FUNDS FOR NORTH SAN DIEGO COC TY TRANSIT DEVELOPMENT BOARD
Statement of the Matter
At the adjourned regular meeting of December 9, 1975, Council
adopted Resolution No. 3801 which authorized the City of
Oceanside to claim funds for the operation of the North County
Transit System. It is now appropriate for the North San Diego
County Transit Development Board to claim said funds, necessitating
a new resolution and multi -party agreement.

an agreement and authorizing a revision to its local transportation
fund claim to provide an advance of funds to the newly created
North San Diego County Transit Development Board.

RESOLUTION NO. 3826
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, RESCINDING
RESOLUTION NO.3801, APPROVING AN AGREE-
MENT, AND AUTHORIZING A REVISION TO ITS
LOCAL TRANSPORTATION FUND CLAIM TO PRO-
VIDE AN ADVANCE OF FUNDS TO THE NEWLY
CREATED NORTH SAN.DIEGO COUNTY TRANSIT
DEVELOPr4ENT BOARD
WHEREAS, Chapter 1188 of the 1975 California Statutes
has created the North San Diego County Transit Development Board
with an effective date of January 1, 1976; and
WHEREAS, said legislation does not provide funding for
the Board to defray initial administrative and legal expenses of
commencing operation and during the period necessary for the
negotiation of acquisition of the Oceanside Transportation System,
which is currently the Operator of the North County Transit
System; and
WHEREAS, this Council believes said funds in the amount
of $100,000 should be provided nut of the Local Transportation F
accounts of the affected North County cities of Carlsbad,
Escondido, Oceanside, San Marcos, and Vista, and the County of
San Diego, with each entity's contribution being allocated based
upon population; and
WHEREAS, while Resolution No.3810 authorized the City of
Oceanside to claim said funds, it is now appropriate for the
North San Diego County Board to do so, directly necessitating
a new agreement.
NOW, THEREFORE, BE IT RESOLVED by the.City Council of the

City of Carlsbad, as follows,;
1. That the above recitations are true and correct.
2. That the North San Diego County Transit Development
Board should be advanced.the sum of $100,000 as soon as possible
after January 1, 1976, from the LTF accounts of the North County
cities of Carlsbad, Escondido, Oceanside, San Marcos, and Vista,
and the County of San Diego.
3. That the amount advanced from each entity should be
the same percentage of the total amount ($100,000) as each
entity's population bears to the total population of the area to
be served by the said Board as follows:

4. That that certain
multiparty
contract
between the
City
of Carlsbad and the
other participating
jurisdictions to

is attached
hereto as Exr.Lbit A, and

approved.

authorized and directed to execute said contract for and on
behalf of the City of Carlsbad.
6. That this Council hereby urges the other affected
entities in North San Diego County to immediately so authorize
their fair shares to be advanced to said Board.
7. That Resolution No. 3801 is rescinded.
PASSED, APPROVED AND ADOPTED at an adjourned meeting of
the City Council of the City of Carlsbad, California, held on the
13th day of January , 1976, by the following vote,
to wit:

EXHIBITA
LOCAL TRANSPORTATION FUND
MULTI -PARTY CONTRACT
WHEREAS, Chapter 1188 of the 1975 California Statutes has created the
North San Diego County Transit Development Board effective January 1, 1976;
and
WHEREAS, said legislation does not provide funding for the Board to
defray initial administrative and legal expenses associated with an inde-
terminate period necessary to negotiate the acquisition of the Oceanside
Transportation System; and
WHEREAS, the affected North County cities and communities believe
$100,000 should be provided from the Local Transportation Fund with each
entity's contribution being based on population;
.NOW THEREFORE, the cities of Escondido, Vista, Carlsbad, Oceanside and
San Marcos, and the County of San Diego, do hereby agree as follows:
1. Based on the following estimates of indl�.vidual jurisdictional popu-
lation, the parties agree to allocate the following amounts of money from the
Local Transportation Fund:

2. The North San Diego County Transit
Development Board
agrees and is
hereby
authorized by all
parties to this
agreement to claim
the above funds

$100,000. Said funds
to be utilized
for the purpose of
implementing the

San Diego County Transit Development
Board consistent
with provisions
of
Chapter 1.188 of the California Statutes
creating said Board.
This claim
is
needed due to changing financial. circumstances
as a result
of the new in-
stitutional
arrangements
outlined in the
subject legislation.

3. The North San Diego County Transit Development Board is hereby
authorized to expend these funds to pay administrative and legal costs
incurred by said Board on or after January 1, 1976.
