I t I I V I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 RESOLUTION NO. 3875 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA SPECIFYING THE GENERAL PRE- VAILING WAGE RATES AS REQUIRED IN PUBLIC WORKS PROJECTS WHEREAS, Section 1773 of the Labor Code of the State of California requires that the general prevailing rate of per diem wages and the general prevailing rates for legal holiday and over- time work in the locality in which a contract for public work is to be performed for each craft, classification or type of workman needed to execute the contract shall be specified in the call for bids for the contract and in the bid specifications and in the con- tract itself; and WHEREAS, section 1773 has been amended to provide that in lieu of specifying the prevailing wage rates in such call for bids the awarding body may refer to copies thereof at its principal office; and 17 WHEREAS, the provisions of Section 1773 of the Labor Code 18 of the State of California provide that where the awarding body 19 chooses to refer to a copy of the prevailing wage rate on file at 20 its principal office in lieu of specifying them in each call for 21 bids, the awarding body shall publish its determination of the 22 prevailing wage rates in a newspaper of general circulation at 23 least one time during each year, and, if there is any change in the 24 prevailing wage rates during the course of any year, the awarding 25 body shall specify the changes in the first call for bids made by 26 the awarding body therafter; and 27 WHEREAS, the City of Carlsbad has compiled a schedule of 28 the prevailing wage rate in this area for each craft, classification 29 or type of workman needed to execute contracts for public works; an 30 WHEREAS, a copy of the said schedule, marked Exhibit "A", 31 is attached hereto and incorporated herein by reference thereto; an 32 I 1 WHEREAS, the City Council of the City of Carlsbad, having 2 heard the testimony of the City Engineer and having reviewed the said schedule determining that the rate of per diem wages and the 4 general prevailing rates for legal holiday and overtime work for 5 each craft, classification or type of workman needed to execute 6 contracts for public works set forth in the said schedule is the 7 prevailing wage rate for each craft, classification or type of 8 workman needed to execute contracts for public works in this area; 9 NOW, THEREFORE, BE IT RESOLVED by the City Council of the 10 City of Carlsbad that the schedule of prevailing rate of per diem 11 ages and the general prevailing rates for legal holiday and over- 12 time work for each craft, classification or type of workman needed 13 to execute contracts for public works is that set forth in Exhibit 14 "A", attached hereto and incorporated'herein by reference thereto; 15 BE IT FURTHER RESOLVED that, in lieu of specifying the 16 said prevailing wage rates in each call for bids, the City of Carls- 17 bad shall refer to a copy of the said prevailing wage rates on file 18 with the City Clerk of the City of Carlsbad. 19 BE IT FURTHER RESOLVED that, if there is any change in the 20 said prevailing wags rates furing the course of the year, the City 21 of Carlsbad shall specify such changes in its first call for bids 22 and any bid call published thereafter; 23 BE IT FURTHER RESOLVED that any contractor whose bid upon �4 a contract for public works awarded by the City of Carlsbad is 25 accepted shall be directed to post a copy of the determination of 26 the prevailing rate of per diem wages and the general prevailing 27 rates for legal holiday and overtime work made by the City Council 28 of the City of Carlsbad at each jobsite; 29 BE IT FURTHER RESOLVED that the City Clerk is,directed to 30 cause the publication of this resolution in the Carlsbad Journal, 31 a newspaper of general :irculation published in the said City of 32 ICarlsbad. -2- �_l t 11 PASSED, APPROVED AND ADOPTED at a regular meeting of the 2lCity Council of the City of Carlsbad, California,. this, 6th da•c of j 3 April , 1976, by the following vote, to wit: 4 4 AYES: Councilmen Frazee, Lewis, Skotnicki and Councilwoman Casler 5 NOES: None 6 ABSENT: Councilman Packard- 7 8 ROBERT C.
