UfAftJ Subject:CARNIVALS AS PERMITTED IN SECTION 21.42.010(2)(D) OF THE CARLSBAD ZONING ORDINANCE. Statement of the Matter The City Council at your meeting of June 15, 1976, directed the City Attorney to prepare the necessary documents amending Title 21, Chapter 21.42, Section 21.42.010, by the amendment of Subsection (2)(D) to authorize the City Manager to grant a conditional use permit for circuses and carnivals up to five days. The ordinance adopting said amendment is attached. Exhibit Ordinance No. 7^ & fa Recommendation If the Council concurs, your action is to introduce OrdinanceNO. Council action 7-6-76 Ordinance #9466 was introduced for a first reading, authorizing the City Manager to grant a CUP for circuses and carnivals up to five days. 7-20-76 Ordinance #9466 was given a second reading by title only and adopted. MANAGER TO GRANT A CONDITIONAL USE PERMIT FOR CIRCUSES AND CARNIVALS UP TO FIVE DAYS. The City Council of the City of Carlsbad does ordain as follows: SECTION 1: That Title 21, Chapter 21.42, Section 21.42.010, of the Carlsbad Municipal Code is amended by the amendment of Subsection (2)(D) to read as follows: "(2)(D) Circuses and carnivals: The city manager shall have authority to issue or deny a conditional use permit for circuses and carnivals for a period not to exceed five days, as follows: 1. Those sponsored by a school or church group; pro- vided that such use is confined to the school or church property; 2. Those sponsored by a community group for a charitable cause, subject to provisions for liability insurance, police protection, cleaning and maintenance as determined by the city manager." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
