Statement of the Matter The City of Carlsbad is presently operating under the provisions the 1971 Edition of the National Electrical Code. The 1975 Edition of the National Electrical Code has been.promulgated and it is now appropriate for the City of Carlsbad to take the steps necessary to adopt it for use in our City. F series of amendments has been prepared by the local chapter of Building Directors and has been reviewed by the Advisory and Appeals Board of the City of Carlsbad and the other jurisdictions in San Diego County. Exhibit Ordinance No. Wb "' adopting the 1975 Edition of the National Electrical Code. Recommendation The Building Department recommends the adoption of the 1975 Edition of the National Electrical Code and the proposed amendments. The City Attorney recommends that if the Council concurs, your action is to read the title of the attached ordinance and then by motion set a public hearing to consider its adoption. The hearing should be set at least 15 days from the date of this meeting. The City Clerk should be directed to publish the required notices containing the statement that copies of the ordinance adopting the code and the code are on file with the clerk and available to the public. Notice should also contain a description of the purposes and subject of the ordinance and the code. (a) The previsions contained in this section shall apply to all existing or relocated buildings when. deemed inade- quate or unsafe by the administrative authority. electrical (b) Relocated buildings - All electric wiring, devices and equipment in relocated buildings shall comply with all the provisions of this code for new installations. l (c) Additions to or alterations in old wiring shall be made in compliance, with the provisions of this section. L (d) Outlets added -to existing branch circuits, including existing outlets, shall be rated at not less than 1-1/2 amperes each. When deemed necessary by the administrative authority, a test plug may be required to be drawn through each run of conduit in the presence of an inspector. 18.12.215 Temporary meter sets. A temporary meter may be. set on the permanent electrical service base for testing equipment lighting of interiors where outside sources do not light, health and safety and protection of persons. However, failure to pro- vide and comply with all provisions of this ordinar_ce shall constitute grounds foz the removal of any or all meters on the prof ct. SECTION 2: Title 18, Chapter 18.12 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.12.220 and 18.12.225 to read as follows: "18.12.220 Cost of permit. *Every applicant for a permit shall pay for each permit issued at the time of issuance a fee in accordance with the following schedule, and the rate provided for each classification shown herein. Any person who shall commence any work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted ,to obtain a permit, pay double the permit fee fixed by this section for such work, pro- vided, however, that this provision shall not apply to emergency .work when it shall be proved to the satisfaction of the adminis- trative authority that such work was urgently necessary and that it was not practical to obtain a permit therefor before the com- mencement of the work. In all such cases a permit must be ob- tained as soon a.j it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not less than $5.00 nor more than $500, or by imprisonment in the County Jail for not to exceed six months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violations of this code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. The issuance or granting of a permit or approval of plans shall not prevent the administrative authority from thereafter requiring the correction of errors in said plans and specifica- tions or from preventing construction operations being carried on thereunder when in violations of this code or of any other ordi- nance or from,revoking any Certificate of Approval when issued in error." SECTION 3: That Title 18, Chapter. 18.12 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.12.230, 18.12.235, 18.12.240 and 18.12.245 to read as follows: 1118.12.230 Section 215-5 amended -- Diagrams of Feeders. Section 215-5 of the National Electrical Code is hereby amended by the addition of the following:'All horizontal'feeders in multiple occupancy, combustible frame dwellings shall be installed underground or outside the building unless otherwise approved by the Administrative Authority. A duplex is not considered a multiple occupancy in this instance.' 18.12.235 Section 220-3 amended -- Branch Circuits Required. Section 220-3 of the National Electrical Code is hereby amended by the addition of subsection (e) to read as follows: 'Each appliance branch circuit shall be limited to two duplex receptacles above counter area and within six feet of serviceable counter area. Section 336-3(c) of the National Electrical Code is hereby amended by the addition of the following: '(9) In commercial or industrial buildings, including hotels and motels. (10) In multiple occupancy dwellings of other than wood frame construction."' SECTION 4: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code is amended by the deletion of Sections 18.12.236 and Sections 18.12.250 through 1$.12.29;0 inclusive. SECTION 5: If for any reason any section, subsection, sentence, clause, or phrase of this ordinance shall be held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Carlsbad hereby declares that it would have passed this ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared uncon- stitutional. If any provision of this ordinance or application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. 4. AD S � City Clerk ( SEAL) 5. r NOTICE OF PUBLIC HEARING RE: ADOPTION BY REFERENCE OF THE 1975 EDITION OF THE NATIONAL ELECTRICAL CODE NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a Public Hearing on June 1, 1976 in the City Council Chambers, 1200 Elm Avenue, Carlsbad, California at 7:00 P.M. to consider adoption of Ordinance No. 8069, which amends Title 18, Chapter 18.12 of the Carlsbad Municipal Code by the Amendment of Section 18.12.0110, and Sec- tions 18.12.205'Ahrough 18.12.245 inclusive and by the deletion of Section 18.12.236 and of Sections 18.1.2.250 through 18.12.290 inclusive to adopt by reference the 1975 edition of the National Electrical Code subject to certain amendments.
