CITY OF CARLSBAD 3611 Supplement #2 ---------------- DATE: May 18, 1976 --------------------- DEPARTMENT: City Manager ------------------ Subject: ELM AVENUE EXTENSION Statement of the Matter Initial: Dept.Hd.t~ c. Atty. VE!!:, C. Mgr. j~ The Council has previously given its consent to purchase property at Valley and Elm to allow the widening of Elm to Monroe. The City had an agreement at a price of $14,800.00~ Subsequently, the sellers refused to sign the escrow instructions at this price. Staff began new negotiations and the sellers have now agreed to sell for $16,500.00. Staff feels that this price is still under the cost of condemnation by approximately $2,500.00. Staff has made as a condition of the purchase that the sellers deposit signed escrow instructions at the price of $16,500.00 in escrow before the City signs the amended escrow instructions. · While staff is of the opinion that the negotiated price of $16,500.00 is realistic, if the sellers do not immediately complete the sale, then Council should proceed with condemnation proceedings at once as further delay will cause an unnecessary increase in the total cost of the Elm Avenue extension. (Wall Exhibit) Recommendation That Council authorize the Mayor to sign amended escrow instructions upon notification by the escrow ho1der that the seller has deposited signed escrow instructions at the renegotiated price of $16,500.00. Further, that if signatures are not obtained by May 25, 1976, that staff be instructed to prepare the nec.essary documents to begin condemnation proceedings for the June 1, 1976 Council meeting.
