Subject: CREATION OF HOUSING COMMISSION Statement of the Matter The City Council, sitting as the Housing Authority, at your December 2, 1975 meeting, directed the City Attorney to prepare an ordinance creating a Housing Commission pursuant to Section 34291 of the Government Code. The number of members, their terms of office, their quali- fications, the method of their appointment and removal, and the advisory functions of the commission have all been set out in the attached ordinance. If,the ordinance is introduced it will be before you for adoption at your meeting of January 6, 1976. It would be appropriate at that meeting to appoint the seven members to the commission, two of which must be tenants of the Authority's leased housing. If the Council concurs, the City Manager should be directed to prepare an agenda bill for the appointment of Housing Commissioners at that meeting. Exhibit Ordinance No. Recommendation If the City Council desires to form a Housing commission as outlined, your action is to introduce Ordinance No.&J_. If the Council desires to appoint members to the commission at your January 6th meeting, the Manager should be instructed • to return with the appropriate agenda bill. Council action 12-18-75 Ordinance #1189 was introduced for a first reading, establishing the Housing Commission. 1-6-76 Ordinance #1189 was given a second reading and adopted. 1 2 3 4 5 6 7 F ORDINANCE NO. 1189 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, C:LIFORNIA, AMENDING TITLE 2 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF CHAPTER 2.40 TO ESTABLISH THE HOUSING COMMISSION. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Title 2 of the Carlsbad Municipal Code is amended by the addition of Chapter 2.40 to read as follows: "Chapter 2.40 HOUSING COMMISSION Sections: 2.40.010 Established. 2.40.020 Membership. 2.40.030 Qualifications. 2.40.040 Meetings. 2.40.050 Vote required. 2.40.060 Functions. 2:40.010 Established. Pursuant to Section 34291 of the California Government Code, a Housing Commission is created as an Advisory Body to the City Council. 2.40.020 Membership. The Housing Commission shall consist of seven members. The members shall be appointed by the Mayor and confirmed by the City Council. The members shall serve two year terms and each member shall serve until his successor is duly appointed and qualified. The initial members of: the Commission shall serve staggered terms as follows: 1. Two members shall serve for a period of one year; 2. Two members shall serve for a period of 18 months; and 3. Three members shall serve for a period of two years. r 1 Members shall serve without compensation. Members of the 2 Commission may be removed by the City Council. 3 2.40.030 Qualifications. At least two members of the 4 Housing Commission shall be tenants of the Housing Authority, at 5 least one of which shall be over 62 years of age. If a tenant 6 member ceases to be a tenant of the Authority, his membership on 7 the Commission shall terminate and another tenant of the Authority 8 shall be appointed for the remainder of the unexpired term. All 9 non -tenant members of the Housing commission shall be electors 10 of the City of Carlsbad and shall be specially qualified by 11 reason of training or experience in real estate, human relations, 12 housing, urban development, building construction, social services 13 or other relevant businesses or professions to advise the Housings, c 14 Authority on the housing program. 5 8 15 2.40.040 Meetings. ,The Housing Commission shall meet 16 regularly once a month, on the fourth Monday of each month, or SoZcc o `� 17 more often if necessary, for the transaction of business. The Housing < a U 20 Commission shall elect a chairman and establish its own rules 21 and procedures necessary for the conduct of its business. 22 2.40.050 Vote required. Four members of the Housing 23 Commission shall constitute a quorum. The affirmative vote of 24 not less than four members shall be necessary for any action 25 - by the commission. 26 2.40.060 Functions. The City Council may by resolution establish specific functions for the Housing Commission."
