CITY OWNED PROPERTY
Statement of the Matter
Sometime ago the City Council approved selling a portion
of a City owned lot on Elm Avenue adjoining the Fire Station
parking lot, to a developer. The project did not materialize
and, or course, the lot was not sold.
Another developer has purchased the property adjoining the
City lot and is asking that the City Council (1) grant an
easement for access through the eastern portion of City lot,
(2) enter into a parking agreement on City property (9 park-
ing spaces), and (3) cooperate in landscaping a planter strip
along the City owner property.
This developer has shown staff a rendering of this proposed
building. In order to provide easier access and additional
portion or all of the City lot.

Recommendation
At this time, the Staff recommends the request be denied.
Previously, the City Council authorized negotiations with
Mr. Ellsworth for the use of the City property in question.
It was the Staff's understanding that this authorization was
based on the Council's desire to encourage the specific uses
and building design that were intended for the lot. The new
design is considerably different than that proposed by Mr.
Ellsworth.

Re: Access and Development of Elm Street Property East of Fire Station
Dear Mr. Bmssey:
After our initial discussion on the proposed use of the subject property, I would like to formally ask the City to consider the following proposal: (Refer to encl osed plat map)
1. Grant an easement for access through the Eastern portion of City owned strip.
Cooperate in landscaping a planter strip from our property along Elm frontage to fire station. We are willing to partici- pate in this landscaping as consideration for access and parking.
2. Einter a parking agreement on City property (9 parking spaces).

The access will provide access for the City property as well and landscaping will certainly be of benefit to the City as well as to our building.
The other item we discussed was the rezoning of the property versus amending the specific plan that now applies to the property. Upon the recommendation
of your planning department and discussion with you, I plan to file an application for O.P. zoning which I’ve been told is consistent with the existing General Plan designation for the area.
