Extension of Moratorium
Statement of the Matter
At the meeting of March 16, 1976, the City Council continued
Agenda Bill 3513, Supplement No. 1 to an adjourned meeting
on March 30, 1976.
Council instructed the City Attorney to prepare a revised
ordinance extending the moratorium subject to certain
exceptions.

ORDINANCE NO. 9454
AN INTERIM ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
ADOPTED AS AN URGENCY MEASURE EXTENDING
WITH CERTAIN EXCEPTIONS ORDINANCE NO.9445
PROHIBITING THE PROCESSING OR APPROVAL
OF MASTER PLANS OR SPECIFIC PLANS FOR
PROPERTY ZONED PLANNED COMMUNITY (P-C).
WHEREAS, the Planning Department upon direction by the
City Council has undertaken a comprehensive review of the P-C,
Planned Community Zone, has prepared a revision of said zone;
and
WHEREAS, the City Council determined that it was necessary
in order to protect the public safety, health and welfare to
adopt as an urgency measure an interim Ordinance No. 9445
prohibiting further processing or approval of Master Plans or
Specific Plans for property in the P-C zone to avoid conflict
with the contemplated revision to the zone.
WHEREAS, after public hearing, held in accord with
Section 65856 of the Government Code, the City Council has
determined pursuant to Section 65858 of said code that it is
necessary to extend with certain exceptions Ordinance 9445 for
four months to allow the ongoing revisions of the P-C zone to
be completed.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Carlsbad, California, as follows:
SECTION 1: That Ordinance No. 9445, prohibiting all
processing and approval of Specific Plans and Master Plans in
that area of the City of Carlsbad zoned P-C, Planned Community,

is hereby extended except as follows:
a. Processing and approval of specific plans in a
planned community where the master planned
development is at least 75% complete may be allowed;
b. Processing and approval of specific plans that are
consistent with the master plan and provide for
exclusively single family detached dwellings to be
constructed to the minimum standards applicable to
development in the R-l zone may be allowed;
c. Processing and approval of revisions to existing
master plans may be allowed subject to amendment
as the City Council determines necessary to ensure
consistency with such revisions to the P-C zone as
the Council may adopt.
SECTION 2: This ordinance shall expire and be of no
further force and effect on August 1, 1976.
SECTION 3: This ordinance shall be read once and shall
take effect immediately.
SECTION 3: The City Clerk shall certify to the adoption
of this ordinance and cause it to be published at least once
in the Carlsbad Journal within fifteen days after its adoption.
