The City of Carlsbad leases from San Diego Gas and Electric two beach parcels as shown on the attached exhibit. The original term of these leases was 8 1/2 years which expired March 31, 1972, and is now. on a year to year lease which may be cancelled by either party upon sixty day's notice. The cost of this lease is $1.00 per year. San Diego Gas and Electric by letter has asked if the City would have any objections to relinguishing these leases and allowing San Diego Gas and Electric to negotiate for their operation and maintenance by the State Division of Parks and Beaches. The City staff has been in the process of negotiating a longer term lease for these parcels. These negotiations were being conducted in conjunction with San Diego Gas and Electric's obligation for improvements on Carlsbad Boulevard. Their obligation for street improvements does not extend to public beaches. Exhibit Map showing location of beach areas. Letter from San Diego Gas and Electric dated April 22, 1976. Recommendation The staff recommends that the Council.indicate to San Diego Gas "" and Electric their concurrence that the entire beach area should be maintained by the State Park and Beach Department with the understanding that the nature of the final agreement between the State and San Diego Gas and Electric would determine whether San Diego Gas and Electric had met its street improvement obligations for Carlsbad Boulevard. . • .Council action 5-l'8-76 The Council accepted staff recommendation. LNG 100 Mr. Paul Bussey City Manager City of Carlsbad 1200 Elm Avenue Carlsbad, CA 92008 Dear Paul: Reference is made to the ocean beachfront area presently leased to the City of Carlsbad by San Diego Gas & Electric Company (SDG&E). Please be advised that SDG&E is currently in the process of granting the State Department of Park and Recrea- tion permission to operate our Employee's Beach as a public facility. In negotiation with State Park and Recreation, they have inquired if it would be possible to include the beach area presently leased to you. While this request appears to have merit, we do not wish to proceed with further consideration without the City's concurrence. Because of present State/SDG&E beach ownership con- figuration and actual land use activities, it would appear somewhat advantageous if one agency were to control the com- bined area. Doing so would seem to simplify the need to provide necessary maintenance and lifeguard protection of the combined beaches. It would be appreciated if you would review this matter and advise if the City would be favorable to State Park and Recreation operating the ocean beach area presently leased from SDG&E.
