Statement of the Matter
On September 17, 197^, the City Council'by Resolution No. 3510
approved the tentative map of Carlsbad Tract lk-1 . The owner has
requested that the subject tentative map be extended for a period
of one year to September 17, 1976.
An interdepartmental staff review could not be completed prior to
the expiration date, and at the September 16, 1975, Council meet-
ing the tentative map extension request was referred back to staff
for recommendation within 35 days.
The City Engineer advises that the Planning, Engineering, Fire,
Building Departments, C.M.W.D. £- L.C.W.D. have been contacted to
determine if -they have any objections to the extension of the tenta-
tive map. Having received no objections,, it is recommended that
the City Council approve the extension of the tentative map subject
to the execution and/or fulfillment of all the cond-itions of Reso-
lution No. 3510 and the following conditions:
.1. Applicant s-ha 1 1 submit a landscaping and irrigation plan for the
project to the Parks and Recreation Director for his approval
prior to the granting of any building permit for the proj-ect.
2. The applicant shall maintain all landscaping for a period of
12 months following acceptance of subdivision improvements by
the City, or until sucji time as a Homeowner's Association is
formed in accordance with GC&R's for this development. Com-.
mencing at that time, all landscaped areas shall be maintained
by the Homeowner's Association in such a manner that erosion and
fire hazards are mitigated.

Recommendat ion
Adopt. Resolution No. 37L/L, approving, subject to the additional
conditions., the tentative map time extension of the subject sub-
division for a period of one year, to expire September 17, 1976.

Council Action
10-21-75 Resolution No. 3762, approving with conditions, an
Extension of Tentative Map for CT 74-7 was adopted,
subject to the deletion of Conditions 1 and 2 of
Resolution No. 3762 as presented and the addition
of Conditions 1 and 2 contained in the memorandum
dated October 21, 1975 from the Planning Director
to the City Council being included. Said Tentative
Map Extension was granted for a period of one year
to expire September 17, 1976. (memorandum attached
and made a part hereof.)

Dear Mr. Flanagan:
It is my understanding that on September 17, 1975, the
tentative map approval for the above will expire unless
I receive an extension. Applying for that extension is
the purpose of this letter.
Due to the national economy and the depressed state of
La Costa, we are forced to postpone any building plans
until there is a rally in the economy here.
Since I am not recording a subdivision map, I realize
that I am subject to the new requirements of the new
subdivision map act.
Please call me at 753-0128 if you have any questions
pertaining to the extension.

RESOLUTION NO. 3510
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE SUBDIVISION MAP
fCT 74-7) FOR A ONE-LOT CONDOMINIUM ON A
.785-ACRE SITE ON THE EAST SIDE OF JEREZ
COURT APPROXIMATELY 400 FEET NORTH OF ITS
INTERSECTION WITH GJBRALTER STREET.
APPLICANT: BARRIE F. CHASE
WHEREAS, on the 13th day of August, 1974, the Carlsbad
City Planning Commission adopted Resolution No. 1089 recommending
to the City Council that Tentative Map (CT 74-7) be conditionally
approved; and
WHEREAS, the City Council of the City of Carlsbad, on the
3rd day of September r 1974, considered the recommendation of
the Planning Commission; and
WHEREAS, said Tentative Map has been declared to have a
nonsignificant impact on the environment and a Negative Declaration
has been prepared and filed in compliance with the requirements of
the City of Carlsbad Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 74-7) is hereby approved sub-
ject to all applicable requirements of the Carlsbad Municipal
Code and to the satisfaction of the following conditions:
1. The development of the property described herein
shall be subject to the restrictions and limitations set
forth herein which are in addition to all the requirements,
limitations and restrictions of all municipal ordinances
and state and federal statutes now in force, or which,
hereafter may be in force for the purpose of preserving
the residential characteristics of adjacent properties,
2. The CC&R's for this development shall be submitted
to the Planning Director for review and approval prior to
the issuance of any building permits.
3. Park-in-lieu fees shall be granted to the City
prior to City Council approval of the final map.
4. In order to provide for reasonable fire protection
during the construction period, the subdivider shall main-

tain passable vehicular access to all buildings and
adequate fire hydrants with required fire flows shall be
installed as recommended by the Fire Department.
5. All public improvements shall be made in conform-
ity to the City of Carlsbad Engineering Design Criteria
and Standard Plans, the Subdivision Ordinance and other
City standards to the satisfaction of the City Engineer
without cost to the City of Carlsbad, and free of all
liens and encumbrances. Improvement plans for water and
sewer systems shall meet the requirements of the respec-
tive service districts.
6. All drainage and grading plans shall be submitted
to the City Engineer for consideration and approval.
7. All utilities, including provisions for cable TV,
shall be placed underground and/or shall be completely
cpncealed from view.
C. That said Tentative Map, together with the provisions
for its design and improvement and subject to the above condi-
tions, is consistent with all applicable general and specific
plans of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 17th day of September , 1974,
by the following vote, to wit:
AYES: Councilmen Chase, McComas, Lewis and Skotnicki

RESOLUTION NO. 3762
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS AN EXTENSION OF TENTATIVE
MAP (CT 74-7). APPLICANT: HARRIS F. CHASE.
WHEREAS, the City Council of the City of Carlsbad, on
the 17th day of September, 1974, adopted Resolution No. 3510
approving, with conditions, Tentative Map (CT 74-7); and
WHEREAS, the subdivider has requested a one-year exten-
sion of such map from September 17, 1975 to September 17, 1976;
and
WHEREAS, the City Council has determined to extend such
map subject to additional conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 74-7) is hereby extended,
subject to the execution and/or fulfillment of all the conditions
of Resolution No. 3510 and the following conditions:
1. The applicant shall submit a landscaping and
irrigation plan to the City Engineer for those slope areas and
landscaping areas which are adjacent to proposed public rights-
of-way for his approval prior to the approval of the final sub-
division grading plan. Said plan shall include a statement of
installation phasing, and shall include landscaping that will
satisfy erosion and fire hazard controls.
2. The applicant or his successor in interest shall
maintain all landscaping to the satisfaction of the City Engineer
and Parks and Recreation Director. Successor in interest shall

mean owner of record or applicable property owner's association.
C. That said tentative map extension together with the
provisions for its design and improvement and subject to the
above conditions, is consistent with all applicable general and
specific plans of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the Carlsbad City Council held on the 21st day of October
1975, by the following vote, to wit:
AYES: Councilmen Chase, Lewis and Councilwoman Casler.
NOES: None.
ABSENT: Councilmen Frazee and Skotnicki.
