No. 1242^ recommending adoption of an amendment to the Floodplain Overlay Zone. The 'amendment provides for City initiated boundary adjustments when it has been determined that such property is not actually located in a f 1 ood-prone area . Exhibits: Planning Commission Resolution No. 1242 Staff Report dated Ap.ril 28, 1976 Recommendation : If the City Council concurs with the findings and recommendations of Planning Commission Resol ution' No . 1.242, the Council should in- struct the City Attorney to prepare the necessary documents. Council action *5-18-76 The Council concurred with the findings of the Planning Commission and the'City-Attorney was instructed to prepare the documents necessary for approval subject to the conditions contained in Resolution #1242 of the Planning Commission. PLANNING COMMISSION RESOLUTION NO. 1242 2 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING 3 FORTH ITS FINDINGS AND RECOMMENDATION RE- LATIVE TO AN AMENDMENT TO TITLE 21 OF THE 4 MUNICIPAL CODE, PROVIDING FOR CITY INITIA- TION OF BOUNDARY ADJUSTMENTS IN THE F-P 5 FLOODPLAIN OVERLAY ZONE CASE NO.: ZCA-766 7 0 WHEREAS, the Planning Commission of the City of Carlsbado _ did adopt Resolution of Intention No. 126 declaring its in-y tention to recommend to the City Council an Amendment to Title .... 21 of the Municipal Code; and 12 WHEREAS, the Planning Commission did hold a duly noticed Public Hearing to consider the subject amendment; and 14 WHEREAS, the Planning Commission received all testimony from those persons interested in and opposed to, if any, the proposed 16 Zone Code Amendment; and 17 WHEREAS, the Planning Commission did find that the proposed 18 amendment to Title 21 has complied with the requirements of the 19 .City of Carlsbad "Environmental Protection Ordinance of 1972" 20 because the proposed amendment is of^an administrative nature 21 and will therefore not have a significant impact on the physical 22 environment; and 23 WHEREAS, the Planning Commission did find that the proposed 24 amendment to Title 21 will help implement the intent of the 25 Geologic and Seismic Safety Element of the General Plan; and 26 WHEREAS, the Planning Commission did find the following 27 facts and reasons to be present which in their opinion are 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 necessary to carry out the general purpose of Title 21 of the Carlsbad Municipal Code: 1) The inclusion of land in the Floodplain (F-P) Overlay Zone is a potential hardship on the property owner. 2) It is therefore desirable to facilitate the removal of land from said zone when new information indicates that that land may not be actually located in a flood-prone area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad that it does recommend approval to the City Council of an amendment to Title 21 as follows: 21.31.025 - Zone Boundary Adjustments The Planning Commission shall initiate a zone change to remove the F-P overlay designation from a particular property upon report of the City Engineer that new information, including but not limited to updated topographic maps, updated meteorological reports, or updated Corps of Engineers studies, indicates that a floodplain boundary line is incorrect. If such a zone change is approved, appropriate documentation shall be forwarded to the Federal Insurance Administration to insure adjust- ment of said boundary line on Federal Flood Hazard Boundary Maps. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Planning Commission held on April 28, 1976, by the following vote, to wit: AYES: Commissioners Dominguez, Fikes, Jose, L'Heureux, Larson and Watson. A'gatep, Secretary V- ..--• v .> CITY OF CARLSBAD PLANNING DEPARTMENT STAFF REPORT April 28, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT CASE NUMBER: ZCA-76 - FLOODPLAIN OVERLAY ZONE APPLICANT: CITY OF CARLSBAD During public hearings last fall on the Floodplain rezonings (ZC-161, 162 and 163), Council directed Staff to prepare an amendment to Chapter 21.31 (F-P Zone) making provision for City-initiated F-P boundary adjustments when it has been determined that such property is not actually located in a flood-prone area. It is recommended that the following section by added to Chapter 21.31 of the Zoning Ordinance: "21.31.025 -Zone Boundary Adjustments: The Planning Commission shall initiate a zone change to remove the F-P overlay designation from a particular property. Upon report of the City Engineer that new information, including but not limited to updated topographic maps, updated meteorological reports, or updated Corps of Engineers studies, indicates that a floodplain boundary line is incorrect. In either case, if such a zone change is ap- proved, appropriate documentation shall be forwarded to the Federal Insurance Administration to in- sure adjustment of said boundary line on Federal Flood Hazard Boundary Maps."
