Statement of the Matter
La Costa Land Company, the owners of all the real property subdi-
vided by Map No. 7992, have petitioned for its reversion to
acreage and submitted a final map for that purpose. The City
Engineer advises that the Planning, Fire, and Parks and Recrea-
tion Department, Carlsbad Municipal Water District, Leucadia
County Water District, San Diego County Flood Control District,
San Diego Gas & Electric Company, and Pacific Telephone Company
have been requested to comment on the proposed action. No objec-
t ions were received, and no reservation of easements dedicated on
Map No. 7992 are necessary..
A public hearing has been duly noticed as required by State law.

Recommenda t i ons
The City Council approve the final reversion map, direct the City
Clerk to release the bonds for CT 73-10, and direct the Finance
Director to release $16/707.33 to |_a Costa Land Company.

Gentl emen :
We, the undersigned, La Costa Land Company, are the owners and the
developers of the property encompassed by Map No. 7992.
Whereas we have filed a tentative map, Carlsbad Tract No. 75-4,
with the City Planning Department for the resubdivision of the
property encompassed by Map No. 7992.
Whereas those streets (El Fuerte Street) necessary to complete
the vehicular circulation through the subject property are a
part of the resubdivision.
Whereas none of the other dedications shown on said Map No. 7992
are necessary for public purposes.
We therefore respectfully request that the City Council of Carlsbad
California approve this Map of Reversion to Acreage of Map No. 7992.

Re: Reversion to acreage
NOTICE IS HEREBY GIVEN that the City Council of 'the City of
Carlsbad will hold a public hearing on Tuesday, October 21, 1975,
at 7:00 p.m. in the Council Chambers, 1200 Elm Avenue, Carlsbad,
California to consider a request for reversion to acreage of that
real property shown on Map No. 7992 (Carlsbad Tract 73-10),
located on the east side of Alga Road between Alfil Way and Babi-
lonia Street, and more particularly described as:
"Portions of Section 30, Township 12 South, Range 3 West, and
Sections 25 and 36, Township 12 South, Range 4 West, San Bernar-
dino Meridian, in the City of Carlsbad, County of San Diego,
State of California, according to official plats thereof."
Those persons wishing to speak on this proposal are cordially
invited to attend the public hearing. If you have any questions,

SUBJECT: CT 73-10 Reversion to Acreage.
This reversion map process will nullify the lots and easements
created for La Costa Estates North (CT 73-10). This action
is a condition of City Council Resolution No. 3709, approving
a resubdivision (CT 75-4) of the original real property. The
boundaries of the present recorded map (No. 7992) for CT 73-10,
the subject reversion map, and the proposed map for CT 75-4
are identical. Although open space easements are involved,
there are no dedicated park lands within the boundary. The
City Park dedication in adjacent San Marcos Canyon is a
separate parcel covered by separate negotiations. Open space
easements will be quitclaimed by this map, but they will be
rededicated as conditioned in the specific plan Resolution
No. 9435 approving the resubdivision.
The subdivision ordinance provides for disposition of fees and
deposits and release of improvement securities. A final
accounting of CT 73-10 has been made. We recommend the
retention of map and plan check fees, the return of fees and
deposits related to public improvements and fees for unused
public services, and the release of all improvement securities,
and the agenda bill reflects this recommendation. All fees
and deposits released will soon be recollected as applicable
to CT 75-4.

CITY OF CARLSBAD, CALIFORNIA/ APPROVING
A FINAL MAP TO REVERT TO ACREAGE, MAP
NO. 7992, CARLSBAD TRACT (CT 73^10)
GENERALLY LOCATED ON THE EAST SIDE OF ALGA
ROAD BETWEEN ALFIL WAY AND BABILONIA STREET
KNOWN AS LA COSTA ESTATES NORTH AND APPROV^
ING THE RELEASE OF IMPROVEMENTS SECURITY
AND RETURN OF FEES FOR SAID SUBDIVISION.
APPLICANT: LA COSTA LAND COMPANY.
WHEREAS, the City Council has approved a subdivision
(CT 73-10) known as LA COSTA ESTATES NORTH, which has been finaled
and recorded as Map No. 7992; and
WHEREAS, all the owners of the subject property have
petitioned the City Council to revert the subdivision to acreage
in accord with the provisions of Chapter 20.40 of the Carlsbad
Municipal Code and the Subdivision Map Act; and
WHEREAS, a duly noticed public hearing has been held
in accord with law on the 21st day of October, 1975; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the City Council finds that the dedications,
or offers of dedications, to be vacated or abandoned, by the
reversion to acreage of CT 73-10, Final Map No. 7992, are
unnecessary for present or prospective public purposes.
3. That all owners of an interest in the real property
within the subject subdivision have consented to the reversion.
4. That the Final Map for the reversion to acreage of
the subdivision known as LA COSTA ESTATES NORTH,(CT 73-10), Map
No. 7992, is hereby approved.

5. That the City Clerk is directed to release all the
improvement securities being held for said subdivision,
6. That the Finance Director is directed to return the
inspection, street light energy, street sign,and duplicating
tracing and printing deposits and the park fees in a total amount
of $16,707.33,

Carlsbad City Council held on the 21st day of October f
