DELETION OF DEPARTMENT HEADS FROM CLASSIFIED SERVICE
Statement`6f the Matter: The purpose of this agenda bill is to
recommend a change -to Section 2.44.030, City Services., of the Carlsbad
Municipal Code. The change would be to unclassify department heads.
Presently, the Assistant City Manager, A§sistant to the City Manager
and Administrative Assistant/s axe unclassified. Unclassifying department
heads would serve two purposes. First, it would allow the City Manager
flexibility in building•a management team. Second, -appointees would
be more responsive to the City Manager
Two courses of action are available to the Council..
Course of Action Number I; would be the adoption of Attachment I, which
-would not change the status of present department heads, but would allow
future hiring of department heads as unclassified personnel.
Course of Action Nomber II, would be the adoption of -Attachment II,
which would, upon -adoption, unclassify al-1 department'heads.
This action is authorized by a majority vote of the City Council
under`the provisions of Section 450.07 of the California Government Code..

Recommendation to the Cj-':y Manager: Course of Action Number I, adoption
of Attachment I, is recommended. This course of action would"grandfather
present department heads as classified personnel but permit flexibility
in future designations of department heads.
If Council apprdves, the matter should be referred to the City Attorney
for preparation of 'documents.

was instructed to prepare the necessary documents foi adoption.

2.44.030 City service. The provisions c
shall apply to all offices, positions and empl
service of the city, except:
(1) Elective officers;
(2) Members of appointive boards, commis
(3) Persons engaged under contract to supply expert,
professional or technical services for a definite period of time;
(4) Volunteer personnel who receive no regular compensation
from the city;
(5) City Manager (covered in separate Ordinances 1040 and
1088, codified in Chapter 2.12);
(6) Assistant City Manager;
(7) Assistant to the City Manager;
(8) Administrative Assistant;
(9) All department heads hired on or after November 1, 1975;
(10) City Attorney;
(11) Emergency employees who are hired to meet the immediate
requirements of an emergency condition, such as extraordinary fire,
flood or earthquake which threatens life or property;
(12) Employees, other than those listed elsewhere in this
section, who are employed less than half time, which is defined
as employees who are expected to or do work less than one thousand
forty hours in any one fiscal year. (Ord. 1166 Sl, 1974;
