Statement of the Matter: In January 1975 the City entered into an agree-
ment with the County of San Diego to participate in the County's 1975-6
Block Grant application for Federal Community Development funds. The City
was awarded $35,000 for restoration of the McGee House and installation
of wheelchair ramps in the downtown. Release of these funds is pending
County review of environmental documents.
The County has requested that all non -entitlement cities submit their
portions of the second year Community Development Block Grant application
by January 14, 1976. The City Council must decide whether or not to apply
for the 1976-7 funds (approximately $68,000). If the Council decides to
apply, a cooperation agreement with San Diego County must be entered into
by December 31, 1975.
The requirements for the second year grant application are outlined in
the attached memo t) the City Manager.

RECOMMENDATION: That the City Manager be authorized to sign an agreement
between the City of Carlsbad and the County of San Diego for the purpose
of making application for 2nd year Housing and Community Development
(HCD) Grant funds.

SUBJECT: 1976-1977 COMMUNITY DEVELOPMENT BLOCK GRANT
On November 13th, the Board of Supervisors authorized County Staff
to proceed with the second year application for Community Development
Block Grant funds. The Board indicated that non -entitlement cities
participating in the application should establish their own project
priorities. Allocations will be based on last year's formula,
with Carlsbad's 1976-1977 share beinq approximately $68,800.
Because of delays before the Board of Supervisors, the City will
have to work quickly to meet the County's January 14, 1976 appli-
cation deadline. Staff recommends that the City Council:
(1) Authorize the City Manager to sign a cooperation
agreement for participation in the 1976-1977
grant application;
(2) Direct staff to organize informal citizen meetings to
assist in the project selection process;
(3) Make suggestions on project priorties and request
staff to prepare a list of potential projects for
a future Council hearinq; and
(n) Direct staff to prepare a draft application for the
Council's review.
COOPERATION AGREEMENT - The County has requested that all non -entitle-
ment cities sign a cooperation agreement notifyinq the County of
their intent to participate in the application. 'The aqreement is
essentially the same as the agreement between the City and the
County for last year's application. The deadline for signing the
agreement is December 31, 1975.
APPLICATION - The City must submit the completed application and
environmental assessment to the County by January 14, 1976. Major
portions of the application include a reeds assessment and a Housing
Assistance Plan which states the City's goals for housing lower in-
come families.
PROJECT SELECTION - The stated ooal of the Community Development
Block Grant program is to "develop viable urban communities, includ-
ing decent housina and a suitable livinq environment and expanding
economic opportunities principally for persons of low and moderate
income".

development plan, provided the plan addresses the needs
and objectives identified in the CD application;

(8) Payment of reasonable administrative costs for planning
and executing community development and housing activities.
Several potential projects were identified as a partof last year's
Council hearings. In addition, some new potential projects have been
authorized by the Council within the year. The following is a list
of identified potential projects: (* identified last year)
(1)* Inner-city bicycle and pedestrian program;
(2)* Inner-city code endorcement program;
(3)* Community swimming pool;
(4)* Multipurpose community facility including child care,
housing referral, bilingual services, etc.;
(5) Improvements to St. Patrick's church building for con-
version to a Senior Center.
CITIZEN! PARTICIPATION - HUD required that all development applicants
enlist citizen participation in the project selection process. The
applicant is not bound to the recommendations of any citizen group
but is required to consider all suggested projects.
Because of time limitations, it is recommended that staff be directed
to hold an open community meeting to discuss project alternatives.
The two public hearings before the City Council can also be used
to elicit public views.
The County will be preparing an overall citizen participation plan
for the application, based on the efforts of participating agencies.
FIRST YEAR GRANT - The City was awarded approximately $35,000 for
the first year Community Development Grant. The grant provided
$10,000 for installation of handicapped ramps in the inner-city
and approximately $25,000 for renovation of the Magee House.
Environmental review documents have been prepared for Carlsbad'F
first year projects and are currently being reviewed by County
staff. Upon completion of this review, the County will petition
HUD for release funds as needed for the two projects.
The Magee House renovation will be initiated upon completion of
the architectural Dlans - probably by early Spring. No timetable
has been set for the installation of handicapped ramps.
THREE YEAR GRANT PLAN - One stipulation of the first year grant
award was that the County preDcre a grant plan which would outline
the goals and objectives over a three year period. The City will

1. It is hereby certified that the City of (hereafter
called "the City") is a unit of general government which chooses to enter
into a cooperation agreement pursuant to Federal Register Vol. 40 No. Ill
dated June 9, 1975, Section 570.3(w) (2) (ii) to undertake or to assist
in the undertaking of essential community development and housing
assistance activities. It is also certified that the City possesses
the legal authority to enter into the cooperation agreement, and to
execute the proposed program; that a resolution motion or similar
action has been duly adopted or passed as an official act of the
applicants' governing body, authorizing the filing of the application,
including all understandings and assurances contained on HUD Form 7015.12
(11-74) items 2-12, and directing and designating the City's chief
executive officer as the authorized representative of the applicant to
act in connection with the application and to provide such additional
information as may be required.
Legal Certification: As counsel for the applicant and an attorney -
at -law admitted to practice in the State in which the applicant is
located, I certify that the facts and representatives contained in
Assurance No. 1 above to be true and in accordance with State and
local law.

Assurances
It is hereby certified that the City of (hereafter
called the City) shall agree to carry out the community development
and housing activities in conformance with the County's procedures.
This responsibility shall apply to the planning and implementation of
all projects proposed by the City which are included in the County's
application pursuant to the City's ,are of the total funding. The
County's procedures which the city must act in accordance with are
as follows:
2. It will comply with:
(a) Title VI of the Civi'. Rights Act of 1964 (P.L. 88-352) and in accordance with Title Vl of thrt Act,
no person in the United States shall, on the ground of race, color, or national origin, be excluded
from participation in, be denied the benefits of, or be otherwise subjected to discrimination under
any program or activity for which the Applicant receives Federal financial assistance and will Imme-
diately take any measures necessary to effectuate this agreement. If any real property or structure
thereon is provided or improved with the aid of Federal financial assistance extended to the Appli-
cant, this assurance shall obligate the Applicant, or in the case of any transfer of such ptooerty,
any transferee, for the period during which the real property or structure is used for a purpose for
which the Federal financial assistance is extended or for another purpose involving the provision of,
similar services or benefits.
(b) Title VIII of the Civil Rights Act of 1968, (P.L. 90-284) as amended, and will administer all prorrams
and activities relating to housing and community development in a manner to affirmatively further inir
housing.
(c) Section 109 of the Housing and Community Development Act of 1974 and in conformance with all re-
quirements imposed by or pursuant to the Regulations of the Department (24 CFR Park 570.601) issued
pursuant to that Section; and in accordance with that Section, no person in the United States shall on
the ground of race, color, nationai origin or ,ex, be excluded from participation in, be denied the bene-
fits of, or be subjected to discrimination under, any program or activity funded in whole or in part with
the community development funds.
(d) Executive Order 11063 on eq-al opportunity in housing.
(e) Section 3 of the Housing and Urban Develo.nment Act of 1953, as amended requiring that to the greatest
extent feasible opportunities for training and employment be given lower income residents of the project
area and contracts for work in connection with the project be awarded to eligible business concerns
which are located in, or owned in substantial part by, persons residing in the area of the project.
3. Prior to the submission of its application, the applicant has:
(a) Provided citizens with adequate information concerning the amount of funds available for proposed
community development and housing activities, the range of activities that may be undertaken, and
other important program requirements;
(b) Held at least two public hearings to obtain the views of citizens on community development and
housing needs; and
(c) Provided citizens an adequate opportunity to participate in the development of the application and in
the development of any revisions, changes, or amendments.
4. The applicant will:
(a) Provide fair and reasonable relocation payments and assistance in accordance with Sections 202,
203, and 204, of the Uniform Relocation Assistance and Real Property Acquisition Policies Act
(P.L. 91-646) aad applicable HUD regulations, to cr for famllies, tndtviduah, partnerships, corp-
orations or asso :iations displaced as a result of any ccquisition �)r teal property assisted undo: the

(b) Provide relocation assistance programs offering the services described in Section. 205 of P.L.91-646

(c) Assure that, within a reasonable time prior to displacement, decent, safe, and sanitary replacement

origin.
S. Thy, applicant will:
(a) In zcquiring real property in connection with the community development block Grant program, be
guided to the extent permitted under State lax. by the real property acquisition policies set cut under
Section 301 of the Uniform Relocation Assistance and Real Propetty Acquisition Policies Act and the
provisions of Section 302 thereof;
(b) Pay or reimburse property owners for necessary expenses as specified in Sections 303 and 304 of the
Act; and
(c) Inform affected persons of the benefits, policies, and procedures provided for under HUD regulations:
6. It will give HUD and the Comptroller General throng's any authorized representative access to acd the
right to examine till records, books, papers, or doca=ents related to the grant.
7. The applicant will comply with the provisions of the Hatch Act which limit the political activity of
employees.
8. It will comply with the provisions of: Executive Order 11296, relating to evaluation of flood hazards, and
Executive Order 11123, relating to the prevention, control, and abatement of water pollution .
9. The applicant's certifying officer:
(a) Consents to assume the . tatus of a responsib:e Federal official under the National Envito _ rtal
Policy Act of 1969 insofar as the provisions of such act apply pursuant to this Part; and
(b) is authorized and consents on behalf of the applicant and himself to accept the jurisdiction of the
Fedeml courts for the purpose of enforcement of his responsibilities as such an official.
10.-The Community Development Program:
