Statement of the Matter
La Costa Land Company, the owners of all the real property subdivided
by Map Uo. 7784, have petitioned for its reversion to acreage and
submitted a final map for that purpose. The City Engineer advises
that the Planning, Fire, and Parks and Recreation Department, Carlsbad
Municipal Water District, Leucadia County Water District, San Diego
County Flood Control District, San Diego Gas & Electric Company, and
Pacific Telephone Company have been requested to comment on the pro-
posed action. No objections were received.
A public hearing has been duly noticed as required by State law.

NOTICE OF PUBLIC HEARING
RE: REVERSION TO ACREAGE
NOTICE IS HEREBY GIVEN that the City Council of the
City of Carlsbad will hold a Public Hearing on Tuesday,
February 17, 1976 at 7:00 P.M., in the Council Chambers,
1200 Elm Avenue, Carlsbad, California to consider a request
for reversion to acreage of that real property shown on Map
No. 7784 (Carlsbad Tract 72-25), located along Alicante Road
and Alfil Way and more particularly described as:
Portions of Sections 15 and 36, Township
12 South, Range 4 West, San Bernardino
Meridian, in the City of Carlsbad, County
of San Diego, State of California according
to official plat thereof.

MEMORANDUM
TO: City Manager

SUBJECT: CT 72-25 Reversion to Acreage
This reversion map process will nullify the lots created for
Alicante Hills (CT 72-25) . This action is a condition of
City Council Resolution No. 3771, approving a resubdivision
(CT 75-6) of the original real property. The boundaries of
the present recorded map (No. 7784.) for CT 72-25, and the
subject reversion map are identical. Open space easements
will be quitclaimed by this map, but they will be rededicated
as conditioned in Planning Commission Resolution No. 1187
approving the resubdivision.
A final accounting and close out of CT 72-25 (Alicante Kills)
has been made as stipulated by Council Agenda Bill Number 2015,
Supplement No. 2.
We recommend the release of Park in Lieu fees that were required
as a condition of recordation of the original subdivision map.
The agenda bill reflects this recommendation. Park fees for this
project are $38,399.04 and in account 65-26-07.

RESOLUTION NO. 3850
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A FINAL
MAP TO REVERT TO ACREAGE, MAP NO. 7784, CARLS-
BAD TRACT (CT 72-25) GENERALLY LOCATED ALONG
ALICANTE ROAD AND ALFIL WAY KNOWN AS ALICANTE
HILLS.
APPLICANT; LA COSTA LAND COMPANY.
WHEREAS, the City Council has approved a subdivision (CT 72-
25) known as Alicante Hills, which has been finaled and recorded
as Map No. 7784; and
WHEREAS, all the owners of the subject property have peti-
tioned the City Council to revert the subdivision to acreage in
accord with the provisions of Chapter 20.40 qf the Carlsbad Muni-
cipal Code and the Subdivision Map Act; and
WHEREAS, a duly noticed public hearing has been held in
accord with law on the 17th day of February, 1976; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the City Council finds that the dedications, or
offers of dedications, to be vacated or abandoned, by the reversion
to acreage of CT 72-25, Final Map No. 7784, are unnecessary for
present or prospective public purposes.
3. That all owners of an interest in the real property with-
in the subject subdivision have consented to the reversion.
4. That the Final Map for the reversion to acreage of the
subdivision known as Alicante Hills, (CT 72-25), Map No. 7784, is
hereby approved.
5. That the Finance Director is directed to return the
Park fees in the amount of $38,399.04.
