J Subject: SELECTION OF -MAGEE HOUSE ARCHITECT ~ ~~ Statement of the Matter The City Council at your meeting of December16, 1976, directed the City Attorney to prepare the necessary documents to retain Edward S. Ebright, of Environmental Design, Planning & Graphics, as the Designer for the restoration of the Magee House. The agreement for that purpose and the resolution approving said agreement are attached. Resolution No. 3Bdo 5 with Agreement Recommendation If the Council desires to approve said agreement, your action is to approve Resolution No. 3f,3d Council Action 1-20-76 Resolution No, 3830, approving an agreement between the City and Edward S. EBRIGHT FOR DESIGN SERVICES RELATIVE TO RESTORATION OF THE PAGEE HOUSE AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT. - The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That that certain agreement between the City of Carlsbad and Edward S. Ebright for design services relative to the restoration of the Magee House, a copy of which is attached hereto marked Exhibit "A" and made a part hereof, is hereby approved. 2. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute said agreement for andon behalf of the City of Carlsbad. FRAZEE, Mayor AGREEMENT EXHIBIT "A" to RESOLUTION NO. 3830 DESIGN SERVICES FOR MAGEE HOUSE THIS AGREEMENT is made and entered into by and between the CITY OF CARLSBAD, hereinafter referred to as "City", and EDWARD S. EBRIGHT, hereinafter refprred to as "Designer" ; both of whom understand as follows: RE C I T A L S: City contemplates the reconstruction and renovation of a residence known as The Magee House located in the City of Carlsbad; and City has budgeted the funds to finance the project; and city desires ts ernploy the services of Desiqner for pian- ning studies, preparation of preliminary plans and preliminary costs estimates and preparation working drawings and specifications for said project. AGREEMENT: 1. General. In accord. with Designer's proposal, City engages Designer to furnish the services hereinafter mentioned, at and for the compen- sation herein stipulated, and Designer accepts said engagement upon said terms. 2. Definition. For the purposes of this agreement the following definitions are accepted and approved by the parties hereto: a. "Preliminary Plans": Drawings or prints thereof, prepared by the Designer for approval by the City prior to preparation of working drawings and specifications and consisting of floor plans and elevations, perspective c drawings e in color ' and other drawings necessary to illustrate the work to be done in the preparation of working drawings. b. "Working Drawings and Specifications": Working drawings and specifications shall consist of the complete and accurate set of architectural, structural, engineering, mechanical, electrical and plumbing drawings fully dimensioned and noted, which clearly indicate all parts of the work and detailed specifications required to complete the entire improvements, complete with all services and appurtenant improvements, including, but not necessarily limited to, the general plot plan, utility plan, exterior lighting, concrete work, carpentry, plastering, heating, ventilating, electrical, plumbing, painting, roofing, tile work and hardware. 3. Duties of Designer. The Designer shall: a. Attend necessary conferences with the City Manager, City Engineer, and City Parks and Recreation Director to accom- plish the planning and preliminary studies of the project. Prepare preliminary plans and preliminary cost estimates and present the same to the City for approval. Furnish and deliver to City detailed specifications of all construction itemized in paragraph 2(b). Designer shall furnish one copy of said detailed specifications which is capable of being easily reproduced. Furnish and deliver to City cost estLmates based upon the completed plans and specifications and broken down under the items of construction itemized in paragraph 2(b). Furnish complete supervision services during construction consisting of periodic inspection visits as required by the work, said visits shall consist of not less than three (3) visits per week, each not less than one (1) hour, keeping the City informed as to the progress of construction, examining contractors applications for payment, issuing certificates for progress and final payment. 4. Data and Services to be provided by City. The following data and services will be furnished without cost ' to Designer by City: a.. All necessary field survey notes for design purposes. b. Records and maps available in City's files or any other such 3. information to aid Designer in his studies for success- ful planning and designing of txe project. - c. Sample forms of agreement, performance bond, labor and material bond, proposal, and general conditions all of which shall be revised as necessary by the Designer and incorporated in the specifications. 5. Payments by City. City shall pay Designer for all services rendered under the provisions of this contract at the rate of $10.50 per hour. Designer will render bi-monthly statements of services rendered which shall be paid upon approval of City. Estimated hours necessary to complete the duties of Designer are as follows: Services required under paragraphs 3(a) and (b) 62 hours. Services required under paragraphs 3:c: I (2) I (e! and (f) 120 hours. Services required under paragraphs 3 (9) , (h) and (i) 20 hours. Designer shall not exceed the above estimates without prior approval of City. In no event shall total compensation of Designer exceed the sum of $2,200.00. 6. Designer agrees to complete and deliver the services required under paragraphs 3 (a) through 3 (f) on or before the expiration of forty-five (45) calendar days from the date hereof. 7. All original drawings, plans, specifications and design notes shall become the property of the City. The design notes may be photostatic copies of the originals. All original drawings are to be made on tracing paper with pencil or pen. 4. A 8. 9. The plans and specifications shall bear the name of Designer together with his certificate number. 0. Standard specifications of the City shall be referred to and incorporated into the detailed specifications, insofar as the same may apply. 10. City reserves the right to terminate the agreement at any time by written notice to the Designer. In the event the City terminates . this agreement, it shall reimburse the Designer a portion of his fee based on the City Engine.er's estimate of work done and its estimated value.
