PROPOSED MORATORIUM, PLANNED COMMUNITY (P-C) ZONE
Statement of the Matter
On November 4, 1975, City Council requested the staff to prepare
a moratorium on all Planned Community Zones in order to com-
pletely review the existing Planned Community Zone.
A number of the related decisions must be made simultaneously
with Council's action on the moratorium. The Council should
also consider the effect the moratorium would have on applications
currently being processed by the City staff and on building permits
which would be requested within the Planned Community Zone.

Recommendation
If the City Council's intention is to place a moratorium on
all additional planned community projects, the attached
ordinance should be adopted. If, however, the Council wishes
to allow those items already set for hearings before the Planning
Commission or City Council to be processed (Items a & b of
Planning Director's memo dated November 12, 1975), this matter
should be continued until those projects in process have been
considered by the City Council.
By minute action, it is recommended that the Council instruct
the staff to set no more planned community items to public
hearing before the Planning Commission.

11-18-75 The matter of the moratorium was continued to the next regular
Council meeting, and the staff was instructed to not accept
any further applications for P-C zoning.
12-2-75 Ordinance #9445, adopted as an urgency measure, prohibiting
the processing or approval of Master Plans or Specific Plans
for property zoned P-C.
MEMORANDUM

SUBJECT: PROPOSED MORATORIUM, PLANNED COMMUNITY (P-C) ZONE
The City Council, November 4, 1975, requested the staff to prepare a moratorium
on all Planned Community Zones in order to completely review the existing Planned
Community Zone.
The staff has reviewed all applications being processed under the P-C Zone and
finds the following to exist:
a) Green Valley Knolls SP-171, CT 75-7
b) Occidental Land Co. (Hester Development) amendment to SP-135A
c) Pre-Annexational Change of Zone ZC-170
It is the Staff's opinion that to properly implement a moratorium, the City
Council consider the following action:
a) Adopt a moratorium on all applications processed as part of the
Planned Community Zone which would require a new application for the
following:
1) Zone Changes
2) Master Plan
3) Specific Plan
4) Tentative Subdivision Maps
b) Applications currently being processed by the staff and being heard
by the Planning Commission and City Council would continue to be pro-
cessed.
c) Building permits or other permits requested subsequent to the final
approval of a Tentative Subdivision Map or a final map will be issued
and shall not be subject to the proposed moratorium.

ORDINANCE NO. 9445
AN INTERIM ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
ADOPTED AS AN URGENCY MEASURE PROHIBITING
THE PROCESSING OR APPROVAL OF MASTER PLANS
OR SPECIFIC PLANS FOR PROPERTY ZONED
PLANNED COMMUNITY (P-C).
WHEREAS, the Planning Department upon direction by
the City Council has undertaken a comprehensive review of the
P-C, Planned Community Zone, and is preparing a revision of
said zone; and
WHEREAS, the City Council has determined that it is
necessary in order to protect the public safety, health and
welfare to adopt as an urgency measure an interim ordinance
prohibiting further processing or approval of Master Plans or
Specific Plans for property in the P-C zone to avoid conflict
with the contemplated revision to the zone.
NOW, THEREFORE, BE IT ORDAINED by the City Council
of the City of Carlsbad, California, as follows:
SECTION 1: That all processing and approval of
Specific Plans and Master Plans in that area of the City of
Carlsbad zoned P-C, Planned Community, is hereby prohibited.
SECTION 2: This ordinance shall be read once and
shall take effect immediately.
SECTION 3: The City Clerk shall certify to the
adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after
its adoption.
