Statement of the Matter
The City Council at your adjourned meeting of July 13, 1976
directed the City Attorney to prepare an ordinance eliminating
the requirement in the Municipal Code that all net revenues
from the transient occupancy tax be transferred to the Parks
and Recreation fund and expended for purposes of such fund. j
An ordinance repealing Section 3.12.150 which contains that
requirement is attached.

OF CARLSBAD, CALIFORNIA, AMENDING TI`.ILE 3,
3 CHAPTER 3.12, OF THE CARLSBAD MUNICIPAL CODE,
BY THE DELETION OF SECTION 3.12,150 TO REMOVE
4 THE RESTRICTIONS ON TFANSIENT OCCUPANCY TAX
REVENUES.

611 The City Council of the City of Carlsbad, California, does
711 ordain as follows:
8 SECTION 1: Title 3, Chanter 3.1.2 of the Carlsbad Municipal
9 Code is amended by the deletion of Section 3.12.150.
10 EFFECTIVE DATE: This ordinance shall be effective thirty days
11 after its adoption, and the City Clerk shall certify to the
12 adoption of this ordinance and cause it to be published at least

13 once in the Carlsbad JGurnal within fifteen days after its
