Statement of the Matter
Pursuant to Section 21.42.010 Para. 2(I), all public buildings are subject to the Conditional Use'Permit (CUP) sections of the Carlsbad Municipal Code.
The Staff processed a CUP for the use and restoration of the Magee .
House.
The Pla'nning Commission, at thefr meeting of April 28, 1976, approved 'CUP-118 - subject to 'conditions.
The Planning Commission action is final on' all CUP'S unless appealed to the City'Cnuncil by any interested or aggrieves oarty. is forwarding the Staff Report and Planning Commission resolution for information only.

. DENCE (MAGEE HOUSE) INTO A PUBLIC BUILD- ING FOR OFFICE AND ASSEMBLY PURPOSES, AS AUTHORIZED BY SECTION 21.42.010 (21) OF
THE MUNICIPAL CODE, ON PROPERTY LOCATED ON THE NORTH SIDE OF BEECH STREET BETWEEN
CARLSBAD BLVD. AND GARFIELD STREET.

WHEREAS, said verif.ied application c0nstitute.s a request
as provided by Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the applicant has complied with the Public
Facility Element of the City of Carlsbad and has provided the
necessary information which ensures Public Facilities will
be available and current with need; and

, WHEREAS, the subject application has complied with the
requirements of the City of Carl sbad "Environmental Protection
Ordinance of 1972" because a Negative Declaration of Environ-
mental Impact was prepared by the County in Connection with
its administration of the Community Development Block Grant .

(1)
The Negative Declaration was granted for the
.. This project proposes no grading or alt.eration of the existing topography; therefore, no adverse impacts on the physical environment are foreseen.

No new structures are proposed; therefore, there will be no significant growth-inducing irnpscts. ..
The majority of- the potential patrons of this center are in lower socio-economic brackets and many are handi- capped. Because 'most of these individuals are located in the Center City area and do not possess automobiles, this project will not indirectly generate significant amounts of motor vehicle emissi.ons.
WHEREAS, at said public hearing, upon hearing and consider-
ing the,testimony and arguments, if any, of all persons who
desired to be heard, said Commission considered all factors
relating to the Conditional Use Permit.
NOW, THEREFORE, BE IT RESOLVED BY THE Planning Commission
of the City of Carlsbad as follows:
(A) That the above recitations are true and correct.
(B) That the Planning Commission .makes the following findings of fact:
(1) The requested use is necessary and desirable for the development of the Community, is essentially in harmony with the various elements and objectives of
' the General Plan, and is not detrimental to existing uses or to uses specif.ically permitted in the aone in which the proposed use is to be located because:
(a) The City has had requests'from several civic groups for a place in which to hold meetings;
The General Plan Parks and Recreation Element recognizes the site as a potential parksite; and.
The .proposed public assembly building is a complementary use; and
The intensity of the proposed use is compatible with the intensity of existing and permitted

(2) The site for the intended use is adequate in size shape to accommodate the use because:
(C) That in view of the findings heretofore made and consider- ing the applicable law, the decision of the Planning Com- mission is to approve Case No. CUP-116, subject to the following conditions:
(a) The remodeling of the existing structure will , adapt it for assembly and meeting use.
(3) All yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained because:

'. (2) All exterior lighting shall be arranged-to reflect away from adjoining properties'and streets.

(4) Prior to the issuance of building permits the appli- cant shall submit a landscape and irrigation plan for the parking lot to the Parks and Recreation Director for his approval. Said landscaping and irrigation shall be installed prior to the issuance of occupancy

(5) The Park design and improvements of the area labeled Magee Park on Exhibit "A" shall be compatible with the lacation and use of Magee House. This requirement shall be met to the satisfaction of the Parks and Recreation Director.
