SUBJECT: Request for a zone change (ZC-167) from RD-M to R-l-10,000 and
approval of a tentative tract map (CT 75-6).
Applicant: La Costa Land Company (Alicante Hills)

The Planning Commission is recommending approval of Zone Change 167 and
Tentative Map (CT 75-6) on property located on the north and south sides
of Alfil Way between Altisma Way and San Marcos Canyon.
The Tentative Map would permit the development of 105 lots, of which
101 are single family residential, 2 are multiple family residential
(RD-M) and 2 are open space. There are also 9 panhandle lots for which
the Planning Commission has approved a variance pending zone change and
tentative map.
The land contained within the boundries of the tentative map is presently
zoned RD-M with a maximum of 14 dwelling units per acre that could be
developed. The applicant is desirous of reducing the overall density
by developing single family homes and improving the very character of the
area north of the LaCosta gold course by creating single family as opposed
to multiple family.
A Final Subdivision Map 7784 has been recorded. The map contemplated
condominium lots. If requested zone change and tentative map are approved
by the City Council, it will be necessary to revert 7784 to acreage
prior to recording a map for CT 75-6.
All public facilities can be provided concurrent with the needs of the
project.

Recommendation: If the City Council concurs with the findings and

struct the City Attorney to prepare the necessary documents.

CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
RECOMMENDATIONS RELATIVE TO REZONING PROPERTY FROM
RD-M TO R-1-10,000 ON PROPERTY LOCATED ON THE NORTH
AND SOUTH SIDE OF ALFIL WAY BETWEEN ALTISMA WAY AND

WHEREAS, a verified application for a certain property, to wit:
All of Carlsbad Tract No. 72-25 (Alicante Hills) according to
Map thereof No. 7784 on file in the Office of the County Recorder
of San Diego County and a portion of the South Half of Section 25,
Township 12 South, Range 4 West, San Bernardino Meridian according
to the official plat thereof in the City of Carlsbad, County of
San Diego, State of California;
has been filed with the City of Carlsbad and referred to the Planning Commission;
and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing to consider the subject rezoning was held at
the time and in the place specified in said notice on September 10, 1975; and
WHEREAS the subject application has complied with the requirements of
the City of Carlsbad "Environmental Protection Ordinance of 1972"; and
WHEREAS, at said public hearing, upon hearing and considering the testimony
and arguments, if any, of all persons who desired to be heard, said Commission
considered all factors relating to the Zone Change and found the following
facts and reasons to exist:
(1) The proposed zone change is consistent with the General Plan because:
a) The proposed zone density is below the density designated in the
Land Use Element; and
b) The zone change will have no adverse impact on any other element
of the General Plan.
(2) The proposed Zone Change is consistent with the Carlsbad Environmental
Protection Ordinance of 1972 because:

CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF THE
TENTATIVE MAP REQUEST FOR 105 LOT SUBDIVISION ON
PROPERTY GENERALLY LOCATED ON THE NORTH AND SOUTH SIDE
OF ALFIL WAY BETWEEN ALTISMA WAY AND SAN MARCOS CANYON.

WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did on September 10, .1975, hold a duly noticed public hearing to
consider a request by La Costa Land Co.; and
WHEREAS, a verified application for a certain property, to wit:
All of Carlsbad Tract No. 72-25 (Alicante Hills) according to
map thereof No. 7784 on file in the Office of the County Recorder
of San Diego County and a portion of the South Half of Section 25,
Township 12 South, Range 4 West, San Bernardino Meridian according

(1) The project is in conformance with the City's environmental goals;
(2) The project is in an urbanized area with utilities installed and
grading accomplished as a result of a previous entitlement;
(3) Consequently the project will have no significant effect on the
existing environment.
WHEREAS, the proposed map meets or performs the requirements or conditions •>

of the "Carlsbad Municipal Code'" or the Subdivision Map Act; and
WHEREAS,at said hearing a staff report was presented and all persons
desiring to speak on the subject request were heard. At the conclusion of
said hearing, after considering all the evidence presented, the Planning
Commission made certain findings and reached a decision on the request as here-
inafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Carlsbad as follows:
A) That the above recitations are true and correct.
B) That the Planning Commission makes the following findings of fact:
1) The proposed subdivision is consistent with the General Plan
a) The density of the proposed subdivision conforms with the
policies and guidelines of the Land Use Element; and
b) The design of the proposed subdivision conforms with the
policies and guidelines of other applicable Elements of the
General Plan.
2) The proposed subdivision is consistent with the Carlsbad
Environmental Protection Ordinance of 1972 because:
a) The proposed project has been found to have an insignificant
impact on the Environment. A negative declaration has been
filed by the Planning Director.
3) The proposed subdivision is consistent with applicable City Public
Facilities policies and ordinances because:

p. C) That in view of the findings heretofore made and considering the
applicable law, the decision of the Planning Commission is to approve
CT 75-6 subject to the following conditions:
1) The final map shall be submitted for approval within 18 months
from the final action by the City Council on the Tentative Sub-
division Map. The final map shall be in substantial confonnance
with the Tentative Subdivision Map known as Exhibit A, dated
August 5, 1975.
1 2) The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
2 addition to all the requirements, limitations and restrictions of
all municipal ordinances and State and Federal statutes.

3) If requested by the City Engineer, an amended tentative map shall
4 be submitted for approval by the City Engineer prior to prepara-
tion of the Final Map to assure compliance with all conditions of
5 approval.
6 4) Final Subdivision Map 7784 shall be reverted to acreage prior to
Final Map approval.
5) In order to provide for reasonable fire protection during the
8 construction period, the subdivider shall maintain passable
vehicular access to all buildings and adequate fire hydrants
9 with required fire flows shall be installed as recommended by the
Fire Department.

6) All land and/or easements required shall be granted to the City
11 of Carlsbad without cost to the City and free of all liens and
encumbrances. No easements shall be recorded prior to recordation
of the final map unless approved by the City Engineer.
13 7) The improvement and grading plans shall include a report of a
geological investigation and a complete grading plan of the
entire site, when required by the City Engineer. The report and
plan shall be prepared by a Civil Engineer licensed by the State
of Califonria, and experienced in erosion control, who shall be
acceptable to the City Engineer. He shall certify that he
has investigated the site and prepared date with full consideratio
of the consequences to the included and neighboring properties
and in conformance with the Geologic anc Seismic Safety Element
of the General Plan.18
8) All public improvements shall be made in conformity with the City
of Carlsbad Standards, the Subdivision Ordinance and other City
standards, to the satisfaction of the City Engineer without cost20 to the City of Carlsbad and free of all liens and encumbrances.
Improvement plans for water and sewer system shall meet the
21 requirements of the respective service districts.
22 9) No development shall be allowed to occur within the 100 year flood
plain, the boundary of which shall be delineated on the final map23 and grading plans.
24 10) The design of all streets shall be approved by the City Engineer
and all street construction shall be inspected and approved
25 by the Public Works inspector, and standard checking and
inspection fees paid.26
11) The proposed location of the security fence, shown in Exhibit A,
2' dated August 5, 1975, shall be resolved between the applicant,
Planning Director and the Parks and Recreation Director.28

12) Prior to final map approval the design of all proposed security
gates shall be submitted to the City Engineer and Fire Chief
for their approval. Any security gate located on Alfil Way shall
be recessed at least 60 feet from the exte'ntion of the south-
easterly right-of-way line of Alicante Road. A gate shall be
retained at the easterly boundary of the subdivision at the
utilities and access easement extending from Alfil Way.
13) On-site fire hydrants and fire protection appurtenances shall be
constructed in accordance with the Fire Department requirements
and shall provide fire flows of 1750 gallons per minute.
14) Improvement plans and grading plans shall provide, by design and
by specification, that no earthwork or construction crosses
the easterly boundary of the subdivision or is installed or
deposited in the San Marcos Canyon Open Space. The proposed
off-site drainage ditch at the northeast corner of lot 61 shall
be constructed within the subdivision boundary and shall not
direct drainage down the San Marcos Canyon face.
15) The existing Almaden Lane cul-de-sac reservation shall not be
vacated.
16) All private facilities provided to adequately control drainage
on the subject property shall be maintained by the property
owners in perpetuity.
17) An additional lot should be created 10' wide along the eastern
boundary adjacent to lot 61, 60, 59, 58. Said lots shall be
shown on the final subdivision map and shall be offered for
dedication to the City of Open Space purposes concurrent with
final map recordation.
18) An open space easement over a portion of lot 99 as shown in
Exhibit A, dated August 5, 1975, shall be granted to the General
Public in perpetuity concurrent with final map recordaticn. In
addition, a twenty foot wide open space easement over lot 99
extending from the end of the public road to the northern
boundary of the subdivision adjacent the eastern boundary of the
subdivision shall be granted to the City of Carlsbad in perpetuit.

19) An open space easement over portions of lots 1, 100, 101, 102 and
105, as shown in Exhibit A, dated August 5, 1975, shall be
granted to the general public in perpetuity concurrent with
final map recordation.
20) Lots 103 and 104 as shown in Exhibit A, dated August 5, 1975, '•>
shall be dedicated to the City of Carlsbad for Open Space use
concurrent with recordation of the Final Map. Prior to dedica-
tion of lot 104, the existing debris and grading deposits shall
be removed from said lot or the unc.onsolidated fill compacted
to the satisfaction of the City Engineer.

Park-in-lieu fees shall be granted to the City prior to City
Council approval of the Final Map.
CC&R's shall be required for CT-75-6. The CC&R's shall be
submitted to the City Attorney for review and approval prior
to approval of the final map. .The CC&R's shall contain provision
or the proper maintenance of private streets and/or roads, and
maintenance of the open space portions of lots 1 and 105 of
CT 75-6. The maintenance provision for streets and open space
shall be the obligation of the applicant or a homeowner's
association or their successors in interest.
23) All extensions of the existing public water and sewer systems
required to provide water and sewer service to all lots in the
subdivision shall be installed by the developer in accordance
with the standards of the applicable service districts.
24) Street names shall be subject to approval of the Planning
Director prior to Final Map approval.
25) All drainage and flood control facilities shall be approved by
the County of San Diego Flood Control District prior to installa-
tion.
26) A detailed landscape and irrigation plan for all phases of the
project, prepared by a landscape architect, shall be submitted
to the Parks and Recreation Director and the City Engineer for
consideration and approval prior to approval of any building
.- -.- permit for any phase of the project. This requirement shall
apply to all private park areas, open space areas, proposed
meandering sidewalks and proposed entrance medians. Said plan
shall also include the detailed plans for the proposed recreation
facilities to be installed in the private park areas.

I. Staff recommends that ZC-167 be approved based on the
following findings:
General Plan Consistency: The proposed zone change is
consistent with the General Plan because:
a) The proposed zone density is below the density
designated in the land use element; and
b) The zone change will have no adverse impact on any
other element of the General Plan.
Environment: The proposed zone change is consistent with
the Carlsbad Environmental Protection Ordinance of 1972
because:
a) The proposed project has been found to have an
insignificant environmental impact; and
b) A negative declaration has been filed by the
Planning Department.
Public Facilities: The proposed zone change is consistent
with applicable City Public Facilities Policies and
Ordinances because:
a) Minimum public facilities exist on-site; and
b) The proposed zone change has been approved by the
affected school district.
II. Staff recommends that V-252 be approved based on the
following findings and subject to the following conditions:

FINDINGS:
1) There are exceptional conditions present on the
project site not present in the same vicinity and zone
because:
a) The size of the project site is sufficient f°r
the number of lots proposed, but the shape and
topography of the site does not allow full street
access to all lots.
2) The variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied
to the property in question because:
a) The property in the same vicinity and zone has
enjoyed development at the density proposed for the
subject property.
3) The granting of the variance will not be materially
detrimental to the public welfare or injurious to the
property and improvements in the vicinity and zone in which
the project is located because:
a) The lots so created are relatively large and
therefore will permit the mitigation of the problems
associated with lots of substandard frontage.
4) The granting of the variance will not adversely affect
the comprehensive General Plan because:
a) The overall project of which the variance is a
part is in conformance with the policies and intent
of the General Plan.
CONDITIONS:
1) The approval is granted for the land described in the
application and any attachments thereto, and is shown on
the Plot Plan submitted labeled Exhibit A, dated August 5,
1975, except as otherwise indicated herein.
2) This approval shall automatically become null and
void upon expiration of CT 75-6.
3) The flag lots enabled by this approval shall have
graded driveways as approved by the City Engineer. Prior
to issuance of building permits, provisions for the paving
and other development of driveways within the panhandle
portion of flag lots shall be made to the satisfaction of
the City Engineer in accordance with City Council policies,

III. Staff recommends that CT 75-6 be approved based on the
following findings and subject to the following conditions:
FINDINGS:

18) An open space easement twenty feet in width, shall be
granted to the City of Carlsbad over lots 27,28,29,30,58,59,
60 and 61. Said easement shall be granted adjacent the
easterly boundary of the subdivision, concurrent with final
map recordation. Prior to approval of the final map, said
easement shall be rough graded to provide pedestrian access,
or as approved by the Parks and Recreation Director.
19) An open space easement over portions of lots 1, 100,
101, 102, and 105, as shown in Exhibit A, dated August 5, 1975,
shall be granted to the general public in perpetuity concurrent
with final map recordation.
20) An open space easement over a portion of lot 99 as shown
in Exhibit A, dated August 5, 1975, shall be granted to the
general public in perpetuity concurrent with final map record-
ation. In addition, a twenty foot wide open space easement
over lot 99 extending from the end of the public road to the
northern boundary of the subdivision adjacent the eastern
boundary of the subdivision shall be granted to the City of
Carlsbad in perpetuity concurrent with final map recordation.
21) Lots 103 and 104 as shown in Exhibit A, dated August 5,
1975, shall be dedicated to the City of Carlsbad for open
space use concurrent with recordation of the Final Map. Prior
to dedication of lot 104 the existing debris and grading
deposits shall be removed from said lot or the unconsolidated
fill compacted to the satisfaction of the City Engineer.
22) Park-In-Lieu fees shall be granted to the City prior to
City Council approval of the Final Map.
23) The open space portions of lots 1 and 105 shall be main-
tained by appropriate homeowner's associations. The CC&R's
for said associations shall include provisions for the
maintenance of said lots and shall be approved by the City
Attorney prior to approval of the Final Map.

REQUEST: Applicant is requesting a Zone Change from the
existing RD-M to R-l-10,000, a variance for the creation
of nine panhandle lots, and a tentative tract map for
105 lots, of which 101 are single family residential,
2 are multiple family residential, and 2 are open space.
The three actions are requested for the purpose of re-
subdividing an area of land for which an approved tentative
tract map exists.

VI- ENVIRONMENTAL IMPACT INFORMATION: A Negative Declaration
was issued for the original subdivision; the applicant
submitted an EIA for the three actions currently under
consideration. Staff has determined that the project
will have an insignificant environmental impact and a
Negative Declaration has been issued.
VII. GENERAL PLAN INFORMATION; The Land Use Element of the
General Plan designates the project site for residential
RMH development (10 to 20 d.u. per acre). The density
of the proposed project is 15 d.u. per acre in the portion
to be rezoned, and 10-20 d.u. per acre on the two lots
remaining in the RDM zone.
v'HI. PUBLIC FACILITIES: The project, site falls within the
Richmar and Escondido Union High School Districts.
Both Districts have recommended approval of the project
(letters attached).
The project will be served by the Carlsbad Municipal
Water (water) and Leucadia County Water (sewer) Districts.
Both districts have recommended approval of the project
provided existing utilities are extended to serve the
additional lots.

General Plan Consistency: The three actions under consideration
are necessitated by the applicant's desire to change the basic
design of his project from condominiums to large-lot single
family detached residences. In all three cases, the Commission
must, if it wishes to approve the project, find that the design
of the current project is consistent with applicable General Plan
designations. guidelines, and policies. A basic purpose of the
General Plan is to provide for the efficient provision of public
facilities: it gives entities providing such facilities advance
notice of the type and quantity required throughout the City.
Obviously major departures from the Plan negate this important
function.
Staff feels that the new design of Alicante Hills does not defeat
this purpose of the General Plan because:
1) The project site is located on the periphery of the
existing public facilities networks;
2) With the exception of Alicante Road, no facilities net-
works serving adjacent development will be affected by the
disposition of Alicante Hills; and
3) The improvements constructed as a part of the original
project will be taken over by La Costa and maintained by a
Homeowner's Association.
Staff therefore recommends that the project be found in conformance
with the General Plan,
City Panhandle Lot Policy: The applicant's request for a variance
to create nine panhandle lots must be evaluated in terms of the
City's adopted Panhandle Lot policy. Staff finds that the pan-
handle lots proposed are consistent with the policy in that there
is sufficient lot area to create such lots but insufficient frontage
on .a dedicated street to create them with the required frontage;
there is sufficient room on-site to provide the parking normally
provided on the street; and adjacent land cannot be affected upon
application of the subdivision. Conditions similar to those imposed

in La Costa Estates North are recommended to ensure mitigation
of the problems inherent in panhandle lots.
Proposed Security Fence: The applicant proposes to construct a
common security fence "with the Estates North Subdivision to the
north, by extending the fence across the San Diego Gas and
Electric Easement as shown in Exhibit A, dated August 5, 1975.
Such an extension would make the utility corridor inaccessible
to public open space use -- the use designated for it in the
General Plan. Staff recommends that the Commission not accept
the extension of the security fence across the easement as is
shown in Exhibit A.
Open Space: The dedication of lots 103 and 104, Combined with
the easement over lots 1, 99, 100, 101, 102, and 105, will help
provide public access to the .proposed Alga Hills park to the
north. Other links in the access system will come from the Estates
North and Alga Hills subdivisions to the north.
Staff is further recommending a twenty foot wide easement be granted
over lots 27 thru 30 and 53 thru 61 for the purpose of public access
between the San Diego Gas and Electric easement and the mouth of
San Marcos Canyon opposite lot 27. The mouth of the Canyon is part-
icularly valuable as open space due to its flat topography and
relation to the golf course. Without such an easement, public access
from the west would be limited to the golf course—an inappropriate
access route.

We have reviex^ed the map of the new Alicante Hills Development
and find no objections from the Rich-Mar Union School District
standpoint.
(The District will be able to provide facilities concurrent with
the needs of the project. However, it may be of interest to
you that no students have attended Rich-Mar schools from La
Costa to date. We are unable to provide bus service to that
area due to continuing delays in the completion of Alga Road
through to Rancho Santa Fe Road. La Costa students are presently
attending schools in Carlsbad under interdistrict attendance
agreements.
