The subdivider has requested that the subject tentative map be extended for an additional period of one year to July 2, 1977. The City Engineer advises that the Engineering, Planning, Building, and Fire Departments, L.C.W.D., O.M.W.D. , and S.D.C.F.C.D. have re- viewed the request. Having received no objection, it is recommended that the City Council approve the extension of the tentative map sub- ject to the execution and/or fulfillment of all the conditions of Resolution No. 3449, Resolution No. 3679 and Resolution No. Exhibit A. Units 1 through 3 have recorded but units 4 and 5 have been held up since January 1976. The sole problem has been in securing an off site drainage easement from Oakview Land Development Company. APPLICANT: PONDEROSA HOMES (KAISER-AETNA). WHEREAS, on the 24th day of January , 197_4_, the Carlsbad City Planning Commission adopted by motion a recommenda- tion to the City Council that Tentative Map (CT 73-18) be condi- tionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 18th day of June , 1974, considered the recommendation of the Planning Commission; and WHEREAS, the granting of said entitlement does not involve any environmental considerations not previously covered in the Environmental Impact Report (No. 122) which was certified for this project; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-18) is hereby approved, subject to the execution and/or fulfillment of the following conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, I limitations and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. I 2. The C.C.& R.'s for this development shall be sub- mitted to the Planning Director for review and approval prior to the issuance of any building permits. 3. In order to provide for reasonable fire protection during the construction period, the subdivider shall main- tain passable vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be installed as recommended 'by the Fire Department. 5. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City standards to the satisfaction of the City Engineer without cost to the City of Carlsbad and free of all liens and encumbrances. Improvement plans for water and sewer system shall meet the requirements of the respective service dis- tricts . 6. Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. The developer shall post a bond in the amount necessary to energize said street lights for an 18-month period after construc- tion to permit the incorporation of the subdivision into a maintenance district. 7. All land and/or easements required by this Ordi- nance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. This requirement shall include all easements dedicated to utility districts after approval of the Tentative Map by the City Council. 8. The subdivider shall dedicate to the public all rights of ingress and egress from lots abutting upon restricted access streets and roads over and across the lines of said lots abutting said streets and roads. This dedication shall be so designated on the certificate sheet of the final map with the intent that the owners of said lots will have no rights of access whatsoever to said streets and roads. The words "access rights dedicated to the City" shall be lettered along the road adjacent to the lots affected on the map proper. Olivenhain Road shall be considered a restricted access street in this instance. 9. The proposed street names are not approved. Street names shall be subject to approval and shall be designated in accordance with the standards and, policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to recordation of the final map. 10. All setbacks on the individual lots shall conform to the requirements for lots in the R-l zone district. 11. The applicant shall provide a fully actuated traffic signal at the intersection of El Camino Real and Olivenhain Road. 12. All.lots having double street frontage shall have the access to one of said streets relinquished to the City of Carlsbad in a manner acceptable to the City Engineer. 13. If required by the City Engineering office, the improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site. The report and plan shall be prepared by civil engineers licensed by the State of California and experi- enced in erosion control who shall be acceptable to the City Engineer, and they shall certify that they have in- vestigated the site and prepared data with full considera- tion of the consequences to the included arid neighboring properties. 15. The locations of parking, one side only, as indi- i cated for portions of Los Pinos Street, shall be subject to the approval of the City Engineer. 16. The horizontal alignment of the indicated Las Palmeras Way and Las Palmeras Street in the vicinity of proposed lots 280-298 and 320-331 shall be revised to eliminate a potentially hazardous curve in a manner accept- able to the City Engineer. C. That said Tentative Map, together with the provisions for its design and improvement and subject to the above conditions, is consistent with all applicable general and specific plans of the City of Carlsbad. APPLICANT: PONDEROSA HOMES WHEREAS, the City Council of the City of Carlsbad, on the second day of July, 1974, adopted Resolution No. 3449, approving with conditions tentative map CT 73-18; and WHEREAS, the City Council of the City of Carlsbad on the first day of July, 1975, granted a tentative map time extension for a period of one year; and WHEREAS, the subdivider has requested a one year extension of such map from July 2, 1976 to July 2, 1977; and WHEREAS, the City Council has determined to extend such map; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That tentative map CT 73-18 is hereby extended, subject to the execution and/or fulfillment of all the conditions of Reso- lution No. 3449 and 3679. C.
