SUBJECT: CARNIVALS'AS PERMITTED IN SECTION 21 . 42 . 010(2)(D) OF THE CARLSBAD ZONING ORDINANCE Statement of th& Matter: At their May 26,.1976 meeting, the Planning Commission approved a Condi ti o.nal Use Permit for a Circus at the El Camino Real Shopping Center. During this hearing, the Planning Commission noted that there are approximately 3 to 4 similar requests made each year for activities at the Shopping Center. They also noted that most of the problems and decisions are administrative in nature and are handled by Staff -such as liability insurance, policing, fire protection regulations and clean-up. The Commission also noted that many of the applicants are unav/are of the requirement for -a Condi tional Use Permit and therefore always seem to have a problem meeting the public, hearing deadline. Therefore, the Planning Commission concluded that it would be advantageous to have administrative approval on these routine matters.- Presently the Zoning Code allows the City Manager to approve carnivals that are for a two-day duration as follows: Chapter 21.42.010 (2)(D), Zoning Ordinance: "Circuses and carnivals:" The city manager shall have authority to issue or deny a conditional use permit for circuses and carni- vals for a period not to exceed two days, as follows: "1 . Those sponsored by a school or church group; prov'ided that such use is confined to the sch'ool or .church property; "2. Those sponsored by a community group for a charitable cause, subject to provisions for liability insurance, police protection, cleaning and maintenanceā€¢as determined by the city manager." The Planning Commission suggests that this requirement be amended to pro- vide for City Manager approval of similar requests up to 5 days in duration Recommendation: If the City Council agrees with the Planning Commission, it is recommended that Staff be directed to prepare necessary documents for such change.
