Statement of the Matter
The Developer, Douglass Southwest Corporation, have requested that a 12 Ft. Easement lying on Lot 62 of Carlsbad Tract 73-8 Unit No. 1, Map No. 8039, recorded on November 8, 1974 be quitclaim. The waterline easement is not
in use since the watermain originally designed and located in said easement
was deleted.

This Department has no objection to quitclaiming a water easement described in Mr. R. E. Epson's request. It was not used for the intended purpose and we are not going to use it in the future.

Dear Mr. Flanagan:
This is a request that a 12' water easement shown on Map
No. 8039, adjacent to Lot $52, be abandoned by the City of
Carlsbad.: ,This easement is no longer required by the Water
Department since the 10" A.C.P. uater main originally planned,
has been deleted. This change is shown on Sheet 10 of the
Improvement Plans, Carlsbad Palisades, Tract 73-8, Unit No. I.

Since I am starting construction on the tbenty-nine (29)
units of Pad I1 immediately, I would appreciate anything you
could do to expediate this matter. The easement is presenting
a problem,in as much as the front porch of said Lot #52 is
situated partially or, the easement and the Building Department
is requiring a modification of our plans unless it can be
ab an d on e d .
