Statement of the Matter
At the January 6, 1976 Council meeting, Council requested that staff
prepare the necessary documents indicating their intention to join
with other local governments in the planning process for the 208 area.

it is recommended that City Council adopt Resolution No.��, indicating

OF CARLSBAD, CALIFORNIA, INDICATING THE INTENT
3 OF THE CITY OF CARLSBAD TO JOIN WITH OTHER
GENERAL AND SPECIAL PURPOSE UNITS OF LOCAL
4 GOVERNMENT IN A PLANNING PROCESS FOR A COOR-
DINATED WASTE TREATMENT 14ANAGEMENT SYSTEM FOR
5 THE SAN DIEGO REGION

WHEREAS, pursuant to Section 208 of the Federal Water Pollutio

Control Act Amendments of 1972, PL 92-500 (hereinafter called "the
8
Act"), the Administratoz of the United States Environmental Protec-
5

tion Agency has by regulation published guidelines for the identi-
10
fication of those areas which, as a result of urban -industrial
11
concentrations or other factors, have or are likely to have, water
12
quality control problems (40 OFR Part 126); and
13
WHEREAS, the San Diego area (hereinafter called "the Area")
14
satisfies the criteria contained in the Act and guidelines for
15
it designation of the area pursuant to Section 208; and
16
WHEREAS, Section 126.10 of.the guidelines requires, among
17
other things, that the affected general and special purpose units
18
of local government within the area must show their intent to join
19
together in a planning process which will result in a coordinated
20
waste treatment management system for the Area; and
21
WHEREAS, such planning process and waste treatment management
22
system is a necessary and significant measure to control present

as well as future sources of water pollution which may affect water

quality, in order to prevent, abate and solve existing and potentia
water quality control problems;,

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
27
City of Carlsbad as follows%

1. That the City of Carlsbad recognizes that the San Diego

1 area has, or is likely to have, water quality control problems,
2 supports designation of the Area pursuant to Section 208 and the'
3 EPA guidelines.
4 2. That the City of Carlsbad intends to join with other
5 affected general and special purpose units of local government
g within the boundaries of the area in a planning process which will
7 result in a coordinated waste treatment management system for
8 the Area.
9 3. That, inasmuch as the Comprehensive Planning Organization
10 (CPO) is a single representative organization with elected offic'iai
11 or their_ designees from local governments.and is capable of coor-
12 dinating effective areawide waste treatment management planning
13 for the Area, the City of Carlsbad supports the designation of
14' CPO as the planning agency for. the Area.
15 4. That the City of Carlsbad reserves the right to determine
16 the amount of non -reimbursable staff involvement in the planning
17I process.
18 5. That the 208 waste treatment planning program should not
19 duplicate, or conflict with, the State Basin Plan (Sac. 303e) or
20 existing local wastewater facilities plans (Sec. 201).
21 PASSED, APPROVED AND ADOPTED at a regular meeting of the City Counc 1;

22 of the City of Carlsbad held the ZOth day of JanUary , 1976, by
23 the following veto, to wit:
24 AYES: Councilmen Frazee, Chase, Lewis, Skotnicki and Councilwoman
Casler.
25 NOES; None.
26 ABSENT: None.
