Statement of the Matter -
On behalf of Kelly-Kurlander, et al, and O.E. Vanderburg, developers of a proposed shopping center generally located at the northeast
. corner of the intersection of Marron Road and El Camino Real, Anacal Engineering has requested the City Council implement abandonment proceedings of Osuna Drive.
The City Council, by its Resolution No. 3304, adopted a Specific Plan (S.P.-141 and 146) to allow the development of the shopping center. The abandonment of Osuna Drive was one of the conditions of the
adopted specific plan.
On August 27, 1975, the Planning Commission adopted Resolution 1179
indicating the,vacation of Osuna Drive conforms with the City's adopted General Plan. The Engineering Department has contacted all utility
companies and the City Public Works Department. Separate easement
documents will be executed for proposed utilities where required prior to acceptance of the development.

Recommendation
Adopt Resolution NO .3733, a resolution of intention declaring intention'
to vacate a portion of Osuna Drive.
10-7-73 Resolution #3753 was adopted, stating intention of City to vacate
a portion of Osuna Drive, and setting time and place for public hearing. Public Hearinq set for November 4, 1975, at 7:OO P.M. in the
City Counci 1 Chambers.

RESOLUTION NO. 37 53
A FGSSOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA DECLARING
INTENTION TO VACATE A PORTION OF OSUNA DRIVE ---
BE IT RESOLVED by the City Council of the City of Carlsbad
as follows:
1. The City Council of the City of Carlsbad does hereby
declare its intention to proceed under the provisions
of Street Vacation Act of 1941 to vacate that certain
portion of Osuna Drive, located within the City of
Carlsbad, County of San Diego, State of California,
particularly described on a map, Drawing No. 182-2,
on file in the Office of the City Clerk and City Engineer
of the City of Carlsbad and on Exhibit "A" attached to
said map.
2. A public hearing shall be held at the City Council
Chambers at 1200 Elm Avenue, Carlsbad, California, at
7:OO p.m., November 4, 1975, for the purpose of hearing
all persons interested in or objecting to said proposed
vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Ci-I:y (:oi.incil of the City of Carlsbad held the7th day of October ,
