Statement of the Matter The City Council, at your meeting of April 27, 1976, directed the City Attorney to prepare the necessary documents approv- ing Tentative Map (CT 76-1) . The resolution approving the Tentative Map is attached. Exhibit Resolution No. 32 J7 approving Tentative Map (CT 76-1). APPLICANT: MARVIN HUMPHREYS. WHEREAS, on Ma^h 24, 1976, the Carlsbad City Planning Commission adopted Resolution No. 1225 recommending to the City Council that Tentative Map (CT 76-1) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on April 27, 1976, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That said Tentative Map, together with the provisions for its design and improvement and subject to the conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. C. D. That Tentative Map (CT 76-1) is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated February 6, 1976. The Final Map shall be submitted within eighteen months from the date of final action by the City Council on the Tentative Subdivision Map. The Final Map shall be in substantial conformance with the Tentative Subdivision Map, Exhibit A. 2. Park-in-lieu fees shall be granted to the City of Carlsbad prior to City Council approval of the Final Map. 3. Prior to City Council approval of the Final Map, the applicant shall formally request withdrawal of ZC-113 and SP-113 by letter to the Secretary of the Planning Commission. 4. Chestnut Avenue shall be dedicated and improved on the basis .of a 68-foot street section. Improvements shall be for a half street section according to City of Carlsbad standards. ' 5. Monroe Avenue shall be improved on the basis of a 30-foot half street section according to City of Carlsbad standards. .' 6. The shed located on the proposed lot line between . Lots 4 and 5 shall be removed. The cost of such removal shall be included in the security .for improvement if removal is not accomplished prior to final map approval. 7. In order to provide for reasonable fire protection during the construction period*, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 8. Ornamental street lighting shall be provided for as required by the Municipal Code. All land and/or easements required shall be granted to the City of Carlsbad without cost to the City, and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the Final Map unless approved by the City Engineer.
