DATE: ' - ' DEPARTMENT: PLANNING ' City Mgr. \\ SUBJECT: ADOPTION OF MINOR AMENDMENTS AND ADDITIONS TO THE LAND USE ELEMENT OF THE CARLSBAD GENERAL PLAN (GPA-36) Statement of the Matter - Durino the course of the recent General Plan Re- visions, and subsequent discussions on other related items, staff was in- structed to process some minor amendments to the General Plan when time allowed. This action includes those amendments. GPA-36 affects the Land Use Element in two ways. One, it amends the textual description of the "Public Utilities" classification and adds a description reqardina "Unique and Special Uses". Second, it makes four minor amendments to the Land Use Plan to'fit the above description modifications and for zoninn consistency purposes. Planning Commission Resolution No. 1205 recommends approval of this amendment (GPA-36). It should be noted that the Commission considered this matter in coniunction with GPA-36. Staff has sol it the Agenda Bills to avoid con- fusion over the overall Goals Statement (GPA-36) and the report included in the Agenda Bill regarding possible Goal amendments to the Land Use Element. This report involves the recommendations of the Citizens' Goals Committee and the Planning Commission regarding the alternative goals to the Land Use Element that were suagested by Councilman Skotnicki during the Land Use Element hearings. Further detail on all these matters is contained in the attached memorandum dated December 5, 1975. Council action 12-16-75 Following the public hearing Resolution #3817 was adopted, amending the Land Use Element of the General Plan (GPA-36) to make certain minor revisions in the text and to change the Land Use Designation for four areas of the City's General Plan. o Council action 12-16-75 ABI3540 and AB#3541 DISCUSSED AS ONE ITEM. Resolution No. 3817, AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN (GPA-36) TO MAKE CERTAIN MINOR REVISIONS IN THE TEXT AND TO CHANGE THE LAND USE DESIGNATION FOR FOUR AREAS OF THE CITY'S GENERAL PLAN, was adopted. Further, it was moved that the Goals Element of the Land Use Element of the General Plan (G)A-36) be continued to the next regular meeting at which time the Overall Goals of the General Plan (AB#3541) will be discussed. 1-6-76 AB#3541 - Suppl#l (AB#3540 was incorporated in this Agenda Bill) It was moved that the Council accept the report of Land Use Element Goals indicated in the Memorandum from the Planning Department to the City Council, dated December 10, 1975, subject to the inclusion of Item "L" and that the matter be set for Public Hearing by the Planning Commission at the time Public Hearings are to be held for the next General Plan Amendment. i 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 PLANNING COMMISSION RESOLUTION NO. 1205 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL ADOPTION OF GPA-37, AN OVERALL GOALS STATE- MENT TO THE GENERAL PLAN, AND GPA-36, MINOR AMEND- MENTS AND ADDITIONS TO THE LAND USE ELEMENT OF THE GENERAL PLAN .WHEREAS, the Planning Commission did on the 26th day of November, 1975, hold a duly noticed public hearing as prescribed by law to consider amendments to the General Plan establishing an overall goals statement and making minor amendments and additions to the Land Use Element; and WHEREAS, the subject General Plan Amendments have complied with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; and WHEREAS, at said public hearing, after the testimony and arguments of all persons who desired to be heard, said Commission considered all the factors relating to the General Plan Amendments and found the following facts and reasons to exist: A) The modification to the Land Use Element text and plan are needed for clarity and for consistency with the Zoning Ordinance. B) The inclusion of an overall goals statement and general policy statements would clarify the General Plan's overall function. WHEREAS, due to the nature of these amendments, it has been determined that a Declaration of Negative (non-significant) Environmental effect is warranted for the following reasons: A) The modification to.the Land Use Element text and Plan are of an administrative nature and will have minimal effect on the physical or -human environment. B) The Goals Statement simply reaffirms and consolidates previously adopted goals and policies. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That the following amendments to the General Plan are recommended to the City Council for approval: \ 1 (1) The textual description of the "Public Utilities" classification in the Land Use Element be modified to read as follows: 2 "This category of land use designates areas currently beinq 3 used for public and quasi-public functions such as power generation, energy transmission, and sewage treatment." 4 (2) ^A new description be added to page 32 of the Land Use Element 5 "as follows: 6 "13. Unique and Special Uses 7 .Within each land use designation, there is the potential for certain land uses that posses unique and special character- 8 Jstics. These uses may include, but are not limited to Jcemetanes. churches, golf courses, mobile home parks,. 9 recreational vehicle parks, public and quasi-public access- pry buildings and facilities, and hospitals. 10 These types of uses cannot be automatically placed within 11 any particular Land Use Category and must be reviewed on an individual site basis. Criteria for this review should in- 12 elude the following: 13 a) Jhe proposed use is necessary and desirable for the City 14 b) The proposed use will be in accord with all of the Elements of the General Plan; 15 c) The proposed use is not detrimental to existing or 16 planned uses in the same vicinity; d) The proposed site is adequate in size and shape to taccomodate the proposed use and any future expansion 18 Jthat may be necessary; 19 e) The street system serving the proposed use is adequate to properly handle all traffic generated by the pro- "Fosed use with minimum disruption to existing area." 21 (3) On page 21. after COMBINATION DISTRICT, add: 22 "UNIQUE AND SPECIAL USES" 23 (4) /our areas on the Land Use Plan be amended as outlined on Exhibits "1", "2", "3", and "4". dated November 26, 1975. and attached hereto. ' - ,V/:7> EXHIBIT' PROPOSED - GOAL AND POLICY STATEMENTS OF THE GENERAL PLAN CITY OF CARLSBAD We, the citizens of Carlsbad, recognizing that we have a unique opportunity to meet the challenge of the future development of our City, do adopt the following goals and policies as part of the General Plan for the City of Carlsbad: GOALS The goal of the Carlsbad General Plan is to provide for the development of Carlsbad as a carefully planned, balanced community that will provide its citizens with the full range of physical facilities and human services that will ensure a life of quality for all. This goal envisions a community composed of cohesive neighborhoods and areas of varied size and socio-economic structure'grouped around an appropriate number of centers providing community services in a safe, attractive, pollution-free environment, based on a sounds viable economy. The.following is a list of Elements of the General Plan v/ith an accompanying overall goal statement for each: 1) Land Use Provide a plan to guide the physical development of the City in an orderly, functional and compatible manner. 2) Circulation , ' Provide a safe, realistic, and integrated circulation system compatible, with the existing and proposed land use pattern of the City. 3) Housing Provide a variety of quality hous'ing types suitable to the economic means and living styles of all identifiable segments of the population. 4) Conservation * Provide a plan for the conservation, development, and utilization of the natural resources in the City *Combined with Open Space Element- 5) Ofc?n Space * Provide for the comprehensive and long-range preservation and conservation of open space land within the City. 6) Geologic and Seismic Safety Reduce loss of life, injuries, damage to property, and economic and social dislocation resulting from geologic hazards. 7) Noise Minimize the impact of noise pollution hy provid- ing compatible land use alternatives and reducing the level of noise wherever possible. 8) Scenic Highway Preserve and enhance areas of scenic quality through the development, establishment, and protection of .scenic highways. 9) Safety Provide a comprehensive plan to prepare for and protect against fires, floods, and other major disasters. 10) ' Parks and Recreation Meet the recreational needs of the community by providing a system of parks, green belts, land and water recreation facilities and buildings in an integrated, useful, attractive and comfortable environment. 11} Public Facilities Assure that adequate public services and facilities .are available to meet the needs of the existing and future population of the City. GENERAL POLICY .STATEMENTS 1) Each goal contained within the General Plan reflects the desires of the community. Amendments to the General Plan shall be limited to those necessary to achieve these goals or to those reflective of changing goals of the community. *Combined with Conservation Element -2- 2) Tne Citizens of Carlsbad shall be afforded the opportunity to review the entire General Plan annually and recommend necessary rev isions to the City Council for adoption. 3) An element of the General Plan shall be amended a maximum of three times per calendar year. "4) When an amendment is proposed to an element of the General Plan, the impact of such an action on each of the other elements shall also be considered. 5) Every element of the General Plan shall be considered when evaluating the conformity of a proposed project to the Plan. 6). Implementing tools, such as zoning, specific plans and development plans, shall be consistent with each element of the General Plan. 7) If an inconsistency exists between a proposed project and the General Plan, this inconsistency 'shall be corrected prior to any action by the City. . 8) Programs, such as a capital improvement budget, shall be developed to implement and maintain the goals and policies of the General Plan. • 9) The rate of population growth shall be based on the City's capacity to furnish supportive services without adversely affecting established areas." 10) The City shall utilize a design review process to insure harmony and compatibility of new develop- ment with existing land uses. 11) The City shall maintain an informative dialogue with its citizens in formulating its policies and actions. t 12) An aggressive attempt shall be made by the City to implement all of the recommendations of the General Plan. NOTE: More specific goal and policy statements will be found in the individual elements of the General Plan. MEMORANDUM December 5, 1975 TO: CITY COUNCIL FROM: PLANNING COMMISSION SUBJECT: GENERAL PLAN AMENDMENT - 36 During the course of the recent General Plan Revisions, and subsequent discussions on other items, staff was instructed to process some minor amendments to the General Plan when possible. Because staff foresees some major amendment requests being submitted for consideration early in 1976, the Planning Commission feels it appropriate to complete action on these minor amendments before the end of the year. GPA-36 would affect the Land Use Element in two ways, One, it would modify the textual description of the "Public Utilities" classification and add a description regarding "Unique and Special Uses". Second, it would make four minor amendments to the Land Use Plan to fit the above description modifications and for zoning consistency pur- poses. The textual change to the "U" classification would clarify the types of operational functions permitted in that designation. These would include sewer district operations as well as those primary operations governed by the Public Utilities Commission. The added section on "Unique and Special Uses" would generally cover those uses permitted by Conditional Use Permit in the Zoning Ordinance. These uses include such things as cemetaries, churches, golf courses, and accessory facilities for governmental and public utility operations (i.e., pumpstations, sub-stations, and water tanks). Changes to the Land Use Plan include the following: (1) Former KOA Site - Designation changed from "Open Space" to "Non- residential Reserve" because the area is no longer committed to open space, a requirement for "Open Space" designation in the Land Use Element. The canyon area will still be designated as "Open Space" in the Open Space and Conservation Elements. (2) Portion of Palomar Airport Business Park - Designation of a 1.8 acre area changed from "Governmental Facility" to "Planned Industrial" because this area has been purchased from the County by Cabot, Cabot, and Forbes and has been included as part of their Industrial Park. (3) CMWD Office - Designation changed from "Public Utility" to "Planned Industrial" to fit the revised description in the text. (4) Batiquitos Substation Site - Designation changed from "Public Utility" to "Medium Density Residential" becuase this site is for an accessory use as defined in the added section on "Unique and Special Uses". MZ:mdp MEMORANDUM December 10, 1975 TO: CITY COUNCIL FROM: PLANNING DEPARTMENT SUBJECT: REPORT ON LAND USE ELEMENT GOALS During the Council hearings on the Land Use Element, Councilman Skotnicki submitted a memo suggesting alternative goal statements to those contained in the proposed draft of the Element. A decision was made to adopt those goals proposed by the Goals Committee and Planning Commission to avoid delay. However, staff was instructed to forward the proposed alternative goal state- ments suggested by Councilman Skotnicki to the Planning Commission for comment and recommendation, with input from the Goals Committee, and returned to the City Council as soon as possible. Staff prepared the attached memorandum dated November 14, 1975, for considera- tion by the Goals Committee. The Committee met on November 20, 1975 to con- sider this matter. After review of Councilman Skotnickirs proposed goal state- ments for the Land Use Element, they offered the following suggestions: 1) Utilizing Councilman Skotnicki's goals and existing goal "B", replace the existing goals of the Land Use Element on Page 6 with the follow- ing: "A.., Preserve and enchance the environment, character, and image of the City as a desirable residential, beach, and open space oriented community. B. Create a pleasing and unique downtown area designed to attract the tourist and to provide the necessary amenities to the permanent residents of the area. C. Promote the economic viability of the agricultural and horticul- tural industries. D. Develop an industrial base of light, pollution free industries of such magnitude as will provide a reasonable tax base and opportunities for employment of local citizens. E. Generate the development of commercial enterprises that support local industries, population and tourist trade. F. Protect and conserve natural resources, fragile ecological areas, unigue natural assets and historically significant features of the community. G. Provide for an orderly balance of both public and private land uses within convenient and compatible locations throughout the City and ensure that all such uses — their type, amount, design and arrangement — serve to protect and enhance the environment, character and image of the City. H. Encourage development only in those areas which can best support a change in land use without adverse impact." 2) Move the second sentence of existing goal "E" to the policy section as follows: "L. Implementation of this Element shall consider the social, economic and physical impacts on the community." On November 26, 1975, the Planning Commission received Staff's analysis and the Goals Committee recommendation. After a lengthy discussion regarding how well the existing Land Use Element and goals have worked to date, the Planning Commission ratified the goals statement as already adopted in the Element. However, a minute motion was approved stating that, if the City Council wishes to amend those goals, a report back to the Planning Commission would not be necessary.
