Statement of the Matter*
On April 28, 1976, the Planning Commission adopted Resolution No.
1243, recommending adoption of an amendment to the Open Space Zone
The-amendment provides for addition of certain agricultural uses
as permitted uses under the Open Space Zone Chapter 21.33, Section
21.33.020.

If the City Council concurs with the findings and recommendations
of Planning Commission Resolution No. 1243, the Council should in-
struct the City Attorney to.prepare the necessary 'documents.

for the Commission's consideration:
1. Chapter 21.33, 0-S Open Space Zone,
Section 21.33.020 -Permitted Uses and Structures.
It is recommended that the following change be made:
Section 21.33.020 of Chapter 21.33 is hereby amended by
addition thereto of subsection (14) which reads as
follows:
14) Agriculture —Only the following agricultural
uses are permitted in the 0-S Zone:
a) Field and seed crops;
b) Truck crops;
c) Horticultural crops;
d) Orchards and vineyards;
e) Pasture and rangeland;
f) Tree farms;
g) Fallow lands .

PLANNING COMMISSION RESOLUTION NO. 1243
RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, SETTING
FORTH ITS FINDINGS AND RECOMMENDATIONS RE-
LATIVE TO AN AMENDMENT TO TITLE 21 OF THE
MUNICIPAL CODE, PROVIDING FOR AGRICULTURAL
USES IN THE OPEN SPACE ZONE.
CASE NO.: ZCA-74
WHEREAS, the Planning Commission of the City of Carlsbad
did adopt Resolution of Intention No. 119 declaring its inten-
g tion to recommend to the City Council an Amendment to Title 21
of the Municipal Code; and
WHEREAS, the Planning Commission did hold a duly noticed
12!Public Hearing to consider the subject amendment; and
13 'WHEREAS, the Planning Commission received all testimony
141 from those persons interested in and opposed to, if any, the
15 proposed Zone Code Amendment; and
WHEREAS, the Planning Commission did find the following
facts and reasons to be present which in their opinion are
necessary to carry out the general purpose of Title 21 of the
19 Carlsbad Municipal Code:
20 1) A number of agricultural uses are considered consistent
with the intent of the Open Space Land Use and Zoning
categories.
2) Certain restrictions should apply to the type of agricul-
23 tural uses permitted, because of the location of several
0-S zoned parcels within or near urbanized areas.
24 3) The action complies with the Carlsbad Environmental
Protection Ordinance of 1972 because:
A negative declaration has been issued for the follow-
ing reason: This proposed ordinance amendment is of
administrative nature and will not have a direct or

significant impact on the physical environment.28

4) The General Plan considers agricultural uses desirable2 in open space designated areas.
3 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
4 of the City of Carlsbad that it does recommend approval to
5 the City Council of an amendment to Title 21 as follows:
6 Section 21.33020 of Chapter 21.33 is hereby amended
by addition thereto of subsection (14) which reads
as follows:
Q (14) Agriculture - Only the following agricultural
g uses are permitted in the 0-S Zone:
(a) Field and seed crops;
(b) Truck crops;
(c) Horticultural crops;
(d) Orchards and vineyards;

14 PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Planning Commission held on April 28, 1976, by
the following vote, to wit:
17 AYES: Commissioners Dominguez, Fikes, Jose, L'Heureux,
Larson and Watson.
18 NOES: None
19 ABSENT: None
