Applicant: Regan Construction Statement of the Matter The Planning Commission recommends 'approval of CT 75-8 for reasons and subject to conditions contained in Planning Commission Resolution 1197 of October 15, 1975. The subject condominium project is located at the southwest corner of Pine Avenue and Washington Street adjacent to the A.T.&S.F. railroad right-of-way. The Planning Commission expressed concern regarding possible noise problems along the railroad rtght-of-way to the northeast of the project. Staff pointed out that noise attenuation has been providing for further site review tn accordance with Noise Element and provisions of the Uniform Building Code. EXHIBITS; Staff Report of October 15, 1975 Planning Commtssion Resolution No. 1197 RECOMMENDATION; If the City Council concurs with the findings and recommendation of the Planning Commission as outlined in Planning Commission Resolution No. 1197, it is recommended that the City Attorney be Instructed to prepare the necessary documents. Council action 11-4-75 The City Attorney was instructed to prepare the necessary documents for approval of the tentative map for Carlsbad Tract-75-8, to include the restrictions and conditions imposed by the Planning Commission's Resolution #1197. CITY OF CARL5BAD "-- PLANNING DEPARTMENT ^ STAFF REPORT October 15, 1975 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT CASE NO. CT 75-8 APPLICANT: TONY REGAN REQUEST: REQUESTS APPROVAL OF A ONE LOT, 22 UNIT CONDOMINIUM PROJECT AT THE SOUTHWEST CORNER OF PINE AND WASHINGTON STREETS. SECTION I; STAFF RECOMMENDATION Staff recommends that Case No. CT 75-8 be APPROVED because of the following findings and subject to the following conditions: FINDINGS (1) The project has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972" because: a) An environmental impact assessment of the project was completed and a negative declaration issued for the following reasons: 1) The project is located in an existing urbanized area with all utilities installed. 2) The project entails minimal grading. (2) The proposed subdivision map, its design and improvements, is consistent with the General Plan because: a) The land use and density of the project (21.7 dwellings per acre) conform to the Land Use Element designations (Residential High Densitys, 20-30 dwellings per acre). b) Noise attenuation has been guaranteed through conditions of approval providing for further site review in accordance with Noise Element Action Program 2.3. c) The provision of public services in accordance with the Public Facilities Element has been guaranteed. CONDITIONS (1) The approval is granted for the land describes in the application aid any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated August 25, 1975. The location of all buildings, fences, signs, roadways, parking areas, landscaping, and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. All buildings and structures shall be of the design as shown on the elevation plans labeled Exhibit A. 2. The Final Map shall be submitted for approval within 18 months from the final action by the City Council on the Tentative Subdivision Map. The Fin-al Map shall be in substantial con- formance with the Tentative Subdivision Map known as Exhibit A dated August 25, 1975. . 3. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 4. Ornamental street lighting shall be provided for as required by Municipal Ordinance. The developer shall deposit cash in the amount necessary to energize said street lights for an eighteen month period after construction, to permit the in- corporation of the subdivision into a maintenance district. 5. All land and/or easements required shall be granted to the City of Carlsbad without cost to the City, and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer. g< Half street frontage improvements shall be installed in Pine Avenue, based on a 30 foot half street section. The sidewalk shall be installed as to minimize the removal of existing trees, as approved by the City Engineer. 7. Washington Avenue shall be dedicated and improved on the basis of a 30 foot half street width along the property frontage. Dedication shall include a 20 foot radius property line return at the intersection of Washington Avenue and Pine Street. Improvements shall include a complete cross gutter across Pine Street, designed to conform with future improve- ment of Pine Street and Washington Avenue. 8. Park in lieu fees shall be granted to the City prior to City Council approval of the final map. 9. The C.C.&Rs for this development shall be submitted to the Planning Director for review and approval prior to the approval of the Final Map. 10. No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad. 11. Prior to the issuance of any building permits, a study of the noise levels on the project site shall be made by an acoustical engineer experienced in noise attenuation. Said study shall determine if attenuation measures are necessary to bring noise levels within 65 db(A) outdoors and 45 db(A) tndoors. Said study shall recommend such attenuation measures as deemed necessary. Said meas-ures shall be incorporated in the site design and building plans for said lots.-I- SECTION II: STAFF BACKGROUND REPORT October 15, 1975 CASE NO.: CT 75-8 APPLICANT: REGAN CONSTRUCTION CO. *• REQUEST; The applicant requests approval of a 22 unit condominium project. II. LOCATION AND DESCRIPTION OF PROPERTY; The southwest corner of Washington Street and Pine Avenue (see attached location map). A dwelling exists on part of the site. The remainder is an uncultivated field. III. EXISTING ZONING; Subject Property: R-3 North: R-3 East: M South: R-3 West: R-3 IV. EXISTING LAND USE: Subject Property: Single Family Dwelling North: Single Family Dwelling East: Railroad right-of-way South: Apartments; avocado orchard West: Single Family Dwelling V. PAST HISTORY AND RELATED CASES; CT 74-9, a 16 unit condo- minium project on .9 acres located on the northwest corner of Chestnut and the railroad right-of-way, was approved by the City Council on September 17, 1974. VI. ENVIRONMENTAL IMPACT INFORMATION: An Environmental Impact Assessment of the project was conducted and a negative declaration (nonsignificant impact) issued September 5, 1975 for the following reasons: 1. The project is located in an existing urbanized area with all utilities installed. 2. The project entails minimal grading. -3- VII. GENERAL PLAN INFORMATION: The project site is designated for RH (residential high density use in the Land Use Element, 20-30 dwelling units per acre). The density of the proposed project is 21.7 dwelling units per acre. The project site is within the noise contour of the rail- road right-of-way adopted in the Noise Element. Attenuation measures are therefore required. As described in the Noise Element Action Program 2.3, these measures include setbacks, construction of barriers and sound insulation. VIII. PUBLIC FACILITIES; Sewer and water service will be supplied by the City of Carlsbad. The project falls within the Carlsbad Unified School District which has sent the City a letter approving the project, and guaranteeing adequate school facilities (attached). U. MAJOR PLANNING CONSIDERATION: Are adequate public facilities provided in conformance with the Public Facilities Element? K. INCIDENTAL INFORMATION: This project requires approval from the Coastal Commission. All affected departments and agencies have contributed Input to and reviewed this report. SECTION III: DISCUSSION Under the City's Subdivision Ordinance, review of condominium projects is limited to the provision of public facilities. Since the project is located in an urbanized area with all facilities available, this consideration poses no problems. Staff's major concern is that noise from the adjacent railroad tracks be attenuated. The recommended condition that a further noise study be made and its attenuation measures incorporated in the project design should take care of this concern. CASE NO. CT-75-8 APPLICANT: REGAN CONSTRUCTION WHEREAS, a verified application for a certain property, to wit: Tract 222 of Thum Lands, in the County of San Diego, State of California, according to map thereof No. 1681, filed in the Office of the County Recorder of San Diego County, December 9, 1915; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy of the City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972 because: 1) An Environmental Impact Assessment of the project was completed and a negative declaration issued for the following reasons: a) The project is located in an existing urbanized area with all utilities installed. b) The project entails minimal grading. WHEREAS, said Commission considered all factors relating to the tentative nap and found the following facts and reasons to exist: 1) The proposed subdivision map, its design and improvements, is con- sistent with the General Plan because: a) The land use and density of the project (21.7 dwellings per acre) conform to the Land Use Element designations (Residential High Densitys, 20-30 dwellings per acre). b) Noise attenuation has been guaranteed through conditions of approval providing for further site review in accordance with Noise Element Action Program 2.3. c) The provision of public services in accordance with the Public Facilities Element has been guaranteed. The location of all buildings, fences, signs, roadways, parking areas, land- scaping and other facilities or features shall be located sub- stantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. All buildings and structures shall be of the design as shown on the elevation plans from the final action by the City Council on the tentative subdivision map. The Final Map shall be in substantial confor- mance with the Tentative Subdivision Map known as Exhibit A 3) In order to provide for reasonable fire protection during the tonstruction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department.16 4) Ornamental street lighting shall be provided for as required by Municipal Ordinance.
