1976-77 Lighting Maintenance Districts
Statement of the Matter
On May 4, 1976, an estimate of expenses for the maintenance
operation of the street lighting system for 1976-77 was presented to
the City Council pursuant to Section 18730 of the Streets and Highways
Code.
The total cost of street lighting, except for street lighting of
City owned properties, was divided among the various properties in the
City in accordance with the benefits received.
The assessment roll (Exhibit 1) reflects individual assessments
to be levied against each property in the City. This roll must be
sent to the County Tax Collector prior to August 10, 1976 to have the
assessments placed on the 1976-77 Property Tax Bills.
The City must provide for the energizing and maintenance of the
lighting system or contract for the services. Since SDG&E is the only
company in this area capable of furnishing energy, the Council should
authorize an agreement with SDG&E in accordance with the rules and
rates of the Public 'Utilities Commission.

SUBJECT: Street Lighting Maintenance Districts
Installation of Street Light System
The system for lighting the public streets has evolved over a period of twenty (20)
years from no lighting to our present system. The initial street lights were in-
stalled (free of charge) at street intersections and the City is billed a monthly
charge for energy and maintenance. On occasion the City has requested the power
company to install lights on wood poles at locations other than intersections to
provide a higher level of lighting.
With the advent of the subdivision ordinance developers were required to install
ornamental street lights in front of new houses. Prior to 1972 these lights were
installed and owned by S.D.G.&E. and paid for by the developer. After 1972 the
lights were installed and paid for by the developers and owned by the City.
In 1966 an ornamental street light system was installed in the downtown area by
the City and paid for by the benefiting property owners.
Our present system consists of 330 lights on wood poles, 320 ornamental lights
owned by S.D.6.& E. and 890 ornamental lights owned by the City. The lights
owned by S.D.G.& E. remain relatively constant since there are few additions or
deletions. The city owned lights increase substantially (approximately 200) each
year due to the high rate of residential development.
Operation of the Street Light System
The entire street light system is energized by S.D.G.&E. and billed on a monthly
basis. Street lights owned by S.D.G.&E. are maintained by the company and this
cost is included in the rate schedule. Street lights owned by the City are main-
tained by City crews and the cost of maintenance is charged to the lighting main-
tenance districts.
Financing the Operation of the Street Light System
Prior to 1971 the cost of energizing and maintaining the street light system was
paid from the general fund. In 1971 the City Council established Lighting Main-
tenance Districts for the purpose of assessing the costs of energy, maintenance
and administration to property owners.
Three districts were established to reflect differences in types of lighting and
level of lighting as follows:
District No. 1 is comprised of S.D.G.&E. owned lights on wood poles at intersections
only. It is determined that each parcel in this district benefits equally from
intersection lighting regardless of size and location. District No. 1 is presently
comprised of 3114 assessable parcels and the amount to be assessed is $23,000.
This means that each parcel in District #1 will be assessed $7.34 to generate the
required revenues.

District No. 2 is comprised of S.D.G.&E. owned lights on wood poles located at
irregular intervals. Due to the irregularity of lot sizes and light spacing in
half of District No. 2, the lots benefit unequally. In this portion of the
district, assessments are on a front foot basis rather than a lot basis. This
simply means the total frontage of the lots in the zone are totaled and divided
into the total amount to be assessed. This yields a front foot factor which,
when multiplied by the lot frontage, yields a specific dollar amount. The
wider the lot the greater the assessment; the narrower the lot the smaller the
assessment.
District No. 3 is comprised of S.D.G.&E. and City owned lights on ornamental
standards. The majority of the lights are in newly developed residential areas
where lot sizes and light spacing is equivalent. In these residential areas it
is determined that each lot benefits equally and the assessment method is the
same as used in District No. 1.
In commercial and industrial areas the irregularity of lot sizes mandates use of
the front foot factor as used in portions of District No. 2.
The following is a breakdown of costs for each District for 1976-77:

Reduced Assessments
Many of the newer subdivisions have either a reduced assessment, or no assessment
at all this year. This is because the City collects deposits to cover street
lighting charges for the first 18 months at the time the final map of the sub-
division is approved. This assures timely energizing of street lighting "mid-
year" without being a financial drain on the established district. In another
specialized case, subdivisions that were developed in the county had special
county service districts for street lighting. These special districts have been
dissolved upon annexation to the City and district fund balances have been
transferred to the City. In some cases sufficient funds still exist, so that
there are no assessments to individual parcels for the following year.
City Participation
The City bears the cost of energy and maintenance for lighting of all City owned
parcels and a portion of the cost of lighting on major streets running through
residential areas. The remaining costs are assessed to property owners on a
benefit basis.

3 MENT ROLL FOR 1976-77 LIGHTING MAINTENANCE DISTRICTS
No. 1, 2, and 3

5 WHEREAS, the City Engineer on May 4, 1976 filed with the
City Council an estimate of costs fox' lighting maintenance district:
for 1976-77; and
WHEREAS, the expenses of maintenance and operation to be
borne by Districts No. 1, 2, and 3 shall be paid by special assess-
10 ment levies upon the land, exclusive of improvements within the
11 Districts; and
12 WHEREAS, the estimated costs of City participation in the
13 districts were estimated in the report by the City Engineer dated
14 May 4, 1976.
15 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
16 City of Carlsbad as follows:
17 1. That the above recitations are true and correct.
18 2. That the boundaries of the Districts shall remain as
19 shown on map entitled "Lighting Maintenance District Map 1975-77
20 on file in the Office of the City Clerk and incorporated herein
21 by reference.
22 3. That the items of maintenance for the lighting system
23 shall consist of electric power, relamping, cleaning of lenses
24 and repair or replacement of damaged circuits, luminaires and
25 standards and other necessary items as described in the Report
26 of the City Engineer to the City Council dated May 4, 1976, on
27 file in the Office of the City Clerk and incorporated by reference
28 herein. Said system shall be lighted from fifteen (15) minutes
29 after sunset until one-half hour (thirty minutes) before sunrise
30 each day in the year. The estimated cost for the first year of
31 the above items of maintenance is as follows:

4. That the City Council determines that there is only one
contractor practically capable of serving the street lighting
system and that such contractor is subject to the jurisdiction of
the Public Utilities Commission of the State of California, and
the City Council orders that the above described items of main-
tenance and operation be furnished from time to time as necessary
by the San Diego Gas and Electric Company, in accordance with the
rates and rules filed by it from time to time with said Public
Utilities Commission.
5. That the City Council orders that the percentage of the
total expenses of maintenance and operation to be paid by District
No. 1, 2, and 3 shall be paid by special assessment taxes levied
upon all the lands, exclusive of improvements, within said district
6. That the City of Carlsbad shall pay the following amounts
of the total expenses of maintenance and operation of said system:
District No. 1 $ 102.76
District No. 2 $ 439.08
District No. 3 $1,394.16
7. That the amount of the total expense of maintenance and
operation of said system to be paid by each district of assessment

against individual benefited parcels of land within each district
is as follows:

8. That the assessments as shown on the final assessment
roll be confirmed and that a certified copy of this resolution
and the confirmed assessment roll be forwarded to the County

6 WHEREAS, the City Council has by Resolution No. 3703 ordered the
7 formation of Lighting Maintenance Districts in the City of Carlsbad to
8 provide for the maintenance and operation of a street lighting system in
9 said City; and
10 WHEREAS, it is necessary for the City to contract for the energy
11 to power said system and for other necessary items for operation and
12 maintenance of said system as described in said resolution; and
13 WHEREAS, the San Diego Gas & Electric Company is the sole and only
14 source available to the City capable of performing said contracts which

are governed as to rates and rules by the California Public Utilities
Commission;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad as follows:
1. That the above recitations are true and correct. '
2. That the Mayor is authorized to execute on behalf*of the City
a contract with the San Diego Gas & Electric Company for the operation and
maintenance of the City in a form and with the terms and conditions as set
out in Exhibit "A" attached hereto and incorporated by reference herein.

AGREEMENT FOR STREET LIGHTING
SCHEDULE LS2-A
This Agreement is made and entered into as of the 7th _ jay of
, 19 76 , by and between SAN DIEGO GAS & ELECTRIC COMPANY,
a corporation, hereinafter called "Utility", and City of Caxlsbad
_ , hereinafter called "Applicant".
In consideration of the mutual promises herein, the parties agree as
follows :
1. Utility agrees to furnish electric energy and switching
service for ornamental street lights connected to system(s)
installed and owned by Applicant as described in Exhibit A,
attached hereto and made a part hereof.
2. Applicant agrees to take and pay monthly for said service
under the Utility's applicable rate schedules, attached hereto
and made a part hereof, for installations set forth in Exhibit
A for period of 1 yeara commencing . July l^th _ j
19 76 , or as soon thereafter as Utility is reasonably able to
supply said service.
3. The parties agree that upon the expiration of the original term,
this agreement shall be automatically extended for successive
terms of one year each; provided that this agreement may be
terminated by either party upon not less than 60 days written
notice prior to the expiration date of the original term or any
extended term.
4. The parties agree that no change shall be made in the above
street lighting system, except by modifications mutually agreed
upon in writing. By said modification new street lights may be
added under the applicable rate and Utility agrees to make any
necessary installations in accordance with its Rules and
regulations; provided that no change will be made in the location
of existing lights unless the expense thereof is paid by Applicant.
5. Applicant agrees that should service to any of the above described
street lights be discontinued during the first year of service
following installation, it shall pay to Utility the net installa-
tion and removal costs incurred by Utility to render such service.
Applicant further agrees that should said service be discontinued
during the second or third year, it shall pay to Utility said net
costs less l/24th of the total amount for each month that service
is continued beyond the first year.
6. Utility agrees to use reasonable diligence in providing uninter-
rupted service, but does not guarantee continuity or sufficiency
of supply of electric energy. If any of said street lights fail

to burn properly, or if for any reason Utility is unable to
supply energy for said lighting service, Applicant agrees
that the only liability of Utility shall be to rebate the
proportionate charge for the time that such lamps fail to burn,
excluding the time preceding notification to the Company of the
particular outage and the first 24 hour period thereafter.
7. Applicant agrees to be governed by the Utility's applicable
rates and Rules on file with the California Utilities Commission,
which rates and Rules are made a part hereof by reference, and a
copy of which will be furnished to Applicant upon request. This
Agreement shall at all times be subject to such changes or modifi-
cations as said Commission may, from time to time, direct in the
exercise of its jurisdiction.
8. Applicant may, with Utility's written consent, assign this
Agreement provided that the Assignee thereof agrees in writing
to perform the obligations and assume the liability hereunder.
Any assignment by Applicant which is not in accordance with this
provision shall be null and void and of no legal effect.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to
be executed for and on behalf of each, by their duly authorized agents, partners,
or corporate officers, as of the day and year first above written.
