Statement of the Matter
On January 21, 1975, the City Council by Resolution No. 3576 approved
the tentative map of Carlsbad Tract CT 72-38. The applicant has
requested that the subject tentative map be extended for a period of
one year to January 21, 1977.
The City Engineer advises that the Planning, Building and Fire Depart-
ments have been contacted to determine if they have any objections to
the extension of the tentative map. Having received no objections it
is recommended that the City Council approve the extension of the tent-
ative map subject to the execution and/or fulfillment of all the condi-
tions of Resolution No. 3576 and Resolution No. .

RESOLUTION NO. 3576
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE MAP (CT 72-38)
TO ALLOW A TWO-LOT CONDOMINIUM SUBDIVISION
ON 1.3 ACRES LOCATED ON THE EAST SIDE OF
CARLSBAD BOULEVARD BETWEEN TAMARACK AVENUE
AND ONE LOT SOUTH OF SEQUOIA AVENUE.

WHEREAS, on December 10, 1974, the Carlsbad City Planning
Commission adopted Resolution No. 1121 recommending to the City
Council that Tentative Map (CT 72-38) be conditionally approved;
and
WHEREAS, the City Council of the City of Carlsbad, on
January 7, 1975, considered the recommendation of the Planning
Commission; and
WHEREAS, an Environmental Impact Report was certified
as complete for a previously issued entitlement for this project,
and the Planning Director has found the Tentative Map (CT 72-38)
to be in prior compliance with the City of Carlsbad Environmental
Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 72-38) is hereby approved sub-
'ject to all applicable requirements of the Carlsbad Municipal
Code and to the satisfaction of the following conditions:
1. The final map shall be submitted for approval
within one year from the final action by the City Council
on the tentative subdivision map. The final map shall
be in substantial conformance with the Tentative Subdi-
vision Map known as Exhibit A, dated November 4, 1974,
on file in the Carlsbad City Planning Department.
2. The development of the property described herein
shall be subject to the restrictions and limitations set
forth herein which are in addition to all the requirements
limitations and restrictions of all municipal ordinance
and state and federal statutes now in force, or which here
after may be in force for the purpose of preserving the
residential characteristics of adjacent properties.

3. All public improvements shall be made in conformit
with the City of Carlsbad Engineering Design Criteria
and Standard Plans, the Subdivision Ordinance and other
City standards, to the satisfaction of the City Engineer,
without cost to the City of Carlsbad, and free of all
liens and encumbrances. Improvement plans for water and
sewer systems shall meet the requirements of the respec-
tive service districts.
4. All land and/or easements required by this ordi-
nance shall be granted to the City of Carlsbad without
cost to the City and free of all liens and encumbrances.
No easements shall be recorded prior to approval of the
final map unless approved by the City Engineer.
5. All utilities, including provisions for cable
TV, shall be placed underground and/or shall be completely
concealed from view.
6. Ornamental street lighting shall be provided for
as required by Municipal Code. The developer shall post
a bond and/or cash in the amount necessary to energize
said street lights for an 18-month period after construc-
tion to permit the incorporation of the subdivision into
a maintenance district. This shall be done prior to
approval of the final map.
7. The improvement plans shall include a report of
a geological investigation and a complete grading plan
of the entire site when required by the City Engineer.
The report and plan shall be prepared by civil engineers
licensed by the State of California and experienced in
erosion control. Said engineers shall certify that they
have investigated the site and prepared data with full
consideration of the consequences to the included and
neighboring properties.
8. All slopes created as a result of this development
shall not exceed a 2:1 slope.
9. Ingress and egress along the property line border-
ing public street right-of-way for all lots shall be
dedicated, except at locations as specified by the City
Engineer. Dedication shall be made prior to approval of
the final map.
10. If requested by the City Engineer, an amended
Tentative Map shall be submitted for approval by the
City Engineer prior to preparation of the final map to
assure compliance with all conditions of approval.
11. In order to provide for reasonable fire protec-
tion during the construction period, the subdivider shall
maintain passable vehicular access to all buildings and
adequate fire hydrants with required fire flows, and dry-
stand pipes shall be installed prior to framing construc-
tion.
12. Park-in-lieu fees shall be granted to the City
concurrent with City Council approval of the final map.
13. Street trees, when required by the City, shall
be installed by the applicant at his expense. Trees shall

be of a type approved by the Parks Department and shall
be installed to their specifications. If removal of any
existing trees is required by the City, said removal shall
be at the applicant's expense. It shall be the respon-
sibility of the applicant to make all arrangements with
the Parks Department concerning the requirements of this
condition. These arrangements are to be made prior to
approval of the final map.
14. The CC&R's for this development shall be submit-
ted to the Planning Director for review and approval prior
to the approval of the final map.
15. Prior to approval of the final map by the City
Council a revised tentative map shall be submitted
showing Sequoia Avenue as a through street. The appli-
cant shall be responsible for the dedication of five feet
on both sides of Sequoia Avenue, and shall be responsible
for full street improvements within the public right-of-
way.
16. The applicant shall offer to the City an Open
Space easement for public access and recreation purposes
over the western half of Lot 2 (comprising an area of
60 feet by 100 feet) concurrent with City Council approval
of the final map. This Open Space easement shall be
improved according to the plan labeled Exhibit B, dated
November 4, 1974.
17. The applicant shall execute a future agreement
to install complete half-street improvements to Carlsbad
Boulevard along subdivision frontage. This shall be ac-
complished prior to final map approval.
C. That said Tentative Map, together with the provisions
for its design and improvement and subject to the above conditions,
is consistent with all applicable general and specific plans of
the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 21st day of January , 1975,
by the following vote, to wit:

DITIONS AN EXTENSION OF TENTATIVE MAP (CT72-38).
WHEREAS, the City Council of the City of Carlsbad, on
the 21st day of January, 1975 adopted Resolution No. 3576 approving
with conditions Tentative Map ( CT 72-38); and
WHEREAS, the subdivider has requested a one-year exten-
sion of such map from January 21, 1976 to January 21, 1977; and
WHEREAS, the City Council has determined to extend such
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That Tentative Map (CT 72-38) is hereby extended,
subject to the execution and/or fulfillment of all the conditions
of Resolution No. 3576.
C. That said tentative map extension together with the
provisions for its design and improvement and subject to the above
conditions, is consistent with all applicable general and specific
plans of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
