CITY OF CARLSBAD Initial: DEPARTMENT: Enqi neerinq Subject: TENTATIVE MAP EXTENSION - CT 74-16 (SEAPINES, n/e OF POINSETTIA LANE & LAGOON LANE) On November 6, 1974, the City Council by Resolution No. 3540 approved the tentative map of Carlsbad Tract 74-16. The owner has requested that the subject tentative map be extended for a period of one year to November 6, 1976. The City Engineer advises that the Planning, Engineering, Fire and Building Departments have been contacted to determine if they have any objections, to the extension of the tentative map. Having received no objections, it is recommended that the City Council approve the .extension of the tentative map subject to the execution and/or ful- fillment of all the conditions 'of Resolution No. 3540, and the follow- ing condition: No final map will be approved until provisions are made to extend the offsite sewer to connect to the existing Ponto sewer and to construct the necessary pumping system; that is until plans are approved and easements and bonds are received. Condition and No. 1 irrigation The applicant shall submit a landscaping plan to the City Engineer for those slope areas and landscaping areas which are adjacent to proposed public rights-of-way for his approval prior to the approval of the final subdivision grading plan. Said include a statement of installation phasing, and plan shall shall in- clude landscaping that will satisfy erosion and fire hazard controls. \ Condition No. 2: The applicant or his successor in interest shall maintain all landscaping to the satisfaction of the City Engineer and Parks and Recreation Director. Successor in interest shall mean owner of record or applicable property owner's association. The conditions as worded represent the context of conditions contained in approving resolutions of Tentative Map Extension for Cabot, Cabot & Forbes and Barrie F. Chase. The same conditions should be added in the approving resolutions for Tentative Map Extension for Carrillo Estates and Standard Pactfic. A. This project would be under construction if it were not for rulings by the Coastal Commission and Attorney General on other projects that could affect this project. APPLICANT: STANDARD PACIFIC OF SAN DIEGO. WHEREAS, on September 24, 1974, the Carlsbad City Planning Commission adopted Resolution No. 1097 recommending to the City Council that Tentative Map (CT 74-16} be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 16th day of October , 1974, considered the recommendation of the Planning Commission; and WHEREAS, an Environmental Impact Report has been prepared, and discussed at duly noticed public hearings before the Planning Commission and the City Council, and the final report has been certified as complete in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the-above recitations $re true and correct, B. That Tentative Map (CT 74-16) is hereby approved sub- ject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties, 2. The CC& R's for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. 3. In order to provide for reasonable fire protec- tion during the construction period the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 5. All utilities, including provisions for cable TV, shall be,placed underground and/or shall be completely concealed from view. 6. Ornamental street lighting shall be provided for as required by Municipal Code. The developer shall post a bond and/or cash in the amount necessary to energize said street lights for an eighteen-month period after construction to permit the incorporation of the subdivi- sion into a maintenance district. 7. All land and/or easements required by this ordi- nance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer. 8. The improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site when required by the City Engineer, The report and plan shall be prepared by civil engineers li- censed by the State of California and experienced in erosion control. Said engineersshall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties and conform to the standards of the Geological Safety Element of the General Plan. 9. Any permits required by the Coastal Zone Conserva tion Act shall be obtained prior to final map approval. C. APPLICANT: STANDARD PACIFIC (SEA PINES). WHEREAS, the City Council of the City of Carlsbad, on the 6th day of November, 1974 adopted Resolution 3540 approving with conditions Tentative Map (CT 74-16); and WHEREAS, the subdivider has requested a one-year exten- sion of such map from November 6, 1975 to November 6, 1976; and WHEREAS, the City Council has determined to extend such map subject to additional conditions; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-16) is hereby extended, subject to the execution and/or fulfillment of all the conditions of Resolution No. 3540 and the following conditions: 1. The applicant shall submit a landscaping and irrigation plan to the City Engineer for those slope areas and landscaping areas which are adjacent to proposed public rights-of-way for his approval prior to the approval of the final subdivision grading plan.
