. . . ; '
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows: •
A. That the above recitations are true and correct.*
B. That Tentative Map (CT 72-34) is' hereby approved,
subject to the execution and/or fulfillment of the following
conditions: '
1. The applicant shall dedicate and improve AlgaRoad to 1/2 street requirements for a "major
arterial highway" (1021 R..O.W.) to the westerly
boundary of the subdivision.
2. The applicant shall install a four-way, fully
actuated traffic signal at the Intersection of
Alga Road and £1 Camino Real and at Arena! Road
and El Camino Real. City will attempt to secure
reimbursement for the Developer by agreements
With the surrounding, or abutting, developers.
3. The applicant shall dedicate an open space
easement along the bank at the rear of the RD-M
lots backing up to El Camino Real.' A building

the Carlsbad Unified School District to
provide for future school requirements that
will result from the proposed development.
If requested by the City Engineer, an amended
Tentative Map shall be submitted for approval
by the City Engineer prior to preparation of

tion during the construction period, the sub-

AGENDA BILL 2094 - TENTATIVE MAP EXTENSION CT 72-34 (AYRES)
The City Council approved the subject tentative map August 7, 1973. The
tentative map was subsequently extended for one year on July 16, 1974 (City
Council Resolution 3180) The applicant requested the City Council on
August 5, 1975 to extend the map for an additional year. The matter has
been returned to the Planning Commission for proper report and review so
as to insure conformance with the General Plan in the new subdivision ord-
inance. In as much as the Council must take action within 90 days of the
request to extend, the matter must be heard November 4, 1975.
The conditions as proposed on the September 5, 1975 Staff Report did not
address phasing nor the improvements and conditions which would be required
as each phase develops. If the City Council elects to approve the tentative
map extension subject to the conditions, conditions number two of section
8, page 3, of the September 5, 1975 Staff Report should be revised to read:
2) Within 60 days of the approval of the extension for CT 72-34,
a revised tentative map showing developmental phases and public
improvements pursuant to each phase should be submitted to City
Council for approval. At that time the Council may require
additional conditions or modify conditions so as to effectively
implement the phasing program as outlined, any additions or
amendment shall be incorporated into the approving resolution.

The City Council on November 4, 1975 requested that revised plans of
subject project be submitted for their review at the January 6 meeting.
To provide sufficient time for staff review and distribution to the
City Council these plans must be submitted to the Planning Department
by December 14, 1975.
