SUBJECT: REQUEST FOR REVIEW FOR ZONING ORDINANCE TO PROVIDE
FOR SENIOR CITIZEN HOUSING
Statement of the
Mr. Bill Rick owner of property located generally on the northeast
corner of Jefferson Street and Oak Avenue, is requesting that the
City review standards of development for Senior Citizen housing in
multiple family zones. The staff is not in a position at this time
to present an analysis and recommend alternate development standards
for Senior Citizen housing.

RE: SENIOR CITIZEN HOUSING
Dear Mayor Frazee and Members of the City Council:
Rick Engineering Company, as the owner of a portion of Block 57, Town of
Carlsbad, feels it timely and wishes to propose construction of senior
citizen housing on its 140' x 200' property adjoining the westerly portion
of the City of Carlsbad's Senior Center.
We believe that we are in a position to proceed immediately to the con-
struction of such housing, if the City of Carlsbad finds that the community
interest will permit modifications to the present development regulations
so that they would permit utilization of this property in a more cost effec-
tive fashion.
Generally, our proposal is to construct 40 small one-bedroom apartments
aimed at individuals or couples who can afford approximately $150 per month
rental and who would be able to utilize all of the public and community facil-
ities within a short distance of this property, but who would not need, or
could not afford, automobile ownership.
It is our belief that success of the project depends upon the high density
proposed, combined with a low parking ratio. We have investigated the
matter and believe that the data support our proposal in this particular loca-
tion „
It is our request that you direct city staff to study and prepare possible
amendments to the ordinances and other regulations which might permit mod-
ifications necessary to accommodate such a proposal, should you find it in
the best interest of the City of Carlsbad to do so.

We are prepared to limit age qualifications and to provide a control on rent
as a condition of a workable permit.

SUBJECT: SENIOR CITIZEN HOUSING STANDARDS, PROCESS ALTERNATIVES
REF.: LETTER TO MAYOR AND CITY COUNCIL FROM BILL RICK OF
JUNE 17, 1976
Mr. Bill Rick has requested that the City Council review develop-
ment standards in multiple family zones to provide for Senior
Citizen Housing. Should the City Council feel a review of de-
velopment standards for Senior Citizen housing is appropriate,
the following discussion reflects necessary legislative processes
which must be considered concurrently.
A. General Plan
The Housing Element and Land Use Element address the
necessity of providing housing for all ages and income
levels in appropriate areas in the City specifically
the downtown. If the Council is desirous of pursuing
specific requirements for Senior housing, it will be
necessary to develop a Specific Plan to provide criteria
and standards for: Parking, setbacks, locations with
respect to public transit, and proximity to social and
professional services.
B. Zoning Ordinance (Residential Zones)
The current ordinance stipulates density, site coverage
and parking requirements for all developments without
regard to specialized housing types. Again if the
Council is desirous of creating standards for Senior
Citizen housing, the Council must consider the follow-
ing:
1) Parking: The requirements for parking are uniformly
applied at a ratio of spaces/number of bedrooms in
each unit on site. If alternative parking schemes
are to be considered, there must be a mechanism which
will provide necessary parking should the proposed
Senior Citizen residential unit be reverted to a
convential rental or condominium.
2) Density: Current standards for density are dictated
by the General Plan and the zoning ordinance. In-
creases beyond the permitted densities may only take
place after code amendment.
Therefore,

A. Code Amendment:
At the present time "Q" (Qualified) Zone and Conditional
Use Permit (CUP) processes are two which could implement
a Senior Citizens housing program. If these ordinances
were utilized, location, parking and density criteria
would have to be developed. There could be other kinds
of code amendments developed to meet the Council's desires.
However, only after thorough staff analysis can a preferred
alternative be recommended.
B. Process Variance:
In the staff's view, it would not be proper for the City
to process Senior Citizens housing programs which are at
variance with current codes because there are no unusual
circumstances, i.e., topography, slope, etc. which would
the City's consideration. State law is specific
and does not allow substantial latitude.
I would suggest that if the Council wishes to proceed, the staff be
instructed to prepare an analysis on the suggested development stan-
dards, criteria, etc. and the various methods to implement such a
program and return to the City Council with report and recommendation
